    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Aprobada inicialmente por el Ayuntamiento Pleno en sesión de día 7 de marzo de 2024 la modificación de la Ordenanza fiscal reguladora de la tasa para la prestación del servicio de celebración de matrimonio civil, y dado que durante el plazo de exposición pública no se ha presentado ninguna reclamación, y por tanto, acontece aprobada definitivamente, se publica íntegramente en cumplimiento del dispuesto a la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y a la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la aprobación definitiva de esta ordenanza se puede interponer recurso contencioso-administrativo ante la Sala de lo contencioso administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses contados desde el día de la presente publicación, de acuerdo con el dispuesto en los artículos 10.1.b y 46.1 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Consulta e información del expediente&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;ORDENANZA REGULADORA DE LA TASA PARA LA PRESTACIÓN DEL SERVICIO DE CELEBRACIÓN DE MATRIMONIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución y por el artículo 106 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local, y con arreglo al que disponen los artículos 15 a 19 del Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales (TRLRHL), este Ayuntamiento establece la tasa para la prestación del servicio de celebración de matrimonio civil, que se regirá por la presente Ordenanza fiscal, las normas de la cual atienen el que prevé el artículo 57 del mencionado TRLRHL.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 1&lt;/strong&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;El hecho imponible que origina la tasa es:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) La prestación del servicio de celebración de matrimonio civil a la sala de sesiones de la Casa de la Vila de Algaida&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) El desplazamiento del Alcalde o Regidor celebrando al lugar de celebración del servicio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La obligación de pago nace desde que se inicia la prestación del servicio. No obstante, en el momento de la solicitud se ingresará, en concepto de depósito previo, el importe de la tasa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Están obligados al pago las personas que soliciten el servicio o se benefician de él.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La responsabilidad del pago de la tasa se solidaria, quedando ambos cónyuges obligados solidariamente al pago de la tasa a la administración municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las tarifas a aplicar son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;a) Para la prestación del servicio en la Sala de Sesiones de la Casa de la Vila: 200,00 euros. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;b) Para la prestación del servicio fuera de las instalaciones de la Casa de la Vila, de forma que se requiera el desplazamiento del alcalde o regidor: 300,00 euros.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Estas tarifas están establecidas para cubrir los costes asociados a la prestación del servicio de matrimonio civil y garantizar la calidad y formalidad del acto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Se bonificará el 100% de las tarifas establecidas en el artículo anterior cuando al menos uno de los dos contrayentes lleve más de un año empadronado en el municipio de Algaida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La celebración del matrimonio civil se hará en la Sala de Sesiones de la Casa de la Vila de Algaida o en cualquier lugar del Término Municipal de Algaida.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Si por causa no imputable al obligado al pago la actividad no se prestara, se procederá a la devolución del importe indicado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las deudas por esta tasa se exigirán por el procedimiento administrativo de apremio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;De acuerdo con el establecido en los artículos 26 y 27 del Texto refundido de la Ley reguladora de las haciendas locales del TRLRHL, se establece para la exacción de la tasa el régimen de autoliquidación. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Las personas que proyecten contraer matrimonio civil, acompañarán a la solicitud el justificante acreditativo de haber satisfecho la autoliquidación, utilizando el impreso existente. La realización material de los ingresos se efectuará en la tesorería municipal o en las entidades financieras colaboradoras de la recaudación municipal que designe el Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 9&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En todo aquello referente a infracciones y sanciones, será de aplicación la Ley 58/2003, de 17 de diciembre, general tributaria, en concreto los artículos 181 y siguientes, y las disposiciones que la desarrollan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;La presente Ordenanza fiscal empezará a regir a partir del día siguiente de su publicación en el Boletín Oficial de las Islas Baleares, y permanecerá vigente, sin interrupción, mientras no se acuerde su modificación o derogación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-size:12px"&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Quedan derogadas todas las ordenanzas que se opongan o contradigan el establecido en la presente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
