&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Por Resolución de la Presidencia del Institut Mallorquí d'&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Afers Socials&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; (IMAS), con fecha 30 de noviembre de 2022 (BOIB núm. 157, de 3 de diciembre de 2022), se aprobaron la convocatoria, las bases y el baremo de méritos del proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario en las escalas, subescalas, clases y especialidades de los subgrupos C1, C2 y AP de las plazas de la oferta pública extraordinaria p&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;ara&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; el año 2022&lt;/span&gt;&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;2.&lt;/strong&gt; &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En sesión celebrada día 14 de noviembre de 2023, el Tribunal Calificador, después de haber revisado el orden de preferencia de los puestos ofrecidos de las personas aspirantes y atendiendo al orden de puntuación establecido en la lista definitiva de baremación de méritos, acordó aprobar la lista definitiva de las personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario en la escala de administración general, subescalas, clases y especialidades del subgrupo C1 del IMAS, correspondiente a la oferta extraordinaria para el año 2022, y propuso su nombramiento como personal funcionario de carrera del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;3.&lt;/strong&gt; &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Por Resolución de la Presidencia del IMAS con fecha 24 de noviembre de 2023, se aprobó la lista definitiva de las personas aspirantes que superaron el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario de la escala de &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;a&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;dministración &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;general, subescala administrativa, clase administrativo-administrativa, subgrupo C1, correspondiente a la oferta extraordinaria para el año 2022 (Anexo I de la Resolución). Asimismo, se nombró personal funcionario de carrera a las personas que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario en la escala de administración general, subescalas, clases y especialidades del subgrupo C1 del IMAS (Anexo II de la Resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;4.&lt;/strong&gt; &lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En sesión celebrada el 19 de febrero de 2024, el Tribunal Calificador acordó excluir de la convocatoria a doña Maria Mercedes Comas Barrigon, por no cumplir con el requisito establecido en la base 5.1.b) y exceder de la edad de jubilación forzosa, de acuerdo con la base 6.7. A consecuencia de la exclusión de esta aspirante, acordó modificar la lista definitiva de las personas aspirantes que habían superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario de la escala de administración general, subescala administrativa, clase administrativo-administrativa del subgrupo C1, incorporando a la siguiente persona aspirante según el orden de prelación definitivo de la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;5. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;El Tribunal Calificador, en sesión celebrada el 11 de marzo de 2024, teniendo en cuenta los errores materiales detectados en las puntuaciones obtenidas en la lista definitiva de méritos, acuerda modificar esta lista, que se publica el mismo día en el tablero de anuncios electrónico del IMAS, y que afecta al orden de prelación de las personas aspirantes y a la lista definitiva de las personas que han superado el proceso selectivo de estabilización para el ingreso como personal funcionario.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;6. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Dada la modificación de la lista definitiva de méritos, &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;con&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; fecha 29 de febrero de 2024 se dio trámite de audiencia a las personas afectadas p&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;ara&lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt; presentar las alegaciones que consideraran pertinentes. Así pues, efectuado el trámite de audiencia, las personas afectadas presentaron instancia en la que manifestaban que no realizarían alegaciones ni aportarían nuevos documentos o justificaciones y daban por realizado el trámite de audiencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;7. &lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;En sesión celebrada el 14 de marzo de 2024, el Tribunal Calificador acuerda modificar la lista definitiva de las personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario del escala de Administración general, subescala administrativa, clase administrativo-administrativa, subgrupo C1. Además, propone dejar sin efectos el nombramiento de doña Maria Joaquina Martínez Castillo como personal funcionario de carrera de la escala de Administración general, subescala administrativa, clase administrativo-administrativa, subgrupo C1 de la Resolución de la Presidencia de la IMAS con fecha 24 de noviembre de 2023. También propone dejar sin efectos el nombramiento de la señora Joana Aina Serra Caimari en el IMAS, dado que se le asigna un puesto de trabajo de las plazas ofertadas por el CIM. Por último, propone el nombramiento de personal funcionario de carrera de la escala de Administración general, subescala administrativa, clase administrativo-administrativa, subgrupo C1 del IMAS, de las personas aspirantes Maria José Espias Garcia y Maria Magdalena Nadal Rossello.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;8&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;Por Resolución de la Presidencia del IMAS con fecha 15 de marzo de 2024 se modificó la Resolución de la Presidencia del IMAS de 24 de noviembre de 2023, en &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;la &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;que &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;se dispone:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;«&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;Modificar el Anexo I de la Resolución de la Presidencia del IMAS con fecha 24 de noviembre de 2023, por la que se aprueba la lista definitiva de las personas aspirantes que han superado el proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario de la escala de Administración general, subescala administrativa, clase administrativo/a del subgrupo C1, correspondiente a la oferta extraordinaria para el año 2022. Se adjunta el Anexo I modificado &lt;/span&gt;&lt;span style="color:#000000"&gt;en&lt;/span&gt;&lt;span style="color:#000000"&gt; esta Resolución.&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Fonaments de dret&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;1. &lt;/strong&gt;El Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;2. &lt;/strong&gt;La Resolución de la Presidencia del IMAS, con fecha 30 de noviembre de 2022 (BOIB núm. 157, de 3 de diciembre de 2022), por la que se aprobaron la convocatoria, las bases y el baremo de méritos del proceso selectivo de estabilización por el sistema de concurso excepcional para el ingreso como personal funcionario en las escalas, subescalas, clases y especialidades de los subgrupos C1, C2 y AP de las plazas de la oferta pública extraordinaria para el año 2022 .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;3. &lt;/strong&gt;La base 5.1 del Anexo II de la convocatoria establece que por tener la condición de aspirante y ser admitidas al proceso selectivo que se convoca, las personas interesadas deben cumplir con la fecha de finalización del plazo de presentación de solicitudes de esta convocatoria y durante el proceso selectivo los requisitos establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;4. &lt;/strong&gt;La base 5.4 del Anexo II de la convocatoria establece que las personas aspirantes deben cumplir los requisitos exigidos el día de finalización del plazo de presentación de solicitudes de esta convocatoria, y deben mantenerlos hasta el momento de la toma de posesión como funcionario de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;5. &lt;/strong&gt;La base 8.8.1 del Anexo II de la convocatoria indica que, para garantizar la cobertura real de todos los puestos ofrecidos por el IMAS y del Consell de Mallorca, se ofrecerán los puestos vacantes a la siguiente persona aspirante disponible en la lista definitiva de valoración de méritos donde se produzca la vacante, según la preferencia de elección de puestos y el orden de puntuación establecido en la lista definitiva de valoración de méritos, tanto si esta vacante se produce por renuncia o por otros motivos .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;6. &lt;/strong&gt;De acuerdo con la base 9.1 del Anexo II de la convocatoria y el artículo 52.3 de la Ley 3/2007, de 27 de marzo, de la función pública de la comunidad autónoma de las Illes Balears, en concordancia con el artículo 61.8 del Real decreto legislativo 5/2015, de 30 de octubre, por el que se aprueba el texto refundido de la Ley del Estatuto básico del empleado público (TREBEP), la lista de personas que han superado el proceso selectivo debe contener, como máximo, tantas personas aprobadas como el número de plazas convocadas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;7. &lt;/strong&gt;La Presidencia del IMAS es el órgano competente para resolver los procedimientos de selección y nombrar al personal funcionario de carrera, de acuerdo con lo que se prevé en el artículo 7.2.14) del texto consolidado de los Estatutos del Institut Mallorquí d'Afers Socials, aprobados por el Pleno del Consell de Mallorca de día 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2.Notificar individualmente a los interesados.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. Ordenar la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares. Las personas relacionadas dispondrán de un plazo de tres días hábiles desde el día siguiente de la publicación, por el juramento o promesa y la toma de posesión.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Esta resolución no pone fin a la vía administrativa y contra ella puede interponerse, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consell de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consell Insular de Mallorca, dentro del plazo de un mes, a contar a partir del día siguiente al de la publicación de la presente Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, a contar a partir del día siguiente al de la notificación de la desestimación de dicho recurso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;No obstante lo anterior, podrá ejercitarse, en su caso, cualquier otro recurso que se estime pertinente. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
