&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;PRIMERO. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;APROBAR las bases de la convocatoria para la adjudicación de autorizaciones para el ejercicio de la venta ambulante para el mercado de noche durante el verano 2024 en el municipio de Ferreries, que se adjuntan como annexo.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;SEGUNDO. &lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;CONVOCAR el procedimiento para la adjudicación de las autorizaciones de venta ambulante para el mercado de noche durante el verano del 2024 en el municipio de Ferreries.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;TERCERO. &lt;/span&gt;&lt;/strong&gt;&lt;em&gt;&lt;span style="background-color:white"&gt;PUBLICAR el anuncio de la convocatoria en el Boletín Oficial de la Provincia, en el tablón de edictos y en la sede electrónica del Ayuntamiento.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA PRIMERA. Objeto&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Constituye el objeto de las presentes bases la concesión en régimen de concurrencia competitiva de 40 autorizaciones para el ejercicio de la venta ambulante en los términos contemplados en la Ordenanza Reguladora de la Venta Ambulante en el término municipal de Ferreries y en la Ley 11/2014, de 15 de octubre, de comercio de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA SEGUNDA. Ubicación de los puestos&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los puestos de venta ambulante se otorgarán a una de las siguientes ubicaciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Carrer Fred&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Plaza Jaime II&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Carrer Degà Febrer&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El Ayuntamiento se reserva la facultad de poder variar la ubicación concreta del mercado, si por&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;circunstancias sobrevenidas, se dieran razones de seguridad para las personas y bienes o de interés público que hicieran conveniente su traslado. En este caso, la nueva ubicación respetará los permisos autorizados conforme a las previsiones de las presentes bases, siempre que sea posible, y siempre siguiéndose el orden establecido en el sorteo. Estas variaciones no darán derecho a indemnización alguna.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA TERCERA. Horario de la venta&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El mercado de verano tendrá lugar entre el viernes 7 de junio y el viernes 13 de septiembre. El 23 de agosto, coincidiendo con el viernes, no habrá mercado de verano, ya que son las fiestas patronales del municipio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De acuerdo con lo que se establece en la Ordenanza municipal reguladora, la venta ambulante se ejercerá en el siguiente horario:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Día de la semana&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;// Horario&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Viernes&amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp; &amp;nbsp;// De 19h a las 23h&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA CUARTA. Características de los puestos de venta&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La venta ambulante se realizará en sitios o instalaciones con estructuras desmontables, nunca fijas, o camiones-tienda, quedando prohibida la colocación de cualquier elemento clavado en el suelo que pueda dañar el pavimento, o sujeto o apoyado en árboles, palos , farolas, muros, verjas u otras instalaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Deben ser de fácil transporte y adecuadas a los condicionamientos establecidos en las autorizaciones, debiendo reunir en todo caso las debidas condiciones de seguridad, salubridad y adorno público. Cada mostrador adjudicado en el puesto de venta, hará como máximo 6m², siendo las medidas de 3x2m. En caso de que el Ayuntamiento aporte la mesa, el tamaño de la mesa será de 2m² El precio para poder establecerse en el mercado de noche, dependerá de si el Ayuntamiento de Ferreries, proporciona mesa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;Los precios son los siguientes:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- 65€ si el puesto de venta aporta su mesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- 90€ en caso de que el Ayuntamiento aporte la mesa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los trabajos de carga y descarga del material de venta pueden empezar sesenta minutos antes del horario de mercado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En el supuesto de autorizaciones para la instalación de puestos de elaboración y venta de productos de alimentación, el interesado deberá disponer de instalaciones dotadas de las exigencias establecidas en la normativa vigente en materia de elaboración y manipulación de productos de alimentación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA QUINTA. Requisitos de los solicitantes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;De acuerdo con la Ordenanza, podrán ser titulares de autorización, las personas físicas y empresas que acrediten previamente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Estar dado de alta en el epígrafe o epígrafes correspondientes del Impuesto sobre Actividades&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Económicas o, en su caso, hallarse en alguno de los supuestos de exención establecidos por la normativa vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Estar dado de alta en el régimen de la Seguridad Social que corresponda, y al corriente en el pago de las cotizaciones de la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) Las personas prestadoras procedentes de terceros países tendrán que acreditar el cumplimiento de las obligaciones establecidas en la legislación vigente en materia de autorizaciones de residencia y trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;d) Tener contratado un seguro de responsabilidad civil que cubra los riesgos de la actividad comercial, cuando obtenga la oportuna autorización municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA SEXTA. Presentación de Solicitudes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6.1 Plazos y puestos.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;El plazo de presentación de solicitudes será del 15 de abril al 30 de abril. No se admitirá solicitud de autorización para la venta ambulante con anterioridad o posterioridad a las fechas establecidas al efecto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cada solicitante podrá incluir en la solicitud de puesto únicamente a una persona autorizada como&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;colaborador.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Cuando la misma persona figure en más de una solicitud, bien como titular o como cotitular o colaborador, quedarán automáticamente excluidas estas solicitudes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Las solicitudes, junto con la documentación preceptiva, tendrán que ser presentadas en el Registro General del Ayuntamiento o por cualquiera de los medios previstos en el artículo 16 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6.2 Solicitudes.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;En la solicitud se hará constar lo siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Nombre y apellidos o, en su caso, razón social del prestamista, así como domicilio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Número de NIF, o CIF, en su caso, o documento acreditativo análogo expedido al prestador en el Estado miembro de la Unión Europea.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) El alta de la Seguridad Social, en el régimen que corresponda, y justificación de estar al día de el abono de las cotizaciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;d) En el caso de personas jurídicas, se hará constar también la referencia de la persona, empleado o socio que hará uso de la citada autorización, en su caso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;e) El alta del impuesto de actividades económicas (IAE), en caso de sujeción, o certificado de Hacienda, de estar en alta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;f) En el caso de venta de alimentos, debe aportarse el carné de manipulador de alimentos y/o registro sanitario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;g) Una fotografía de los productos que se pondrán a la venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;h) Documentación acreditativa de la suscripción de un seguro de responsabilidad civil, así como del pago de la correspondiente prima.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;i) Adjuntar la solicitud de inscripción en el mercado de verano de 2024, indicando si necesita que el Ayuntamiento de Ferreries aporte mesa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;j) Haber pagado el precio público estipulado en la tabla de precios de las presentes bases.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;k) Adjuntar la declaración responsable firmada, declarando que se cumplen todos los requisitos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;6.3 Enmienda&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Si la solicitud no reúne los requisitos exigidos en los apartados anteriores, se requerirá al interesado para que en el plazo máximo de 10 días hábiles subsane la falta o acompañe a los documentos preceptivos de su solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA SÉPTIMA. Criterios de Adjudicación&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Con el fin de garantizar la transparencia e imparcialidad en la adjudicación de los puestos, éstos se&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;adjudicarán según orden en el registro de entrada, hasta un máximo de 40 licencias tal y como estipula la cláusula primera. Si pasado el plazo de solicitudes y enmienda, el solicitante no adjunta la documentación que falta, se otorgará la licencia a otro vendedor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA OCTAVA. Adjudicación de las Autorizaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;8.1 Instrucción.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Finalizado el plazo de presentación de solicitudes, se llevará a cabo la valoración de las mismas y la&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;comprobación del cumplimiento de los requisitos exigidos por los servicios técnicos municipales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;8.2. Resolución.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Valoradas las propuestas, los Servicios Técnicos elevarán una propuesta de resolución al órgano competente para la adopción del oportuno acuerdo, que se publicará en la sede electrónica y en el tablón de anuncios de este Ayuntamiento. El plazo máximo para resolver será de tres meses a contar desde el día siguiente al final del plazo para la presentación de solicitudes. Transcurrido el plazo sin haberse notificado la resolución, los interesados podrán entender desestimada su solicitud.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;8.3 Presentación de documentación.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Una vez concedida la autorización municipal, el Ayuntamiento de Ferreries notificará a los vendedores ambulantes para que efectúen el pago en un plazo máximo de 10 días, adjuntando la documentación acreditativa del pago de tasas correspondientes. La falta de presentación de la documentación anteriormente descrita en plazo, se entenderá como renuncia a la autorización por parte de su titular. En este caso, se procederá a autorizar a los solicitantes correspondientes, en función del orden establecido en la lista de espera, concediéndoles un plazo de 5 días para aportar la documentación antes indicada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA NOVENA. Obligaciones de los Adjudicatarios&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Sin perjuicio de las obligaciones derivadas de la normativa vigente en materia de defensa de usuarios y consumidores, las personas titulares de autorizaciones municipales para el ejercicio de la venta ambulante vendrán obligados a cumplir las siguientes especificidades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;a) Exponer en forma fácilmente visible para el público los siguientes elementos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- El documento en el que conste la correspondiente autorización municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Los datos personales, o en su caso, la denominación social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- La dirección donde se atenderán, en su caso, las reclamaciones de los/as consumidores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;b) Las personas que ejerzan la venta ambulante, están obligadas a entregar, si el interesado lo reclama, recibido o justificante de la operación de compraventa, cuyo contenido mínimo será el siguiente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Datos personales, o en su caso denominación social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- DNI o NIE, o CIF&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Producto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Precio y fecha.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Cantidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;- Firma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;c) Dispondrán en el puesto de venta, de los carteles y etiquetas en los que se expondrán de forma visible los precios de venta de los productos ofrecidos. El precio de los productos destinados a la venta se expondrán de forma explícita e inequívoca, observándose en todo momento la legislación vigente en esta materia. En aquellos productos que se vendan a granel o en los que el precio de venta se determine en función de la cantidad o volumen del producto alimenticio, el precio se indicará por unidad de medida. Igualmente tendrán a la vista todas las existencias de artículos, sin que pueda apartar, seleccionar u ocultar parte de ellos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;d) A requerimiento del personal o autoridades municipales que estén debidamente acreditados, los vendedores estarán obligados a facilitarles la documentación que les sea solicitada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;e) Las personas titulares de las autorizaciones respetarán los perímetros y sitios para el ejercicio de la venta, que en ningún caso tendrán que coincidir con el acceso a sitios públicos, privados o establecimientos comerciales o industriales. No podrán, asimismo, situarse de forma que impidan la visibilidad de sus escaparates o expositores, señales de tráfico u otros indicativos. Tampoco podrán ubicarse en las confluencias de las calles, pasos de peatones o entradas reservadas a viviendas, comercio o vehículos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;f) Los puestos que expendan artículos que sean objeto de peso o medida, tendrán que disponer de báscula y metro reglamentarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;g) Todas las mercancías deberán exponerse al público debidamente protegidas, ya una altura mínima de 60 cm. del suelo, salvo aquellas que por su volumen o peso generen algún tipo de problema.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;h) Asimismo, los productos de alimentación, cuando se haya autorizado su venta, se expondrán, en la medida de lo posible, en contenedores o envases homologados, aptos a las características de cada producto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;i) No se podrán expender mercancías fuera del puesto de venta asignado, ni obstaculizar la libre circulación de los pasillos entre puestos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;j) Llevar a cabo la limpieza de sus puestos de venta. Los desperdicios, envases, envoltorios y otros residuos ocasionados a consecuencia del ejercicio de la actividad comercial, serán depositados en los contenedores situados al efecto. La situación de estos contenedores no podrá ser alterada como consecuencia de la actividad de venta ambulante.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;k) Deberán mantener en buen estado de conservación las instalaciones del puesto de venta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;l) Los titulares de los puestos deberán reparar los desperfectos que pudieran ocasionar pavimento, arbolado o alumbrado urbano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;m) Queda prohibida la utilización de aparatos acústicos para comunicar la oferta de mercancías.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA DÉCIMA. Tasas&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los autorizados tendrán que efectuar el pago de las tasas por ocupación de vía pública establecidas por la Ordenanza fiscal correspondiente en el plazo que se indique en la autorización. La falta de pago de las tasas se entenderá como renuncia a la autorización concedida, determinando la aplicación de lo dispuesto en el artículo 6.4 en relación con la lista o turno de espera. La renuncia o desistimiento no generará el derecho a la devolución de las tasas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA UNDÉCIMA. Vigencia de las Autorizaciones&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;La vigencia de las autorizaciones para el ejercicio de la venta ambulante será hasta el 13 de septiembre del año en curso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA DUODÉCIMA. Cobertura de Vacantes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Los solicitantes que no hubiesen obtenido adjudicación constituirán una bolsa o lista de espera a efectos de cobertura de vacantes, ordenada en función de la puntuación obtenida. La propuesta de adjudicación del puesto vacante será notificada al interesado, siguiendo el orden de la bolsa, quien manifestará su aceptación entendiéndose decaído su derecho en caso de no manifestarse.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:white"&gt;CLÁUSULA DECIMOTERCERA. Recursos Administrativos y Jurisdiccionales&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;c) Las personas procedentes de terceros países, tienen que cumplir las obligaciones establecidas a la legislación vigente en materia de residencia y trabajo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;e) Póliza de seguros de responsabilidad civil, con el documento que acredite la vigencia y que está al corriente de pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;f) Carné de manipulador de alimentos del titular y los empleados que tengan que ocupar la parada de venta, en el caso de expedición de productos alimentarios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
