20965 282940 CAIB 720 2024-05-04 text/html 686010 es ![CDATA[Notificación de resoluciones de nombramiento como entidades colaboradoras, de la campaña de concesión de subvenciones en los establecimientos adheridos a un centro comercial virtual o plataforma de marketplace municipal]] CAIB 2024-05-03 2024-05-04 CAIB ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El artículo 14 de las bases reguladoras y convocatoria para la concesión de subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma de marketplace municipal, aprobadas por Junta de Gobierno Local de fecha 6/11/2023 y publicadas en el BOIB nº156 de 16/11/2023, especifica que la resolución del procedimiento de selección de las entidades colaboradas se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el artículo 45.1 de la ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las solicitudes de nombramiento de entidades colaboradoras de bonos 2023-2024 se han ido tramitando según lo establecido en las bases que rigen el procedimiento de concesión, la ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y la ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La Teniente de Alcalde delegada de Comercio ha ido dictando diferentes resoluciones. </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Resolución de fecha 29/11/2023:</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<span style="color:#000000"><strong>INFORME DEL ÓRGANO INSTRUCTOR EN RELACIÓN A LA PRIMERA PROPUESTA DE RESOLUCIÓN RESPECTO A LAS SOLICITUDES DE NOMBRAMIENTO DE ENTIDADES COLABORADORAS PARA LA GESTIÓN DE LAS SUBVENCIONES “VALES DESCUENTO 2023-2024”</strong></span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>ANTECEDENTES DE HECHO</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>En fecha 6/11/2023 se aprobaron por Junta de Gobierno Local, las bases reguladoras y convocatoria para la concesión de subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma de marketplace municipal. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong>En fecha 16/11/2023, se publicaron en el BOIB nº 156, el extracto de la convocatoria y las bases reguladoras anteriormente precitada. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> En fecha 17/11/2023, se ha abierto el plazo para presentar las solicitudes de nombramiento de entidad colaboradora en la campaña de los bonos 2023-2024. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>Se ha comprobado, por parte de la sección administrativa de comercio, que las solicitudes presentadas hasta el día de hoy cumplen con los requisitos establecidos en las bases reguladoras para poder ser entidad colaboradora. Para que, a través de un convenio de colaboración con el Ayuntamiento de Calvià, se encargue de la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma marketplace. </span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;<span style="color:#000000"><strong>VALORACIÓN JURÍDICA</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>La presente convocatoria, se rige en las bases reguladoras publicadas en el BOIB nº 156 y en lo no regulado en ellas, por las siguientes normativas: </span></span></span></p> <ol> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>LGS</strong>).</span></span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Real Decreto 887/2006</strong>, de 21 de julio, por el que se aprueba el Reglamento de la <strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>RLGS</strong>).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Decreto legislativo 2/2005</strong>, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones (en adelante <strong>TRLS</strong>).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Ley 39/2015</strong>, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante <strong>LPACAP</strong>).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> </li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <ol style="list-style-type:lower-alpha"> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La relación de solicitudes presentadas</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La relación de solicitudes admitidas</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> </li> <li> <p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Recursos que se pueden presentar contra la resolución.</span></span></p> </li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> En fecha 17/11/2023, se ha abierto el plazo para presentar las solicitudes de nombramiento de entidad colaboradora en la campaña de los bonos 2023-2024. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>Se ha comprobado, por parte de la sección administrativa de comercio, que las solicitudes presentadas hasta el día de hoy cumplen con los requisitos establecidos en las bases reguladoras para poder ser entidad colaboradora. Para que, a través de un convenio de colaboración con el Ayuntamiento de Calvià, se encargue de la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma marketplace. </span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>VALORACIÓN JURÍDICA</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>La presente convocatoria, se rige en las bases reguladoras publicadas en el BOIB nº 156 y en lo no regulado en ellas, por las siguientes normativas: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>8. Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>LGS</strong>).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9. Real Decreto 887/2006</strong>, de 21 de julio, por el que se aprueba el Reglamento de la <strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>RLGS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>10. Decreto legislativo 2/2005</strong>, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones (en adelante <strong>TRLS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>11. Ley 39/2015</strong>, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante <strong>LPACAP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>12. Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>13. Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>14. Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">f. La relación de solicitudes presentadas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">g. La relación de solicitudes admitidas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">h. La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">i. La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">j. Recursos que se pueden presentar contra la resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. font-size:12px">“<span style="color:#000000"><strong>INFORME DEL ÓRGANO INSTRUCTOR EN RELACIÓN A LA TERCERA PROPUESTA DE RESOLUCIÓN RESPECTO A LAS SOLICITUDES DE NOMBRAMIENTO DE ENTIDADES COLABORADORAS PARA LA GESTIÓN DE LAS SUBVENCIONES “VALES DESCUENTO 2023-2024”</strong></span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>ANTECEDENTES DE HECHO</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>En fecha 6/11/2023 se aprobaron por Junta de Gobierno Local, las bases reguladoras y convocatoria para la concesión de subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma de marketplace municipal. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong>En fecha 16/11/2023, se publicaron en el BOIB nº 156, el extracto de la convocatoria y las bases reguladoras anteriormente precitada. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> En fecha 17/11/2023, se ha abierto el plazo para presentar las solicitudes de nombramiento de entidad colaboradora en la campaña de los bonos 2023-2024. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>Se ha comprobado, por parte de la sección administrativa de comercio, que las solicitudes presentadas hasta el día de hoy cumplen con los requisitos establecidos en las bases reguladoras para poder ser entidad colaboradora. Para que, a través de un convenio de colaboración con el Ayuntamiento de Calvià, se encargue de la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma marketplace. </span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>VALORACIÓN JURÍDICA</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>La presente convocatoria, se rige en las bases reguladoras publicadas en el BOIB nº 156 y en lo no regulado en ellas, por las siguientes normativas: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>15. Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>LGS</strong>).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>16. Real Decreto 887/2006</strong>, de 21 de julio, por el que se aprueba el Reglamento de la <strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>RLGS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>17. Decreto legislativo 2/2005</strong>, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones (en adelante <strong>TRLS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>18. Ley 39/2015</strong>, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante <strong>LPACAP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>19. Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>20. Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>21. Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">k. La relación de solicitudes presentadas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">l. La relación de solicitudes admitidas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">m. La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">n. La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">o. Recursos que se pueden presentar contra la resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. Para que, a través de un convenio de colaboración con el Ayuntamiento de Calvià, se encargue de la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma marketplace. </span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>VALORACIÓN JURÍDICA</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>La presente convocatoria, se rige en las bases reguladoras publicadas en el BOIB nº 156 y en lo no regulado en ellas, por las siguientes normativas: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>22. Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>LGS</strong>).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>23. Real Decreto 887/2006</strong>, de 21 de julio, por el que se aprueba el Reglamento de la <strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>RLGS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>24. Decreto legislativo 2/2005</strong>, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones (en adelante <strong>TRLS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>25. Ley 39/2015</strong>, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante <strong>LPACAP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>26. Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>27. Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>28. Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">p. La relación de solicitudes presentadas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">q. La relación de solicitudes admitidas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">r. La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">s. La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">t. Recursos que se pueden presentar contra la resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. font-size:12px">“<span style="color:#000000"><strong>INFORME DEL ÓRGANO INSTRUCTOR EN RELACIÓN A LA QUINTA PROPUESTA DE RESOLUCIÓN RESPECTO A LAS SOLICITUDES DE NOMBRAMIENTO DE ENTIDADES COLABORADORAS PARA LA GESTIÓN DE LAS SUBVENCIONES “VALES DESCUENTO 2023-2024”</strong></span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>ANTECEDENTES DE HECHO</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>En fecha 6/11/2023 se aprobaron por Junta de Gobierno Local, las bases reguladoras y convocatoria para la concesión de subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma de marketplace municipal. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong>En fecha 16/11/2023, se publicaron en el BOIB nº 156, el extracto de la convocatoria y las bases reguladoras anteriormente precitada. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> En fecha 17/11/2023, se ha abierto el plazo para presentar las solicitudes de nombramiento de entidad colaboradora en la campaña de los bonos 2023-2024. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>Se ha comprobado, por parte de la sección administrativa de comercio, que las solicitudes presentadas hasta el día de hoy cumplen con los requisitos establecidos en las bases reguladoras para poder ser entidad colaboradora. Para que, a través de un convenio de colaboración con el Ayuntamiento de Calvià, se encargue de la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables en los establecimientos adheridos a un centro comercial virtual o plataforma marketplace. </span></span></span></p> <p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>VALORACIÓN JURÍDICA</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- </strong>La presente convocatoria, se rige en las bases reguladoras publicadas en el BOIB nº 156 y en lo no regulado en ellas, por las siguientes normativas: </span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>29. Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>LGS</strong>).</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>30. Real Decreto 887/2006</strong>, de 21 de julio, por el que se aprueba el Reglamento de la <strong>Ley 38/2003</strong>, de 17 de noviembre, General de Subvenciones (en adelante <strong>RLGS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>31. Decreto legislativo 2/2005</strong>, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de subvenciones (en adelante <strong>TRLS</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>32. Ley 39/2015</strong>, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (en adelante <strong>LPACAP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>33. Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>34. Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>35. Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">u. La relación de solicitudes presentadas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">v. La relación de solicitudes admitidas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">w. La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">x. La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">y. Recursos que se pueden presentar contra la resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. Ley 40/2015</strong>, de 1 de octubre, de Régimen Jurídico del Sector Público (en adelante <strong>LRJSP</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>41. Ley 19/2013</strong>, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno (en adelante <strong>Ley 19/2013</strong>).</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>42. Real Decreto 130/2019</strong>, de 8 de marzo, por el que se aprueba la Base de Datos Nacional de Subvenciones y la publicidad de las subvenciones y demás ayudas públicas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Además de la citada normativa, se aplicarán las restantes normas de derecho administrativo y, en su defecto, el derecho privado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Se deberá cumplir lo señalado en las bases de ejecución del presupuesto municipal del ejercicio 2023. En concreto, su sección VII: Régimen de las subvenciones, en el que se establece el Plan Estratégico de subvenciones del Ayuntamiento de Calvià. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- </strong> El artículo 12.1 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones, establece que serán entidades colaboradoras, aquellas que, actuando en nombre y por cuenta del órgano concedente a todos los efectos relacionados con la subvención, entregue y distribuya los fondos públicos a los beneficiarios cuando así se establezca en las bases reguladoras, o colabore en la gestión de las subvenciones sin que se produzca la previa entrega y distribución de los fondos.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.- </strong>El artículo 3 de las bases establece los órganos competentes para la ordenación, instrucción y resolución del procedimiento de concesión de las subvenciones.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>CUARTO.- </strong>En el capítulo III de las bases reguladoras y convocatoria que rigen el procedimiento de concesión se regulan las entidades colaboradoras. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>QUINTO.- </strong>El artículo 13 y siguientes de las bases regulan la instrucción de las solicitudes de adhesión que se presentan. En estos artículos se prevé: </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Artículo 13. Instrucción de solicitudes </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- No habrá selección de solicitudes por cuanto serán admitidas todas aquellas que se presenten en plazo y cumplan los requisitos establecidos en las presentes bases y, si acaso, en la convocatoria.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- Una vez cerrado el plazo de presentación de solicitudes, la sección de Comercio del Servicio de Comercio y Actividades realizará una verificación documental y el cumplimiento, por parte de los solicitantes, de los requisitos. Dicha sección será el órgano instructor del procedimiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- En caso de detectarse defectos u omisiones subsanables, o que se necesitara información complementaria, se requerirá al solicitante, mediante notificación, para que en un plazo máximo de diez (10) días subsane las faltas o acompañe los documentos preceptivos, con indicación de que, si así no lo hiciera, se le tendrá por desistido de su petición, previa resolución que deberá ser dictada en los términos previstos en el <strong>artículo 21</strong> de la <strong>LPACAP</strong>.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- Una vez evaluadas las solicitudes la sección de Comercio emitirá un informe con propuesta de resolución en el que se concrete el resultado de la evaluación efectuada y se establezcan las solicitudes que se autorizan y aquellas que se deniegan. El informe estará debidamente motivado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Debido a que las entidades colaboradoras poseen un largo plazo para presentar las solicitudes se harán informes propuesta cada cierto tiempo, incluso con anterioridad a la finalización del plazo de presentación.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 14. Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.- El/la Teniente de Alcalde delegado/a de Comercio resolverá el procedimiento de selección de entidades colaboradoras mediante resolución que pondrá fin a la vía administrativa.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2.- La resolución deberá dictarse y notificarse en un plazo máximo de tres (3) meses a partir de la fecha de finalización del plazo de presentación de solicitudes.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3.- La resolución se notificará a los interesados mediante su publicación en el BOIB, surtiendo dicha publicación los efectos de la notificación de acuerdo con el <strong>artículo 45.1</strong> de la <strong>LPACAP</strong>. Asimismo se publicará en la página web municipal.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La publicación se hará en el plazo de diez (10) días a partir de la fecha en que haya sido dictada, en los términos establecidos en los <strong>apartados 2</strong> y <strong>3 </strong>del <strong>artículo 45</strong> de la <strong>LPACAP</strong>, sin perjuicio de la remisión de la información correspondiente a la Base de Datos Nacional de Subvenciones (en adelante <strong>BDNS</strong>).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4.- El vencimiento del plazo máximo sin haberse notificado la resolución, legitima a los interesados para entender desestimada, por silencio administrativo, la solicitud de concesión de la condición de entidad colaboradora.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5.- La resolución deberá incluir los siguientes términos:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">z. La relación de solicitudes presentadas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">aa. La relación de solicitudes admitidas</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">ab. La relación de las solicitudes para las que se propone la concesión de la condición de entidad colaboradora, incluyendo, si es posible en base a la legislación de protección de datos personales: razón social, o nombre completo, y NIF.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">ac. La relación de solicitudes desestimadas y los motivos de la desestimación.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">ad. Recursos que se pueden presentar contra la resolución.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 15. Convenios de colaboración</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- De acuerdo con el <strong>artículo 16.1</strong> de la <strong>LGS</strong>, de 17 de noviembre, se formalizará un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por éstas, conforme al modelo establecido en la correspondiente convocatoria.”</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Por todo ello, una vez revisadas las solicitudes presentadas, en base a lo previsto en el artículo 13 de las bases que rigen el procedimiento, según lo dispuesto en el artículo 21.1.letra s) de la Ley 7/1985, de 2 de abril, Reguladora de las Bases del Régimen Local y de acuerdo con la normativa e informe citados, se propone a la Teniente de Alcalde delegada de Turismo, Comercio, Actividades, Playas y Litoral, que adopte la siguiente,</span></span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>RESOLUCIÓN</strong></span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>PRIMERO.- AUTORIZAR </strong>el nombramiento como entidades colaboradoras las solicitudes indicadas en el anexo I, para que colaboren en la gestión de las subvenciones a través de la adquisición de bonos descuento canjeables, en la campaña de los bonos descuento 2023-2024, en base al listado de solicitudes presentadas.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>SEGUNDO.- FORMALIZAR </strong>con cada una de las solicitudes admitidas, un convenio de colaboración entre el Ayuntamiento de Calvià y las entidades colaboradoras en el que se regularán las condiciones y obligaciones asumidas por ambas partes, conforme al modelo establecido en la correspondiente convocatoria. </span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>TERCERO.-</strong> <strong>PUBLICAR</strong> en el BOIB de la presente resolución, surtiendo dicha publicación los efectos de notificación de acuerdo con lo establecido en el artículo 45.1 de la <strong>LPACAP</strong>. El plazo para interponerlo es de un mes a contar desde el día siguiente al de la recepción de la presente notificación, no pudiendo, en este caso, interponer recurso contencioso-administrativo hasta que se haya resuelto expresamente el de reposición o se haya producido la desestimación presunta del mismo.
