    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 8.3&amp;nbsp;de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 30&amp;nbsp;de enero de 2018, por la cual se convocan subvenciones para el Fomento de la Agricultura Ecológica, especifica que la Resolución se notificará a las persones interesadas mediante su publicación al Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones publicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El expediente ha sido tramitado por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento del que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria&amp;nbsp;del FOGAIBA, con fecha 2&amp;nbsp;de mayo&amp;nbsp;de 2024, firmó la siguiente resolución:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Con fecha 6 de abril de 2023, se publica en el BOIB núm. 43, la Orden de la consejera de Agricultura, Pesca y Alimentación por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha 15 de abril de 2023, se publica en el BOIB núm. 48, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria, para el año 2023, de las ayudas destinadas para el fomento de la agricultura ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Con fecha 30 de mayo de 2023, se publica en el BOIB núm. 71, la Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución de la presidenta del FOGAIBA de 27 de febrero de 2023, de convocatoria, para el año 2023, de las ayudas correspondientes a las intervenciones en forma de pagos directos que prevé el Plan estratégico de la PAC (PEPAC), así como otras resoluciones de convocatoria de ayudas que prevén las intervenciones en el desarrollo rural. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Con fecha 30 de junio de 2023, se han recibido 551 solicitudes por la ayuda destinada para el fomento de la agricultura ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 20 de febrero de 2024, se publica en el BOIB núm. 25 la Resolución de denegación a los beneficiarios de las ayudas, Rd1conjunta de la Sección II, por el incumplimiento del requisito previsto en el apartado 7 del punto tercero de la convocatoria de estar al corriente de las obligaciones tributarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. El solicitante AOVE Artà SL, con número de expediente 04004999 y NIF B57770125 presenta el día 12 de febrero de 2024 con el número de registro REGAGE24e00010936833, las alegaciones a la propuesta provisional de denegación, publicada en la web el día 1 de febrero. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Las alegaciones presentadas son correctas y por tanto, el solicitante cumple con el requisito para poder ser beneficiario de la ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9. Según el artículo 109,1 de la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas, las administraciones públicas pueden revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de grabación o desfavorables, siempre que esta revocación no constituya dispensa o exención no permitida por las leyes, ni sea contraria al principio de igualdad, al interés público o al ordenamiento jurídico.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 12 de abril de 2023 por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas para el fomento del agricultura ecológica, publicada en el BOIB núm. 48 de día 15 de abril de 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Apartado 7 del punto tercero de la convocatoria referente a estar al corriente de las obligaciones tributarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. &lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Informe y Propuesta de Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Revocar parcialmente la Resolución de denegación de 20 de febrero de 2024, publicada en el BOIB núm. 25.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Notificar la Resolución al interesado AOVE Artà SL, con número de expediente 04004999 y NIF B57770125 mediante su publicación en el Boletín Oficial de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Informar a los interesados que sus expedientes se encuentran a su disposición y consulta en el Servicio de Ayudas de Desarrollo Rural del FOGAIBA (calle de Reina Constança, nº4 de Palma).&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
