    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punto 3 del apartado Octavo de las Resoluciones del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023 por la que se convocan ayudas destinadas al pago compensatorio para zonas con limitaciones específicas, ayudas destinadas al pago compensatorio en zonas de montaña, ayudas destinadas al fomento de las razas autóctonas en peligro de extinción, fomento de la agricultura ecológica y fomento de pastos para el aprovechamiento de la ganadería ecológica, de 14 de abril de 2023 por la que se convocan ayudas destinadas al fomento de la producción integrada, de 18 de abril de 2023 ayudas destinadas a la protección de variedades autóctonas en riesgo de erosión genética y de 9 de mayo de 2023, por la que se convocan ayudas destinadas a pago de los cultivos sostenibles por el uso de aguas regeneradas, para el año 2023, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Illes Balears, y se hará de de acuerdo con los términos previstos en el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del FOGAIBA, con&amp;nbsp;fecha 9&amp;nbsp;de&lt;/span&gt;&amp;nbsp;&lt;span style="color:#212121"&gt;marzo&amp;nbsp;de 2024, firmó la siguiente resolución: &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al fomento de la agricultura ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;7. Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al fomento de pastos para el aprovechamiento de la ganadería ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;8. Con fecha 11 de mayo de 2023 se publicó, en el BOIB núm. 60, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 9 de mayo de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al pago de los compromisos agroambientales de los cultivos sostenibles por el uso del agua regenerada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;9. De conformidad con los apartados sexto de ambas resoluciones, y de la Resolución de modificación de la Presidenta del Fogaiba, para el año 2023, de determinadas ayudas comunitarias directas y al desarrollo rural en la Agricultura y en la Ganadería, de fecha 25 de mayo de 2023, publicada en el boib 71 de 30 de mayo de 2023, el plazo de presentación de solicitudes de las convocatorias terminó el 30/6/23, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 1357 solicitudes de ayuda de limitaciones específicas, 274 de ayuda de montaña, 299 de ayuda de fomento de razas autóctonas, 188 de ayuda de fomento y protección de variedades autóctonas en riesgo de erosión genética, 300 de ayuda de producción integrada, 551 de ayuda de agricultura ecológica, 162 de ayuda de pastos de ganadería ecológica y 48 de ayuda por riego con aguas regeneradas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de estas ayudas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;11. Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;em&gt;de febrero de 2024 se notificó, mediante publicación en la página web http:ll www.caib.es, el informe y propuesta provisional de denegación de las ayudas anteriormente mencionadas, emitida por Servicio de Ayudas al Desarrollo Rural a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;12.Con fecha 16 de febrero de 2024 el vicepresidente en materia agraria del FOGAIBA, dicta resolución de denegación la cual se publica en el BOIB nº25 de 20 de febrero de 2024. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;13. El beneficiario que figura en el Anexo I presenta la documentación requerida antes de la publicación en el BOIB de la resolución de denegación y se comprueba que cumple con el requisito para poder ser beneficiario de las ayudas antes detalladas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;14. El artículo 109.1 de la Ley 39/2015, de revocación de actas y rectificación de errores por el que las administraciones públicas pueden revocar, mientras no haya transcurrido el plazo de prescripción, sus actos de grabación o desfavorables, siempre que esta revocación no constituya dispensa o exención no permitida por las leyes, ni sea contraria al principio de igualdad, al interés público o al ordenamiento jurídico.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;10. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;16. Real Decreto 1054/2022, de 27 de diciembre, por el que se establece y regula el Sistema de información de explotaciones agrícolas y ganaderas y de la producción agraria, así como el Registro autonómico de explotaciones agrícolas y el cuaderno digital de explotación agrícola. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;17. Real Decreto 1051/2022, de 27 de diciembre, por el que se establecen unas normas para la nutrición sostenible en suelos agrarios. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;18. Real Decreto 1050/2022, de 27 de diciembre, por el que se modifica el Real Decreto 1311/2012, de 14 de septiembre, que establece el marco de actuación para conseguir un uso sostenible de los productos fitosanitarios. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;19. Real Decreto 147/2023, de 28 de febrero, por el que se establecen las normas para la aplicación de penalizaciones en las intervenciones previstas en el Plan estratégico de la política agrícola común, modificándose varios reales decretos por los que se regulan diferentes aspectos relacionados con la aplicación en España de la política agrícola común para el período 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;20. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;21. Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;22. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El resto de normativa de desarrollo y aplicación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Revocar parcialmente la resolución de denegación de 16 de febrero de 2024 publicada en el BOIB núm. 25 del 20 de febrero de 2024. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Notificar la resolución al interesado del Anexo I mediante la publicación en el BOIB. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
