<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En sesión ordinaria de la Junta de Gobierno Local del Ayuntamiento de Sant Joan de Labritja celebrada el día <span style="color:#000000">21</span> de <span style="color:#000000">marzo</span> de 2024 se aprobó las bases reguladoras que han de regir la convocatoria de Subvenciones Directas y Nominativas del municipio de Sant Joan de Labritja para el año 2024, que se transcriben a continuación: </span></span></span></p>

<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 2. Naturaleza jurídica y régimen aplicable.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1. Las ayudas que se concedan tendrán el carácter de subvención y se regirán por la Ley 38/2003, de 17 de noviembre, General de Subvenciones -LGS- y su reglamento de desarrollo, bases de ejecución del presupuesto 2024 y documento anexo, las presentes bases, convenio regulador en aquellos casos que se considere y el acuerdo especifico de concesión.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Las ayudas directas que se concederán directa y nominativamente, exclusivamente, a los beneficiarios relacionados en el anexo de las Bases del Presupuesto Municipal y en la base 1 de la presente convocatoria.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3. </span><span style="color:#231f20">Las ayudas recibidas son compatibles con la percepción de otras ayudas procedentes de cualquier otra administración o entre público o privado, siempre que su importe se de tal cantidad que aisladamente o en concurrencia con otras subvenciones no supere el total de la actividad subvencionada, de acuerdo con lo previsto en el artículo 19.3 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 3. Crédito presupuestario.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Las subvenciones previstas en la presente convocatoria están consignadas en el presupuesto municipal del año 2024 por un importe total de </span><span style="color:#000000"><strong>224.800,00 euros</strong></span><span style="color:#000000">,</span><span style="color:#000000"> con cargo a las aplicaciones presupuestarias detalladas en la Base 1 de las presentes Bases.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En cualquier caso, la concesión de las subvenciones queda condicionada a la existencia de crédito adecuado y suficiente en el momento de resolución de la concesión, conforme al artículo 56.2 del Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones -RLGS-.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 4. Cuantía de las ayudas.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">La ayuda económica ascenderá como máximo al importe que figura en el anexo de las Bases de Ejecución del presupuesto municipal del año 2024 y en las presentes Bases.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 5.- Destinatarios.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Podrán solicitar las ayudas previstas en esta convocatoria las personas físicas, jurídicas, Comisiones, Cofradías etc. previstas en la Base 1 de la convocatoria y para la subvención directa y por el importe máximo que figura en dicha base, en el plazo máximo de </span><span style="color:#000000"><strong>tres meses </strong></span><span style="color:#000000">a contar del de la fecha de inserción de las presentes Bases en el tablón de anuncios y en la Sede electrónica del Ayuntamiento de Sant Joan de Labritja.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las solicitudes deberán ir acompañadas de todos los documentos previstos en la Base 6.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si la solicitud se presentara fuera de plazo no serán tenidas en cuenta en el presente ejercicio, perdiendo el derecho a su recepción.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si a la solicitud le faltara alguno de los documentos relacionados en la Base 1 o se presentaran incompletos, serán requeridos para la subsanación de los mismos en un plazo máximo de 10 días hábiles. En caso de que no se cumplimentara correctamente el requerimiento referido, las solicitudes no serán tenidas en cuenta dando lugar a la perdida del derecho a la percepción de la subvención prevista en esta convocatoria para el beneficiario.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El beneficiario no debe estar incurso en alguna de las prohibiciones establecidas en el artículo 13 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones -LGS- </span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 6. Solicitudes y documentación.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Los beneficiarios de subvención previstos en la Base 1 de esta convocatoria podrán solicitar ayuda económica por el importe previsto en la misma, para fomento de las actividades que lleven a cabo los beneficiarios dentro de los fines previstos en estas bases y que tradicionalmente se viene subvencionando en ejercicios anteriores, debiendo presentar necesariamente para su tramitación y concesión la siguiente documentación:</span></span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Anexo I.</strong></span><span style="color:#000000"> Modelo de solicitud de la subvención. Será cumplimentado y firmado por el interesado o representante legal de la entidad o asociación solicitante de la subvención.</span></span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Fotocopia del DNI del interesado o del representante legal</strong></span><span style="color:#000000"> de la entidad o asociación solicitante de la subvención.</span></span></span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Documentación acreditativa de la vigencia del cargo que ostenta el representante legal</strong></span><span style="color:#000000"> de la entidad o asociación solicitante de la subvención o, en su caso, acreditación de la autorización correspondiente para realizar la solicitud de subvención.</span></span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Si el solicitante de la subvención se trata de una entidad o asociación legalmente constituida, deberá presentar</span><span style="color:#000000"><strong> copia de los Estatutos, así como las modificaciones</strong></span><span style="color:#000000"> que se hubieran producido.</span></span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Certificado de titularidad bancaria</strong></span><span style="color:#000000"> en el que se acredite el número de cuenta corriente donde debe ingresarse la subvención.</span></span></span></span></p>
</li>
<li>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Certificado de estar al corriente de sus obligaciones con la Agencia Estatal de Administración Tributaria (AEAT)</strong></span><span style="color:#000000">.</span></span></span></span></p>

<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>Certificado de estar al corriente de sus obligaciones con la Tesorería General de la Seguridad Social</strong></span><span style="color:#000000">. En caso de que la entidad o asociación no esté inscrita en el sistema de la Seguridad Social, deberá presentar el certificado o informe de inexistencia de empresario.</span></span></span></span></p>
</li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 8. Plazo y lugar de presentación de las solicitudes.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">1. El </span><span style="color:#000000"><strong>plazo de presentación de solicitudes será </strong></span><span style="color:#000000"><strong>de tres meses</strong></span><span style="color:#000000"> a contar del día siguiente al de la publicación de las presentes Bases en el Tablón de anuncios y en la Sede electrónica del Ayuntamiento de Sant Joan de Labritja.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2. Las solicitudes junto con la restante documentación que se indica en la base anterior, deberán presentarse en el Registro General del Ayuntamiento de Sant Joan de Labritja, sin perjuicio de lo establecido en el artículo 16.4 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas -LPACAP- acompañada de toda la documentación prevista en la Base 6.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3. La presentación de solicitudes a esta convocatoria implica la aceptación de sus bases.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 9. Procedimiento y resolución.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Tanto el artículo 22 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones -LGS- como los artículos 7 y 8 del Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones, disponen que el procedimiento ordinario de concesión de subvenciones se tramitará en régimen de concurrencia competitiva. A efectos de esta ley, tendrá la consideración de concurrencia competitiva el procedimiento mediante el cual la concesión de las subvenciones se realiza mediante la comparación de las solicitudes presentadas, a fin de establecer una prelación entre las mismas de acuerdo con los criterios de valoración previamente fijados en las bases reguladoras y en la convocatoria, y adjudicar, con el límite fijado en la convocatoria dentro del crédito disponible, aquellas que hayan obtenido mayor valoración en aplicación de los citados criterios.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No obstante, podrán concederse de forma directa las siguientes subvenciones:</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Las previstas nominativamente en los Presupuestos Generales de las Entidades Locales, en los términos recogidos en los convenios y en la normativa reguladora de estas subvenciones.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">A efectos de lo establecido en el párrafo anterior, se entiende por subvención prevista nominativamente en los Presupuestos Generales del aquella en que al menos su dotación presupuestaria y beneficiario aparezcan determinados en los estados de gasto del Presupuesto. El objeto de estas subvenciones deberá quedar determinado expresamente en el correspondiente convenio de colaboración o resolución de concesión que, en todo caso, deberá ser congruente con la clasificación funcional y económica del correspondiente crédito presupuestario.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Aquellas cuyo otorgamiento o cuantía venga impuesto a la Administración por una norma de rango legal, que seguirán el procedimiento de concesión que les resulte de aplicación de acuerdo con su propia normativa.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Con carácter excepcional, aquellas otras subvenciones en que se acrediten razones de interés público, social, económico o humanitario, u otras debidamente justificadas que dificulten su convocatoria pública.</span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">El procedimiento para llevar a cabo el otorgamiento de la concesión directa de las subvenciones previstas en estas bases es el siguiente:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>A.- </strong>Una vez que se formule la solicitud se emitirá informe de Intervención sobre la existencia de consignación presupuestaria para el otorgamiento de la correspondiente subvención nominativa, se emitirá informe-propuesta con relación al otorgamiento de la subvención.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>B.-</strong> Por acuerdo de Junta de Gobierno Local se otorgará la subvención, de conformidad con lo establecido en estas bases o convenio que se suscriba en su caso, en cuanto a plazo y forma de justificación.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>C.-</strong> Se notificará el acuerdo de concesión a los interesados, según lo establecido en el artículo 40 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Publicas, ajustándose la práctica de dicha notificación a las disposiciones contenidas en el artículo 41 de la precitada norma.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">1.- Las solicitudes presentadas serán resueltas por la Junta de Gobierno Local, así como la necesidad o no de suscribir convenio regulador individualizado para cada una de ellas.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">2.- La Secretaría y la Intervención revisarán las solicitudes presentadas y comprobarán que reúnen los requisitos señalados en las bases de la convocatoria.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">3.- Se emitirá informe de Intervención sobre la existencia de consignación presupuestaria para el otorgamiento de la correspondiente subvención nominada.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">4.- A propuesta de la Concejalía de Cultura se elaborará lista provisional de admitidos y ayudas que se les asignan, así como de los excluidos y sus causas proponiendo su aprobación a la Junta de Gobierno Local.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">5.- La Junta de Gobierno Local acordará aprobar provisionalmente la lista anterior con especificación de la causa de exclusión, en caso de no reunir los requisitos previstos en la ley, presupuesto municipal de 2023 o en estas Bases, que será notificada a los interesados, concediéndoles un plazo de subsanación de 15 días, si procede, conforme al artículo 68 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas -LPACAP-.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">6.- Recibidas y analizadas las subsanaciones, se elaborará la lista definitiva de los beneficiarios de las ayudas y el importe de las ayudas a otorgar, así como de los excluidos que será remitida, a propuesta de la concejalía de cultura, a la Junta de Gobierno Local para su aprobación definitiva.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">7.- El plazo máximo para notificar la resolución del procedimiento será de dos meses, contados a partir del día siguiente a la finalización del plazo de presentación de solicitudes.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si transcurrido dicho plazo no se hubiera dictado resolución expresa, las solicitudes presentadas se entenderán desestimadas.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em><strong>CONTENIDO DE LOS CONVENIOS:</strong></em></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">De conformidad con el artículo 65.3 del Real Decreto 887/2006, de 21 de julio, establece que la resolución o, en su caso, acuerdo o convenio deberán incluir los siguientes extremos: </span></span></span></p>
<ul>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Determinación del objeto de la subvención y de sus beneficiarios, dE acuerdo con la asignación presupuestaria.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Crédito presupuestario al que se imputa el gasto y cuantía de la subvención, individualizada para cada beneficiario si fuesen varios.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Compatibilidad o incompatibilidad con otras subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualesquiera Administraciones o Entes Públicos o Privados, nacionales, de la Unión Europea o de Organismos Internacionales.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Plazos y modos de pago de la subvención, posibilidad de efectuar pagos anticipados y abonos en cuenta, así como el régimen de garantías que deberán aportar los beneficiarios.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Plazo y forma de justificación por parte del beneficiario del cumplimiento de la finalidad para la que se concedió la subvención y de la aplicación de los fondos percibidos.</span></span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 10. Obligaciones de los beneficiarios.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">Los beneficiarios de las ayudas concedidas deberán cumplir las siguientes obligaciones:</span><span style="color:#ffffff">o</span></span></span></span></p>
<ul>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Cumplir el objetivo, ejecutar el proyecto, realizar la actividad o adoptar el compromiso y obligaciones que fundamenta la concesión de la subvención.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Justificar ante el órgano concedente o la Entidad colaboradora, en su caso, el cumplimiento de los requisitos y condiciones, así como la realización de la actividad y el cumplimiento de la finalidad que determinen la concesión o disfrute de la subvención.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Someterse a las actuaciones de comprobación, a efectuar por el órgano concedente o, así como cualesquiera otras de comprobación y control financiero que puedan realizar los órganos de control competentes, tanto nacionales como comunitarios, aportando cuanta información le sea requerida en el ejercicio de las actuaciones anteriores.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Comunicar al órgano concedente la obtención de otras subvenciones, ayudas, ingresos o recursos que financien las actividades subvencionadas.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Acreditar, con anterioridad a dictarse la propuesta de resolución, que se halla al corriente en el cumplimiento de sus obligaciones tributarias y frente a la Seguridad Social, en todo caso, se podrá autorizar al Ayuntamiento a obtener dichos datos.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No mantener deudas de cualquier naturaleza con el Ayuntamiento de Sant Joan de Labritja.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Disponer de los libros contables, registros diligenciados y demás documentos debidamente auditados, en los términos exigidos por la Legislación mercantil y sectorial, aplicable al beneficiario en cada caso.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Conservar los documentos justificativos de la aplicación de los fondos recibidos, incluidos los documentos electrónicos, en tanto puedan ser objeto de las actuaciones de comprobación y control.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Dar la adecuada publicidad de carácter público de la financiación de programas, actividades, inversiones o actuaciones de cualquier tipo que sean objeto de subvención.</span></span></span></li>
<li><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Si se estuviera en curso de alguna de las causas de reintegro, se deberá proceder al reintegro de la cuantía recibida.</span></span></span></li>
</ul>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 11. Pago de las ayudas concedidas. Justificación de las ayudas.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">De conformidad con lo dispuesto en Ley 38/2003, General de Subvenciones -LGS-, para la justificación de las ayudas se requerirá otra documentación que la acreditativa del requisito para obtener la condición de beneficiario prevista en la Base 6 de esta convocatoria.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#231f20"><em><strong>DOCUMENTACIÓN PARA LA JUSTIFICACIÓN DE LA SUBVENCIÓN: </strong></em></span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Todos los beneficiarios de las ayudas previstas en esta convocatoria deberán presentar la documentación justificativa de la subvención, debiendo presentar los siguientes documentos:</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>1. Anexo II.</strong> Modelo de justificación de la subvención. <span style="color:#000000">Será cumplimentado y firmado por el interesado o representante legal de la entidad o asociación solicitante de la subvención.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>2. Memoria justificativa</strong></span><span style="color:#000000"> de las actuaciones, actividades o proyectos realizados. Deberá acreditar que se ha cumplido la finalidad para que se otorgó la subvención.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>3. Documentos justificativos del gasto realizado</strong></span><span style="color:#000000">. Forma de acreditación:</span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">1. Pagos en efectivo</span><span style="color:#000000"> (hasta 1.000,00 €):</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>1. Factura</strong></span><span style="color:#000000">, en la que deberá constar: Nombre y apellidos o razón social, NIF del proveedor, NIF del cliente (beneficiario de la subvención), fecha, importe, concepto de pago y n.º de factura.</span></span></span></span></p>

Recibo</strong></span><span style="color:#000000">, en el que deberá constar: nombre y apellidos o razón social, NIF del proveedor, NIF del cliente (beneficiario de la subvención), fecha, importe, concepto de pago, n.º de recibo y sello de la empresa (NO SE ADMITIRÁN SELLOS “ESTÁNDAR” EN LOS QUE ÚNICAMENTE FIGURE LA PALABRA “PAGADO”, “CONTABILIZADO” O SIMILAR, SIN IDENTIFICACIÓN DEL PROVEEDOR).</span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">2. Pagos por transferencia bancaria</span><span style="color:#000000">:</span></span></span></span></p>

Certificado de movimientos bancarios</strong></span><span style="color:#000000"> en el que figure el importe, el n.º de factura / recibo y la fecha.</span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">3. Pagos con tarjeta de crédito o débito</span><span style="color:#000000">: Se deberá presentar el</span><span style="color:#000000"><strong> extracto bancario del movimiento de la tarjeta</strong></span><span style="color:#000000">, donde conste el importe, la fecha y el nombre del proveedor.</span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">4. Nóminas</span><span style="color:#000000">:</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>1. Nóminas pagadas en efectivo</strong></span><span style="color:#000000">. S</span><span style="color:#000000">e justificará el pago, presentando la nómina firmada por el/la trabajador/a.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>2. Nóminas pagadas por transferencia bancaria</strong></span><span style="color:#000000">. Se justificará el pago, presentando la nómina y el justificante bancario de la transferencia a nombre del/de la trabajador/a, debiendo figurar el mes y año al que corresponda.</span></span></span></span></p>
<p style="margin-left:40px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000">5. Viajes</span><span style="color:#000000">: En caso de presentarse gastos correspondientes a viajes relacionados con la actividad subvencionada (hoteles, billetes de avión, barco, restaurantes…), deberán justificarse mediante factura o recibo, que además de los datos relacionados anteriormente, deberán contener el nombre y apellidos de las personas que realicen la actividad.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>4. Certificado de estar al corriente de sus obligaciones con la Agencia Estatal de Administración Tributaria (AEAT)</strong></span><span style="color:#000000">.</span></span></span></span></p>
<p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000000"><strong>5. Certificado de estar al corriente de pago con la Tesorería General de la Seguridad Social</strong></span><span style="color:#000000">. En caso de que la entidad o asociación no esté inscrita en el sistema de la Seguridad Social, deberá presentar el certificado o informe de inexistencia de empresario.</span></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em><strong>OBSERVACIONES DE LOS DOCUMENTOS JUSTIFICATIVOS DEL GASTO REALIZADO:</strong></em></span></span></span></p>

<p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">No se admitirán como documentos justificativos del gasto realizado, los siguientes: albaranes, facturas proforma, hojas de pedido, tickets.</span></span></span></p>
</li>
<li>
<p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el caso de las nóminas, sólo se imputará el importe que refleje la transferencia bancarias, que será el importe neto de la nómina (líquido a percibir por parte del/de la trabajador/a). Para imputar el importe de la nómina bruta a la subvención, el beneficiario deberá aportar, además, el justificante del pago de las retenciones de IRPF a la AEAT junto al modelo 111 del período que corresponda, y el justificante de pago de los seguros sociales a la Seguridad Social (RLC, antiguo TC-1 y RNT, antiguo TC-2).</span></span></span></p>
</li>
<li>
<p style="text-align:left"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">En el caso de los viajes, se exceptuará de la obligación de que se haga constar en la factura o recibo el<span style="color:#000000"> nombre y apellidos de las personas que realicen la actividad a los solicitantes beneficiarios cuyo importe de la subvención concedida no supere los 3.000,00 €. En este caso, se podrá sustituir por un certificado donde conste el nombre y apellidos de las personas que realicen la actividad emitido por el interesado o representante legal de la entidad o asociación beneficiaria de la subvención.</span></span></span></span></p>

</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><em><strong>PLAZO PARA LA PRESENTACIÓN DE LA JUSTIFICACIÓN:</strong></em></span></span></span></p>
<ol>
<li>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">APIMAs y CEIPs: Las actividades subvencionadas deberán llevarse a cabo en el curso escolar 2024-2025. El plazo para presentar la documentación justificativa finalizará el <strong>29 de marzo de 2025</strong>.</span></span></span></p>
</li>
<li>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Resto de beneficiarios: Las actividades subvencionadas deberán llevarse a cabo en el año 2024. El plazo para presentar la documentación justificativa finalizará el <strong>30 de noviembre de 2024</strong>.</span></span></span></p>
</li>
</ol>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 12. Compatibilidad de las ayudas.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Las ayudas reguladas por la presente convocatoria serán compatibles con otras de la misma finalidad, cualquiera que sea la Administración o Entidad que las conceda.</span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><strong>Base 13. Control y reintegro.</strong></span></span></span></p>
<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">Procederá el reintegro de las cantidades percibidas y la exigencia del interés de demora desde el momento del pago de la subvención hasta la fecha en que se acuerde la procedencia del reintegro, y en la cuantía fijada en el artículo 38.2 de la Ley General de Subvenciones, en los siguientes casos:</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">a) Obtención de la subvención falseando las condiciones requeridas para ello u ocultando aquellas que lo hubieran impedido.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">b) Incumplimiento total o parcial del objetivo, de la actividad, del proyecto o la no adopción del comportamiento que fundamentan la concesión de la subvención.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">c) Incumplimiento de la obligación de justificación o la justificación insuficiente, en los términos establecidos en el artículo 30 de la Ley 38/2003, y en su caso, en las Normas reguladoras de la subvención.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">d) Incumplimiento de la obligación de adoptar las medidas de difusión contenidas en el apartado 4 del artículo 18 de la citada Ley 38/2003.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">e) Resistencia, excusa, obstrucción o negativa a las actuaciones de comprobación y control financiero previstas en los artículos 14 y 15 de la Ley 38/2003, así como el incumplimiento de las obligaciones contables, registrales o de conservación de documentos cuando de ello se derive la imposibilidad de verificar el empleo dado a los fondos percibidos, el cumplimiento del objetivo, la realidad y regularidad de las actividades subvencionadas, o la concurrencia de subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualesquiera Administraciones o Entes Públicos o Privados, Nacionales, de la Unión Europea o de Organismos Internacionales.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">f) Incumplimiento de las obligaciones impuestas por la Administración a las Entidades colaboradoras y beneficiarios, así como de los compromisos por estos asumidos, con motivo de la concesión de la subvención, siempre que afecten o se refieran al modo en que se han de conseguir los objetivos, realizar la actividad, ejecutar el proyecto o adoptar el comportamiento que fundamenta la concesión de la subvención.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">g) Incumplimiento de las obligaciones impuestas por la Administración a las Entidades colaboradoras y beneficiarios, así como de los compromisos por estos asumidos, con motivo de la concesión de la subvención, distintos de los anteriores, cuando de ello se derive la imposibilidad de verificar el empleo dado a los fondos percibidos, el cumplimiento del objetivo, la realidad y regularidad de las actividades subvencionadas, o la concurrencia de subvenciones, ayudas, ingresos o recursos para la misma finalidad, procedentes de cualesquiera Administraciones o Entes Públicos o Privados, Nacionales, de la Unión Europea o de Organismos Internacionales.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000">h) La adopción, en virtud de lo establecido en los artículos 87 a 89 del Tratado de la Unión Europea, de una decisión de la cual se derive una necesidad de reintegro.</span></span></span></p>
<p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#000000"><span style="color:#000080"><span style="color:#000000">i) En los demás supuestos previstos en la Normativa reguladora de la subvención.</span></span></span></span></span></p>
