    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Finalizado el plazo de exposición pública para la presentación de reclamaciones contra el acuerdo adoptado por el Pleno del Ayuntamiento de Alcudia, en la sesión plenaria ordinaria de día 12 de diciembre de 2023, de la Modificación del Reglamento Municipal de Transporte Urbano de Auto taxi y Galeras del Ayuntamiento de Alcudia, publicado en el BOIB núm. 173 de día 23 de diciembre de 2023, sin que se hayan presentado reclamaciones, queda aprobada definitivamente la modificación del reglamento siguiente, de conformidad con el que prevé el artículo 70.2 de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen Local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El texto íntegro de la modificación del Reglamento Municipal de Transporte Urbano de Auto taxi y Galeras es el siguiente;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;&amp;lt;&amp;lt; Modificación del Reglamento municipal regulador del Transporte Urbano de Auto taxi y Galeras, por lo que hace al transporte urbano de galeras&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;EXPOSICION DE MOTIVOS &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se modifica el vigente Reglamento municipal regulador del Transporte Urbano de Auto taxi y Galeras, en cuanto al transporte urbano de galeras, regulado en su Título III, Sección Segunda, relativo a los vehículos adscritos a las licencias de galeras, para incluir la posibilidad de eliminar la tracción animal mediante una caballería y sustituir el carruaje por un vehículo eléctrico homologado y del tipo galera actualmente generalizado con capacidad por cinco plazas y el conductor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se introduce la posibilidad de que los titulares de licencias de vehículos de tracción animal puedan sustituir a su cargo los vehículos y así contribuir a evitar la explotación de estos animales y utilizar las alternativas que existen en la actualidad. Se trata de una alternativa que iría en línea con la demanda de la ciudadanía y de los turistas que visitan la ciudad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En este sentido, el capítulo 5 (artículos 106 y ss) del Reglamento municipal del transporte urbano de auto taxi y galeras que regula el vehículo y la caballería prevé la posibilidad de sustituirlos por carruajes eléctricos homologados sin tracción animal y así contribuir a la mejora de la imagen de Alcudia como destino turístico comprometido con la protección animal y del cuidado del entorno, a la vez que se permite mantener los lugares de trabajo de las familias que se dedican eliminando la explotación de estos animales y sus consecuencias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Articulo único. - Modificación del Reglamento municipal de transporte Urbano de Auto taxi y Galeras&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;1. Se substituye el artículo 87 que queda con la siguiente redacción&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Art. 87&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;.- &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El servicio urbano de transporte de viajeros con vehículos de tracción animal o de tracción eléctrica limitada con conductor, desde ahora galeras está sujeto a licencia administrativa municipal y tendrá que contar con todas las autorizaciones estatales y autonómicas que sean preceptivas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Los titulares de licencias municipales de transporte de viajeros con vehículos de tracción animal podrán solicitar el cambio de vehículo por uno de tracción eléctrica limitada a velocidad de&amp;nbsp;25k/h&amp;nbsp;a su cargo y no podrán iniciar la actividad sin la correspondiente autorización de cambio de vehículo. Una vez autorizado el cambio de vehículo no podrá solicitarse otro cambio de vehículo de tracción animal.&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;2. Se añade un apartado octavo en el artículo 102, con la siguiente redacción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;"8.- &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;No será necesario acreditar las circunstancias mencionadas en los apartados h), y) J) cuando el titular de la licencia de transporte de viajeros con vehículo de tracción animal haya obtenido la autorización de cambio de vehículo por tracción eléctrica limitada."&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;3. Se substituye el artículo 106 que quedará con la siguiente redacción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“La tracción de los vehículos podrá ser animal o eléctrica limitada.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;1. Tracción animal: Cuando la tracción del vehículo se realice por tracción animal, se tendrá que contar con una caballería que reúna las condiciones de salud, nutrición, higiénico-sanitarias y de imagen adecuadas y los siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Especie: caballar.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Edad: Entre 3 y 16 años. Después de esta edad podrá seguir prestando servicios siempre que esta circunstancia sea autorizada expresamente a las revisiones sanitarias.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Sexo: Hembra o macho sanado.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Altura: desde 1,52m.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;2. Tracción eléctrica: las licencias municipales vigentes los titulares de las cuales soliciten un cambio de vehículo a tracción eléctrica limitada, el vehículo tendrá que ser tipo galera tradicional homologado que reúna las condiciones mínimas siguientes:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Motor eléctrico de 2.200 w&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Capacidad: 6 asientos (1 conductor y 5 asientos)&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Peso: 420 Kg&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Sistema de freno “Freno de pie hidráulico” y freno de mano por cable por el freno de mano.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Sistema de limitación de velocidad a 25 km/hora&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;4.- Se modifica el artículo 107 con la adicción de un punto segundo y tercero que quedarán redactados de la siguiente manera:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“107.2 Para autorizar la adscripción de una galera de tracción eléctrica limitada a una licencia se requerirá:&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;El vehículo tendrá que estar homologado y contar con las autorizaciones estatales y autonómicas preceptivas.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Pasar la revisión técnica habilitante.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Declaración del bòxer, establo o similar donde se guarda y aloja el carruaje.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;Una vez autorizada la adscripción por parte de la Alcaldía, la galera será dotada de una fija identificativa municipal y no se podrá circular sin ella.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;No se podrá autorizar la adscripción de más de un vehículo por cada licencia.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;107.3 Queda prohibido trabajar con la galera de tracción eléctrica limitada cuando no se reúnan las condiciones del apartado anterior y utilizar elementos publicitarios u otros aditamentos.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;5. Se modifica el artículo 125, añadiendo, al final:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;“&lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;no será necesario disponer de la documentación referida a los puntos 10 y 11 a los conductores de los vehículos de tracción eléctrica limitada debidamente autorizados.”&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;6. Se modifica el artículo 141 sobre faltas muy graves, por adición de un punto núm. 20 con la siguiente redacción:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;«20.- conducir a velocidad superior a 25k/h o alteración del limitador de velocidad en el &lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;caso de galeras de tracción eléctrica limitada»&amp;gt;&amp;gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;&lt;strong&gt;Disposición final&lt;/strong&gt;. - La presente modificación del Reglamento entrará en vigor cuando se haya publicado íntegramente en el Boletín oficial de las Islas Baleares y hayan transcurrido quince días hábiles des de la recepción de la norma por parte de las administraciones autonómica y estatal de acuerdo con los artículos 103 i 113 de la Ley 20/2006, de 15 de diciembre, municipal i régimen local de las Islas Baleares. &amp;gt;&amp;gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;(Firmado electrónicamente: 12 de abril de 2024&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
