es 240047 17729 text/html 17727 es CAIB CAIB 685351 2024-04-18 CAIB ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Hechos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1.El 22 de diciembre de 2020 se publicó en el BOIB nº. 212, la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa PREE) en el Programa Operativo FEDER 2014-2020, mediante la Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 (BOIB núm. 212).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. La Dirección General de Economía Circular, Transición Energética y Cambio Climático concedió una subvención a la persona o entidad que figura en el anexo de esta Resolución en el marco&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; de la convocatoria para actuaciones de rehabilitación energética en edificios existentes (Programa PREE).</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">3. </span>La persona o entidad que figura en el anexo aportó la documentación para la justificación de la realización de las actuaciones subvencionadas.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">4. El técnico de la Dirección General de Economía Circular, Transición Energética y&nbsp; Cambio Climático examinó la documentación aportada y emitió informe desfavorable a la justificación del expediente descrito en el anexo con la motivación que figura en este anexo.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. El 15 de marzo de 2024 se emitió una Propuesta de resolución de revocación del director general de Economía Circular, Transición Energética y Cambio Climático&nbsp; (BOIB nº 39 , de 21 de marzo de 2024).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">6. Se ha agotado el plazo de diez días que se concedía para presentar alegaciones sin que se hayan presentado.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">7. El día 3 de abril de 2024 se emitió Propuesta de resolución de revocación definitiva del director general de Economía Circular, Transición Energética y Cambio Climático.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El Decreto 75/2004, de 27 de agosto, por el que se despliegan determinados aspectos de la Ley de finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Islas Baleares (BOIB núm. 122, de 2 de septiembre de 2004 ).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. La Orden de la consejera de Comercio, Industria y Energía de 15 de mayo de 2008 por la que se establecen las bases reguladoras para la concesión de subvenciones en materia de energía (BOIB núm. 72, de 24 de mayo de 2008 ).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. El Reial decreto 737/2020, de 4 de agosto, por el que se regula el programa de ayudas para actuaciones de rehabilitación energética en edificios existentes y se regula la concesión directa de las ayudas de este programa a las comunidades autónomas y ciudades de Ceuta y Melilla (BOE núm. 212, de 6 de agosto de 2020).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">5. La Resolución del vicepresidente y consejero de Transición Energética y Sectores Productivos de 14 de diciembre de 2020 por la que se aprueba la convocatoria pública de subvenciones para actuaciones de rehabilitación energética en edificios existentes (Programa PREE) (BOIB núm. 212, de 22 de diciembre de 2020).</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. Revocar la concesión de la subvención detallada en el anexo.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">2. Autorizar y disponer negativamente el gasto a favor de los beneficiarios por el importe detallados en el anexo con cargo a las partidas presupuestarias.</span></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Declarar concluido el procedimiento y, por tanto, archivar el expediente indicado en el anexo.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">4. Publicar esta Resolución en el <em>Boletín Oficial de las Illes Balears.</em></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Interposición de recursos</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que agota la vía administrativa, se puede interponer recurso potestativo de reposición ante el consejero de Transición Energética, Sectores Productivos y Memoria Democrática en el plazo de un mes a contar desde el día siguiente de la publicación, de acuerdo con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.</span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
