    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;En fechas 24 de noviembre de 2023 y 26 de febrero de 2024, el director gerente de la Agencia de Defensa del Territorio de Mallorca ha dictado las siguientes resoluciones:&lt;/p&gt;

&lt;p&gt;Resolución de fecha 24 de noviembre de 2023:&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;Visto el Acuerdo del Tribunal Calificador de propuesta de personas aspirantes que han superado el proceso selectivo de estabilización por&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; el sistema de concurso excepcional para el ingreso como personal funcionario en la escala&lt;span style="display:none"&gt;&amp;lt;A[escalera|escala]&amp;gt;&lt;/span&gt; de administración general, subescala&lt;span style="display:none"&gt;&amp;lt;A[subescalera|subescala]&amp;gt;&lt;/span&gt; administrativa, administrativo –a del subgrupo C1, de la Agencia del Territorio y del nombramiento como funcionarios de carrera, de fecha 22 de noviembre de 2023, y una vez comprobado el cumplimiento&lt;span style="display:none"&gt;&amp;lt;A[cumplimiento|cumplido]&amp;gt;&lt;/span&gt; de los requisitos para ser nombrados funcionarios de carrera.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="line-height:115%"&gt;RESUELVO&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Primero.- Aprobar&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; la lista definitiva de personas aspirantes que han superado el proceso selectivo de estabilización por&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; el sistema de concurso excepcional para el ingreso como personal funcionario en la escala&lt;span style="display:none"&gt;&amp;lt;A[escalera|escala]&amp;gt;&lt;/span&gt; de administración general, subescala&lt;span style="display:none"&gt;&amp;lt;A[subescalera|subescala]&amp;gt;&lt;/span&gt; administrativa, administrativo –a del subgrupo C1 de la Agencia del Territorio, de acuerdo con lo que se indica en el anexo 1 de este documento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el artículo 52.3 de la Ley 3/2007, en concordancia con el artículo 61.8 del TREBEP, esta lista contiene, como máximo, tantas personas aprobadas como número de plazas convocadas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Segundo.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif; line-height:115%"&gt; &lt;strong&gt;Nombrar &lt;/strong&gt;personal funcionario de carrera de la escala de administración general, subescala administrativa, administrativo –a de administración general del subgrupo C1 de la Agencia del Territorio, a las personas aspirantes que han superado el procedimiento selectivo de estabilización por el sistema de concurso excepcional para la convocatoria de estas plazas, de acuerdo con lo que se indica al anexo 1 de este documento.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:107%"&gt;Visto el informe favorable de fiscalización previo 2024/0010 de 26 de febrero de 2024&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:107%"&gt;Por todo eso, y en virtud de las atribuciones conferidas, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Informar que de acuerdo con el artículo 22.1 del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares y el punto 9.3 de las bases específicas de la convocatoria, los puestos de trabajo de jefaturas orgánicas y puestos de trabajo singularizados se adjudican en adscripción provisional.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:black"&gt;&lt;strong&gt;&lt;span style="line-height:115%"&gt;Segundo. -&lt;/span&gt;&lt;/strong&gt;&lt;span style="line-height:115%"&gt; &lt;strong&gt;Ordenar &lt;/strong&gt;la publicación de la presente Resolución en el Boletín Oficial de las Islas Baleares, a los efectos oportunos. Las personas nombradas dispondrán de un plazo de 3 días hábiles, contado a partir del día siguiente en la publicación, para la toma de posesión. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:107%"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:107%"&gt;Contra esta resolución, que pone fin a la vía administrativa, las personas interesadas pueden interponer recurso potestativo de reposición delante del mismo órgano que ha dictado la resolución en el plazo de UN MES. Contra la desestimación expresa del recurso de reposición podrá interponerse recurso contencioso administrativo ante el Juzgado Contencioso administrativo de Palma que corresponda, en el plazo de DOS MESES, contados a partir del día siguiente de la notificación de la desestimación del mencionado recurso. Una vez transcurrido un mes desde la interposición del recurso de reposición sin que se haya notificado la resolución, se podrá interponer recurso contencioso administrativo, contra la desestimación presunta del recurso de reposición, sin limitación temporal, mientras no haya resolución expresa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:107%"&gt;&lt;span style="color:black"&gt;&lt;span style="line-height:107%"&gt;No obstante el anterior, se puede ejercitar, si es el caso, cualquier otro recurso que se estime pertinente. Todo eso de conformidad con el artículo 4.2 de los Estatutos de la Agencia, aprobados por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el Pleno del Consejo Insular de Mallorca, en sesión de día 10 de noviembre de 2008 (última publicación BOIB nº. 41, de 30/03/2019), la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contenciosa administrativa. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
