    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;Por Resolución de esta Alcaldía de día 22&amp;nbsp;de abril de 2024, se ha dictado el siguiente:&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Vista la convocatoria del proceso de estabilización por el sistema concurso de méritos para la cobertura de cinco (5) plazas de personal laboral categoría Técnico grado básico, clase auxiliar administrativo/a, nivel VI del Convenio colectivo del Ayuntamiento de Llucmajor, las bases de la cual se publicaron en el BOIB n.º 154 de 26 de noviembre de 2022 y el anuncio de la cual se publicó en el BOE n.º 307 de 23 de diciembre de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Visto el Decreto 2023004556 de día 15 de noviembre de 2023 en el cual se establece que en el turno libre el Sr. Francesc Xavier Tomàs Terrasa, las Sras. Maria de los Angeles Garrido Bibiloni, Maria Rafael Puigserver y Maria Visitación Ramírez Rosselló y, en el turno de reserva el Sr. Rafael Ramírez Rosselló han superado el proceso selectivo del concurso extraordinario de méritos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Dado que la Sra. Maria Visitación Ramírez Rosselló y el Sr. José Alarcón González en fecha 30/01/2024 (RGE. N.º 1.962 y 2.024) presentaron su renuncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Visto lo establecido en la base 15.3&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt; «...cuando haya renuncias de aspirantes seleccionados antes del nombramiento o la toma de posesión, el tribunal elevará al órgano convocante una relación complementaria de los aspirantes que estén situados a continuación de las personas propuestas, por orden de puntuación, para su posible nombramiento como personal funcionario de carrera en sustitución de las que renuncien a las plazas.»&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Visto el anuncio de la relación complementaria de las personas aspirantes que han superado el proceso selectivo por orden de prelación, realizado por el Tribunal el día 10 de enero de 2024 y publicado el día 11 de enero de 2024. Resulta, de conformidad con lo previsto en la base 15.3, que la Sra. Gloria Maria Ferrer Martínez, con DNI **1117***, es la aspirante situada a continuación de las personas propuestas, por orden de puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En consecuencia,&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVO&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primero.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Aceptar la renuncia de la Sra. Maria Visitación Ramírez Rosselló y el Sr. José Alarcón González de fecha 30/01/2024 y RGE. N.º 1.962 y 2.024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segundo.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Ordenar la contratación de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercero.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Publicar esta Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Requerir al Sr. Francesc Xavier Tomàs Terrasa, las Sras. Maria de los Angeles Garrido Bibiloni, Maria Rafael Puigserver, Gloria Maria Ferrer Martínez y el Sr. Rafael Ramírez Rosselló para que firmen contrato en el plazo máximo de tres días hábiles, a contar a partir del día siguiente a la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Dar traslado de esta Resolución al Pleno del Ayuntamiento, así como a la Unidad de Recursos Humanos por su conocimiento y efectos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta resolución los interesados podrán interponer un recurso potestativo de reposición ante este Ayuntamiento, en el plazo de un mes a contar del día siguiente de la publicación, de conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;También podrán interponer alternativamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-administrativo con sede en Palma, en el plazo de dos meses, de conformidad con lo establecido en los artículos 30, 112.3 y 114.1 c) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y 8, 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En caso de optar por interponer el recurso de reposición, no se podrá interponer un recurso contencioso-administrativo hasta que se haya notificado la resolución expresa del recurso de reposición o haya transcurrido un mes desde su interposición sin haber recibido la notificación, fecha en que se podrá entender desestimado por silencio administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:null"&gt;Todo ello sin perjuicio de que puedan interponer cualquier otro recurso que estimen oportuno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
