    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El 19 de septiembre de 2023 se publicó el acuerdo de la Comisión Insular de Ordenación del Territorio, Urbanismo y Patrimonio Histórico-Artístico del Consejo Insular de Eivissa, de 13 de julio de 2023, de aprobación definitiva de la revisión del Plan General de Ordenación Urbana de Eivissa. Dado que se ha advertido una omisión en los artículos 7.3 y 8.4 de las Normas urbanísticas de la Revisión del PGOU que fueron publicadas junto con el acuerdo, se considera necesario subsanar la omisión y publicar su corrección.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, las administraciones pueden rectificar en cualquier momento los errores materiales, de hecho o aritméticos existentes en sus actas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo ello, según el acuerdo de la CIOTUPHA de 14 de marzo de 2024, corresponde publicar en el Boletín oficial de las Illes Balears la corrección de errores de los artículos 7.3 y 8.4 de las Normas urbanísticas de la Revisión del PGOU de Eivissa, en el siguiente sentido:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Respecto a la redacción del artículo 7.3 de la Revisión del PGOU,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Donde dice:&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«&lt;strong&gt;Artículo 7. ACTOS SUJETOS A LICENCIA URBANÍSTICA&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;(…)&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Las actuaciones sobre infraestructuras de telecomunicaciones contempladas en el artículo 49, apartados 10 y 11, de la LGTEL no requerirán la obtención de licencia.»&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Debe decir:&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«&lt;strong&gt;Artículo 7. ACTOS SUJETOS A LICENCIA URBANÍSTICA&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Las actuaciones sobre infraestructuras de telecomunicaciones contempladas en el artículo 49, apartados 9, 10 y 11, de la LGTEL no requerirán la obtención de licencia.»&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Respecto a la redacción del artículo 8.4 de la Revisión del PGOU,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Donde dice:&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;«&lt;strong&gt;Artículo 8. ACTOS SUJETOS A COMUNICACIÓN PREVIA DE OBRAS&lt;/strong&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;(…)&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4. Aquellas infraestructuras de telecomunicaciones &lt;/em&gt;contempladas&lt;em&gt; en el artículo 49, apartados 10 y 11, de la LGTEL no requerirán de presentación de comunicación previa ni de otro procedimiento similar.»&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
