Viabilidad económico-financiera de la concesión.</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>ESTUDIO DE VIABILIDAD ECONÓMICA DE LA CONCESIÓN DEL SERVICIO DEL CENTRO DE RECEPCIÓN DE VISITANTES DEL CASTILLO DE BELLVER CON UN BAR Y UNA TIENDA</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1. Objeto y justificación del estudio.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Como actuación previa a la contratación de una concesión de servicios para CENTRO DE RECEPCIÓN DE VISITANTES DEL CASTILLO DE BELLVER CON UN BAR Y UNA TIENDA se redacta el presente estudio económico.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En este documento se desarrollan los aspectos más importantes que configuran la concesión del servicio que incluye el bar y tienda para los visitantes del Castell de Bellver y su entorno.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La duración de la concesión de servicio de bar y la tienda en el Centro es de cuatro años, con posibilidad de prórroga de un año, lo que hace un total de cinco años. El horario mínimo de apertura es el mismo que el del Castillo de Bellver, con posibilidad de apertura como máximo según el horario de apertura del Bosque. Deberá prestarse el servicio de bar durante los eventos programados por parte del Ayuntamiento que está previsto un horario desde las 19 horas hasta las 23 horas en época de verano.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El presente Estudio económico se redacta de conformidad con lo dispuesto en el artículo 285.2 de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, por la que se transponen al ordenamiento jurídico español las Directivas del Parlamento Europeo y del Consejo 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014 (en adelante LCSP), norma que exige que en los contratos de concesión de servicios la tramitación del expediente vaya precedida de la realización y aprobación de un estudio de viabilidad o viabilidad económico-financiera, en su caso.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No se estipula, sin embargo, en qué casos se podrá optar por una u otra opción. El contenido de este estudio, por analogía, será el establecido en el artículo 247.2 de la LCSP correspondiente a las actuaciones preparatorias del contrato de concesión de obras. Es por ello que para determinar la idoneidad de una u otra figura de estudio atenderemos lo que se establece en el artículo 247.6 de la LCSP, que especifica que siempre que sea de forma motivada “por la naturaleza de la obra, por su finalidad o por la cuantía de la inversión requerida”, se podrá sustituir la elaboración de un estudio de viabilidad, por un estudio de viabilidad económico financiera cuando se considere suficiente en atención a la naturaleza y finalidad de la obra o cuantía de la inversión requerida.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En consecuencia, la LCSP establece la posibilidad de acordar la sustitución del estudio de viabilidad por un estudio de viabilidad económico-financiera cuando se considere suficiente en atención a la naturaleza y finalidad de la obra o cuantía de la inversión requerida.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo que dispone el artículo 247.6 de la LCSP, vistas la duración de la concesión, la escasa cuantía y la naturaleza de la inversión prevista para llevar a cabo la prestación del servicio de bar, se considera adecuado un estudio económico de viabilidad puede dar justificación a la determinación del canon y de la rentabilidad de la explotación económica,</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2. Finalidad y justificación del servicio.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La finalidad del contrato propuesto es la gestión mediante concesión de servicios, del servicio de bar y tienda por los visitantes del Museo y del Castillo de Bellver que se financiará con los ingresos de las ventas a particulares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por tanto, la finalidad de la concesión es fundamentalmente dar el servicio de bar a las personas que acceden al Castillo de Bellver y al Museo, al mirador de Bellver, a las zonas verdes e instalaciones del bosque en general, a la vista de que no hay otro servicio similar cerca, al menos, en tres kilómetros y la posibilidad de adquisición de artículos relacionados con el museo de Bellver como promoción cultural.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este lugar cultural, turístico y natural no dispone en la actualidad de un servicio de bar para los visitantes y en general para la ciudadanía, para satisfacer las posibles necesidades de personas que acceden al mismo, ya sea a pie o en cualquier tipo de vehículo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La venta de productos relacionados con el Museo promociona la cultura y la historia del Castillo de Bellver y de la ciudad.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. Justificación del contrato de concesión de servicios.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo que dispone el artículo 15 de la LCSP, el contrato de concesión de servicios es aquél en virtud del cual el poder adjudicador encomienda a título oneroso a una o varias personas, naturales o jurídicas, la gestión de un servicio cuya prestación sea de su titularidad o competencia, y cuya contrapartida venga constituida bien por el derecho a explotar los servicios objeto del contrato o bien por este derecho acompañado del de percibir un precio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Este derecho de explotación de los servicios implica la transferencia al concesionario del riesgo operacional, abarcando el riesgo de demanda, el de suministro, o ambos. Se entiende por riesgo de demanda lo que se debe a la demanda real de los servicios objeto del contrato y riesgo de suministro lo relativo al suministro de los servicios objeto del contrato, en particular el riesgo de que la prestación de los servicios no se ajuste a la demanda.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Así, la elección de este modelo de contratación se encuentra justificada a la vista de que el Ayuntamiento no dispone de medios humanos y materiales adecuados y este servicio se puede financiar con los ingresos provenientes de las ventas lo que implica que la administración no debe destinar recursos económicos públicos para la prestación de los servicios.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Téngase en cuenta en este sentido que la transferencia al concesionario del riesgo operacional implicará la exposición del servicio a las incertidumbres del mercado, pero a la vista de las estadísticas del número de visitantes en el Castillo, así como las personas que acceden a las zonas naturales del bosque y la carencia de un servicio similar cercano, se estima que está garantizada la rentabilidad por el concesionario con una gestión prudente.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4. Visitantes del castillo de Bellver.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La demanda de uso del servicio de Centro de Recepción de Bellver se fundamenta en los datos reales de visitas al Castillo de Bellver y su Museo, y las personas que acceden a las zonas verdes y al mirador.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto a los eventos, de acuerdo con la información facilitada por los responsables del Castillo, están previstos unos 45 eventos culturales en verano. El número de eventos es de aproximadamente 45, con un horario de 19.00 h. hasta las 23:00 h., dentro del período del 1 de junio y 15 de septiembre. En cada uno de los eventos se prevé un máximo de 400 asistentes (máximo en total 18.000 asistentes potenciales). Durante dicho período de verano el adjudicatario debe tener abierto el servicio de bar que dé servicio a los asistentes de estos eventos.&nbsp;Visto que el objeto de la visita y el horario son diferentes, se considera que no son los propios visitantes del castillo, ya computados en el cuadro anterior.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. Duración de la concesión y riesgos operativos y tecnológicos.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La duración de la concesión quedará establecida en el plazo de cuatro años, con una posible prórroga de un año.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Durante los años que dura la concesión y, según establece la ley, la empresa concesionaria asumirá el riesgo operacional que implicará la exposición del servicio a las circunstancias del mercado. Pero visto el incremento de las personas visitantes tanto en el castillo como en el museo, y en las zonas verdes, así como la carencia de un bar cerca de este lugar, se estima que está garantizada la rentabilidad por el concesionario con una prudente gestión empresarial.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6. Costes e ingresos del concesionario. Previsión de cuenta de resultados y rentabilidad.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.1 Local e inversión en equipo.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La prestación del servicio se desarrollará en el Centro de recepción del castillo, un local descrito en los pliegos técnicos que ha sido objeto de tareas de mantenimiento y adecuación por parte de los servicios de Infraestructuras municipales y por tal se considera que se ha actualizado el aspecto y la funcionalidad de este.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La puesta en marcha del servicio de bar hace necesaria la adquisición de los siguientes elementos de equipamiento:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a)&nbsp;Maquinaria.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El local actualmente dispone de alguna maquinaria, pero, a la vista de que no se ha podido comprobar el funcionamiento, se prevé que el concesionario adquiera la totalidad del mismo y adecuar los elementos como son lavavajillas, horno, planchas, freidoras, elemento de frío, expositores, y maquinaria diversa como microondas, exprimidores, cortadoras y mandolinas.</span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">b)&nbsp;Mobiliario.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se trata de la adquisición de mesas y sillas, así como taburetes de bar y estanterías. font-size:12px">Respecto a las inversiones de la tienda, consta en los pliegos técnicos que se dispone del mobiliario adecuado para la prestación del servicio, excepto el caso de la adquisición de un equipo informático de gestión de inventario y pagos e impresora que, de acuerdo con consultas de proveedores especializados publicados en internet, el coste de la inversión de un pack estándar para pyme es de 1.250 euros</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.2 Horario de apertura y prestación de los servicios.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo dispuesto en los pliegos, se segmenta el período anual en dos tramos:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6.4 Coste de personal.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El coste de personal es un coste para el concesionario, y la plantilla puede variar dada la estacionalidad de las visitas al centro de recepción del castillo, lo que puede implicar esta variabilidad de clientes potenciales y por tanto de volumen de negocio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Así, como consecuencia de la estacionalidad en el número de visitantes según los datos históricos del servicio municipal de Cultura, hace que se requiera la contratación para el bar de:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">dos personas en temporada de otoño-invierno,</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">tres personas en temporada primavera-verano.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">un posible refuerzo por puntas de trabajo y/o absentismo.</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además, se ha tenido en cuenta el horario mínimo de la prestación de servicios de bar exigido en los pliegos de acuerdo con los horarios de apertura del castillo (ver cuadro 4), las horas máximas de trabajo del personal de acuerdo con la normativa laboral.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Es de aplicación al personal contratado el convenio colectivo laboral de hostelería de la Comunidad Autónoma de las Islas Baleares publicado en el BOIB número 51, de 22 de abril de 2023.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el coste de personal se incluyen todas las condiciones más favorables del convenio laboral, entre ellas el sueldo bruto mensual, el tiempo máximo de la jornada laboral, vacaciones, plus desplazamiento, vestuario, etc. y una estimación del coste de Seguridad Social de un 30,48%.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con la variación del número de visitantes en el castillo y en el museo, se ha calculado la necesidad de dos trabajadores en temporada de otoño-invierno y tres el resto del año.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo que disponen los pliegos técnicos, el horario mínimo de apertura del bar es, como mínimo, el mismo que el del Castillo de Bellver y como máximo el mismo que el de apertura del bosque.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los horarios actuales del Castillo de Bellver son los siguientes:</span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Horario de verano (desde el mes de abril al mes de septiembre): de martes a sábado de 10 a 19 h (9 h) y domingos y festivos de 10 a 15 h (5 h).</span></span><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Horario de invierno (desde octubre a marzo): de martes a sábado de 10 a 18 h (8 h) y domingos y festivos de 10 a 15 h (5 h).</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con los pliegos técnicos, están previstos unos 45 eventos, con un aforo máximo de 400 personas. El horario es de 19:00 h. a 23:00 h. Este servicio supone la prestación del servicio de 180 horas por este concepto.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En atención a dicho horario, las horas de apertura del servicio de bar durante el año, se han estimado en un total de 2.543 horas, de acuerdo con lo que se indica en el cuadro 4 anterior.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con lo dispuesto en el convenio colectivo aplicable, el número anual máximo de horas por persona será de 1.776.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otra parte, debe tomarse en consideración, a efectos de la estimación del coste de personal, el índice de absentismo laboral del sector de hostelería y restauración, estimado en el 6%.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">A partir de todo lo indicado (horas anuales de apertura, horas máximas según convenio laboral, índice de absentismo y personal mínimo requerido) la ratio de cobertura del personal para la prestación del servicio se estima en 1,5320 pax prestación/pax presencial. en consecuencia, la plantilla requerida para la adecuada prestación del servicio en temporada invierno y verano se estima en 3,2 y 4,8 empleados, respectivamente, según el siguiente detalle:</span></span></p> <table border="1" cellspacing="0" class="Table" style="border-collapse:collapse; font-size:12px">En cuanto a los eventos, el Ayuntamiento estima la programación de unos 45 en época de verano entre los días 1 de junio al 15 de septiembre, y el concesionario deberá prestar el servicio de bar, con un preaviso de un mes. El horario es de 19 h a 23 h.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por el cálculo de los clientes potenciales, el aforo de los eventos es de unas 400 personas. font-size:12px">A partir de la previsión del coste de personal (145.034 euros), se estima una cifra potencial de ingresos de 446.261 euros.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contraste del cálculo de estimación de los ingresos del bar:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">No se dispone de información real a la vista de que los antecedentes de la explotación previa no se corresponden con la situación de mercado actual.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con las estadísticas de visitantes y la media de los dos últimos años post-pandemia, se puede calcular que se pueden esperar a unos 337.593 visitantes con un criterio de prudencia.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En base a estas estimaciones, se podría considerar que uno de cada tres visitantes del centro de recepción del Castell de Bellver podría consumir en el bar un consumo medio de 4 euros por persona, teniendo en cuenta que, habrá clientes de bajo gasto y otros con un consumo superior a la vista de que, según los pliegos, los productos ofrecidos van desde una botella de agua, snacks o platos elaborados.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otra parte, la gestión y medios que el concesionario aplique en la gestión del negocio serán claves para dinamizar la demanda y garantizar la rentabilidad. Además, debe recordarse que la zona de influencia de la concesión se amplía visto que el bar más cercano está ubicado a más de dos km de distancia.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta estimación se ha realizado en un escenario de normalidad. El concesionario asume el riesgo de la concesión pero con una gestión prudente y adecuada podría ampliarse la facturación del bar si se da un servicio con una buena relación de calidad-precio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se ha considerado que, además de los visitantes del Castillo de Bellver, hay personas que acuden al mirador o al bosque que también podrían considerarse clientes potenciales, pero de los que no se disponen datos objetivos para computar.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En este entorno, en el supuesto de un potencial de consumidores de 338 mil personas, con una estimación de consumos uno de cada tres y un gasto medio por consumidor de 4€, resultaría una cifra de negocio estimada en torno a los 451 mil euros, lo que supone una desviación de aproximadamente el 1% respecto a la cifra estimada en el presente informe (446 miles de euros), lo que induce a considerar la bondad de las estimaciones realizadas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esto supone que la aplicación de las ratios del sector y la prudente estimación de los clientes potenciales con un consumo medio dan el mismo resultado de facturación y de estimación de la cifra anual de negocio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En lo que se refiere a la previsión de los ingresos de la tienda, no se disponen de datos de servicios anteriores o de referencia del sector, por lo que, se parte de la misma proyección que en el caso del servicio del bar, con la estimación de los clientes potenciales y consumo medio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En consecuencia, se estima que una de cada 4 personas (25%) visitantes del Castell serán compradoras de productos de la tienda, con una compra media de 2,5 euros.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Se han consultado la documentación de expedientes con el mismo objeto del contrato, y en concreto, los estudios de viabilidad de la licitación de la tienda del Museo Nacional Centro de Arte Reina Sofía de diciembre de 2023 y de la tienda librería de Museo de Historia de Madrid y del Planetario, de 2020, a fin de conocer la estructura de costes y estimado de facturación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
