font-size:12px">El Pleno de esta entidad, en sesión extraordinario celebrada el día 30 de abril de 2024, acordó la aprobación de la modificación del Acuerdo regulador del precio público para la prestación del servicio municipal de la escuela de verano, lo cual se hace público a efectos de su general conocimiento </span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">“<strong>Ordenanza fiscal reguladora de los preciós publicos para la prestación del Servicio municipal de la escuela de verano del Ayuntamiento de Capdepera.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Articulo 1.- Fundamento y naturaleza</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">En conformidad con el que prevén los artículos 127 y 41 al 47 del Texto refundido de la Ley reguladora de las haciendas locales (Real decreto legislativo 2/2004), el Ayuntamiento de Capdepera establece el precio público por la prestación del servicio de la Escuela de Verano especificado en las tarifas del artículo 4, que se tienen que regir por esta ordenanza.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Articulo 2.- Hecho imponible</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los precios públicos se tienen que acreditar desde el comienzo de la prestación del servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Articulo 3.- Sujetos pasivos </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Son sujetos pasivos, en concepto de contribuyentes, las personas físicas y jurídicas, y las entidades a que se refiere el artículo 35.4 de la Ley 58/2003, de 17 de diciembre, General Tributaria, que resultan beneficiados por el servicio prestado y regulado en la presente Ordenanza.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Articulo 5.- Normes de gestión y cobro</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. La obligación de pagar el precio público nace desde el momento en que se solicita la prestación del servicio.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. La formalización de la matrícula y el pago del precio público se tiene que hacer según las normas que determine el Ayuntamiento.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 6. -Devolución del precio público</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Una vez hecho efectivo el precio público, no se puede volver el importe correspondiente excepto en los casos siguientes:</span></span></p> <ol class="lower-alpha" start="1"> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;Cuando por causas no imputables al obligado al pago el servicio no se preste. En este caso, hay que volver el 100% del importe abonado.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;En los casos en que el beneficiario del servicio tenga que darse de baja por enfermedad grave, con justificación previa de esta. En esta caso, hay que volver el importe de la parte proporcional que le corresponda.</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">&nbsp;Si se solicita la devolución con una antelación igual o superior a 10 días naturales a comienzos de la actividad.</span></span></li> </ol> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Procederá la devolución de los precios públicos regulados en esta ordenanza, previo informe técnico y autorización del órgano correspondiendo</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las solicitudes de tramitación de devolución tendrán que ser presentadas por escrito en el registro general del Ayuntamiento de Capdepera y adjuntar los siguientes documentos:<span style="display:block; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; margin-bottom:0px; margin-top:0px"> </span></span></span></p> <ul> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Documentación justificativa que corresponda</span></span></li> <li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Certificado de titularidad bancario de la cuenta donde realizar el ingreso</span></span></li> </ul> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Artículo 7. Infracciones y sanciones</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Las infracciones y las sanciones en materia tributaria se tienen que regido por aquello que dispone la Ley general tributaria y la normativa que la despliega.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición final. </strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La presente Ordenanza, entrará en vigor el día de su publicación en el Boletín Oficial de la Provincia, permaneciendo en vigor hasta su modificación o derogación exprés</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Disposición derogatoria.</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Queda derogado los apartados y) y j) del anexo de la ordenanza fiscal reguladora del precio público para el uso de instalaciones deportivas y realización de actividades deportivas del servicio municipal de deportes (SME)&nbsp;del Ayuntamiento de Capdepera publicada día 30 de abril de 2016 con el número de&nbsp;BOIB&nbsp;54.”</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">De acuerdo con el artículo 112.3 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, contra el presente Acuerdo se podrá interponer recurso contencioso–administrativo, en el plazo de dos meses contados a partir del día siguiente a la publicación de este anuncio en conformidad con el artículo 46 de la Ley 29/1998, de la Jurisdicción Contencioso-Administrativo.</span></span></p> <p> </p> <p style="text-align:center">Capdepera, <em>(firmado electrónicamente: 30 de abril de 2024)</em></p> <p style="text-align:center"><strong>La alcaldesa<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></strong> Mireria Francesca Ferrer Jaume</p> ]] 20288
