&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;«&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CONSTITUCIÓN DE LA BOLSA PREFERENTE DE PERSONAL FUNCIONARIO INTERINO DE LA CONVOCATORIA DEL PROCESO DE ESTABILIZACIÓN POR CONCURSO-OPOSICIÓN PARA CUBRIR DOS PLAZAS DE TAG, ESCALA DE ADMINISTRACIÓN GENERAL, GRUPO A, SUBGRUPO A1, DEL AYUNTAMIENTO DE SANTANYÍ&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Decreto&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En la villa de Santanyí, la Alcaldesa que suscribe, Sra. Maria C. Pons Monserrat, en presencia del secretario de la Corporación, dicta lo siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Vista la convocatoria y bases del proceso de estabilización por concurso-oposición para cubrir siete plazas de personal funcionario de la Administración general y especial del Ayuntamiento de Santanyí (derivada de la Ley 20/2021, de 28 de diciembre, medidas urgentes para la reducción de la temporalidad en el empleo público).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Vistas las dos plazas de TAG convocadas en el proceso selectivo anterior.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Visto que en fecha 24 de marzo de 2023 se publicó la lista provisional de personas admitidas y excluidas en este proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4. Visto que en fecha 27 de octubre de 2023 se publicó, por un lado, la lista definitiva de personas admitidas y excluidas en esta convocatoria y, por otra, el acta de confección de la lista provisional de méritos de acuerdo con la autobaremación hecha por las personas aspirantes de la convocatoria para cubrir dos plazas de TAG.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Visto que en fecha 04 de diciembre de 2023 el tribunal calificador publicó el acta de aprobación de la lista provisional con las puntuaciones obtenidas en la fase de oposición, de la convocatoria del proceso de estabilización por concurso-oposición por cubrir dos plazas de TAG, grupo A1, del Ayuntamiento de Santanyí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Visto que en fecha 22 de diciembre de 2023 tuvo lugar la publicación del acta de aprobación de la lista definitiva de puntuaciones obtenidas en la fase de oposición, de la convocatoria del proceso de estabilización por concurso-oposición por cubrir dos plazas de TAG de la escalera de Administración General, Grupo A1, del Ayuntamiento de Santanyí.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;7. Vista el acta de aprobación de las correcciones de las enmiendas de la lista provisional méritos alegados publicada en el día 02 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;8. Vista el acta de la lista definitiva de méritos alegados de acuerdo con la autobaremación aportada y de personas que han superado el ejercicio de la fase de oposición de la convocatoria de dos plazas de técnico/a de administración general del proceso de estabilización del Ayuntamiento de Santanyí publicada el día 02 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;9. Vista el acta de la lista informativa del orden de las personas aspirantes de acuerdo con la puntuación de la fase de oposición y la puntuación alegada en la declaración responsable del proceso de estabilización por concurso-oposición de dos plazas de TAG, personal funcionario, del Ayuntamiento de Santanyí, publicada el 03 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;10. Vista el acta de comprobación de los méritos alegados por las personas aspirantes requeridos en la convocatoria del proceso de estabilización por concurso-oposición para cubrir dos plazas de TAG de la escala de administración general, grupo A1, del Ayuntamiento de Santanyí publicada el día 07 de febrero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;11. Vista el acta de la lista provisional del concurso de méritos de las personas aspirantes a la convocatoria del proceso de estabilización por concurso-oposición para cubrir dos plazas de TAG de la escala de administración general, grupo A1, del Ayuntamiento de Santanyí publicada el 27 de febrero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;12. Vista el acta de publicación definitiva del concurso de méritos de las personas aspirantes y propuesta de su aprobación por la alcaldesa, de la convocatoria del proceso de estabilización por concurso-oposición para cubrir dos plazas de TAG de la escala de administración general, grupo A1, del Ayuntamiento de Santanyí publicada el 11 de marzo de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;13. Visto que, en fecha 15 de marzo de 2024, por Resolución de alcaldía núm. 2024/431 se ha aprobado la lista definitiva de personas aspirantes que han superado este proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;14. Visto que, en fecha 18 de abril de 2024, el tribunal de selección del proceso selectivo propone a la Alcaldía la constitución de la bolsa preferente de personal interino técnico de administración general. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Fundamentos de derecho &lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Real Decreto Legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto Básico del Empleado Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;- Base 21 de la convocatoria del proceso de estabilización por concurso-oposición para cubrir siete plazas de personal funcionario de la Administración general y especial del Ayuntamiento de Santanyí (BOIB núm. 160, 10 de diciembre de 2022).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En consecuencia, &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESUELVE&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Publicar el anuncio de esta Resolución en el Boletín Oficial de las Illes Balears y, posteriormente, en la página web de la Corporación». &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Contra esta Resolución, que pone fin a la vía administrativa, se puede interponer, alternativamente, o recurso de reposición potestativo, en el plazo de un mes a contar desde el día siguiente de la publicación de este edicto, ante la alcaldesa de este Ayuntamiento, de conformidad con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, o recurso contencioso-administrativo, ante el Juzgado de lo Contencioso-Administrativo en el plazo de dos meses a contar desde el día siguiente a la publicación de este edicto, de conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa. Si se optase por interponer el recurso de reposición potestativo, no se podrá interponer recurso contencioso administrativo hasta que aquél sea resuelto expresamente o se haya producido su desestimación por silencio. Todo ello sin perjuicio de que pueda ejercitarse cualquier otro recurso que se estime pertinente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
