&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedentes &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; Vista la convocatoria del proceso de estabilización por el sistema concurso de méritos para la cobertura de tres (3) plazas de personal laboral categoría Personal especializado, clase jardinero/a, nivel V del Convenio colectivo, del Ayuntamiento de Llucmajor, las bases de la cual se publicaron &lt;span style="color:#000000"&gt;en el &lt;/span&gt;BOIB n.º 154 de 26 de noviembre de 2022 y el anuncio de la cual se publicó &lt;span style="color:#000000"&gt;en el&lt;/span&gt; BOE n.º 307 de 23 de diciembre de 2022.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.- &lt;/strong&gt;Visto el Decreto 2023004560 de día 15 de noviembre de 2023 en el cual se establece que los Srs. Esteve Montalvo i Camps, Marc Rafael Bujosa Bohm y Humberto Carlos Carrascosa Miret han superado el proceso selectivo del concurso extraordinario de méritos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.- &lt;/strong&gt;Dado que el Sr. Esteve Montalvo i Camps en fecha 26/01/2024 (RGE. N.º 1.780) y el Sr. Marc Rafael Bujosa Bohm en fecha 29/01/2024 (RGE. N.º 1.884) presentaron &lt;span style="color:#000000"&gt;su&lt;/span&gt; renuncia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.-&lt;/strong&gt; &lt;span style="color:#000000"&gt;Visto&lt;/span&gt; lo establecido en la base 15.3&lt;em&gt; «...cuando haya renuncias de aspirantes seleccionados antes del nombramiento o la toma de posesión, el tribunal elevará al órgano convocan&lt;/em&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;te&lt;/em&gt;&lt;/span&gt;&lt;em&gt; una relación complementaria de los aspirantes que estén situados a continuación de las personas propuestas, por orden de puntuación, para su posible nombramiento como personal funcionario de carrera en sustitución de las que renuncien &lt;/em&gt;&lt;span style="color:#00000a"&gt;&lt;em&gt;a&lt;/em&gt;&lt;/span&gt;&lt;em&gt; las plazas.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinto.- &lt;/strong&gt;Visto el anuncio de la relación complementaria de las personas aspirantes que han superado el proceso selectivo por orden de prelación, realizado por el Tribunal el día 10 de enero de 2024 y publicado el día 11 de enero de 2024. Resulta, en conformidad con &lt;span style="color:#000000"&gt;lo&lt;/span&gt; previsto en la base 15.3, que el Sr. Igor Ernesto Verdaguer Rivera, con DNI **3385*** y el Sr. Toni Gamez Matas, con DNI **2276***, &lt;span style="color:#000000"&gt;son&lt;/span&gt; los aspirantes situados a continuación de las personas propuestas, por orden de puntuación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En consecuencia,&lt;strong&gt; RESUELVO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- &lt;/strong&gt;Aceptar la renuncia del Sr. &lt;span style="color:#000000"&gt;Esteve Montalvo i Camps&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;de fecha 26/01/2024 y RGE. Nº. 1.780 y del Sr. Marc Rafael Bujosa Bohm de fecha 29/01/2024 y RGE. Nº. 1.884.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt; Ordenar la contratación de:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;como personal laboral fijo Jardinero, categoría Personal especializado, clase jardinero/a, nivel V del Convenio colectivo del Ayuntamiento de Llucmajor, derivada de la Oferta de Ocupación Pública Extraordinaria de 2022 del Ayuntamiento de Llucmajor.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Publicar &lt;span style="color:#000000"&gt;esta&lt;/span&gt; Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;.-&lt;/strong&gt; Requerir a los Srs. &lt;span style="color:#000000"&gt;Humberto Carlos Carrascosa Miret&lt;/span&gt;, Igor Ernesto Verdaguer Rivera y Toni Gamez Matas para que firmen contrato en el plazo máximo de tres días hábiles, &lt;span style="color:#000000"&gt;a contar&lt;/span&gt; a partir del día siguiente a la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinto&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;.-&lt;/strong&gt; Dar traslado de esta Resolución al Pleno del Ayuntamiento, así como a la Unidad de Recursos Humanos por su conocimiento y efectos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra esta resolución los interesados podrán interponer un recurso potestativo de reposición ante este Ayuntamiento, en el plazo de un mes a contar del día siguiente de la publicación, de conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;También podrán interponer alternativamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-administrativo con sede en Palma, en el plazo de dos meses, de conformidad con lo establecido en los artículos 30, 112.3 y 114.1 c) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y 8, 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En caso de optar por interponer el recurso de reposición, no se podrá interponer un recurso contencioso-administrativo hasta que se haya notificado la resolución expresa del recurso de reposición o haya transcurrido un mes desde su interposición sin haber recibido la notificación, fecha en que se podrá entender desestimado por silencio administrativo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Todo &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ello&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; sin perjuicio de que puedan interponer cualquier otro recurso que estimen oportuno.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
