El 15 de septiembre de 2015 se publicó en el Boletín Oficial de las Islas Baleares núm. 136 la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 10 de septiembre de 2015, por la que se convocan, para los años 2015 a 2019, subvenciones para la creación de empresas de jóvenes agricultores . La citada Resolución se modificó en fecha 26 de abril de 2016 (BOIB núm. 54, de 30 de abril de 2016), modificada por la Resolución del presidente del FOGAIBA de 26 de junio de 2018 (BOIB núm. 80, de 28 de junio de 2018). </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>2. El 1 de septiembre de 2022, el vicepresidente en materia agraria del FOGAIBA dictó la Resolución de concesión de ayudas para la creación de empresas de jóvenes agricultores (RES1), publicada en el BOIB nº.118, de 8 de diciembre de 2022, en la que se incluye una concesión a favor de NADAL JOSEP GALMÉS SITJAR</em></em><em><em>, con NIF ***</em></em><em><em>3</em></em><em><em>7</em></em><em><em>65</em></em><em><em>**, con importe de ayuda por concurrencia de 27.500,00 €, con núm. de expediente CEJA2021_1/0</em></em><em><em>35</em></em><em><em>.</em></em><em>&nbsp;<em>Dentro de la subvención concedida se incluyeron 10.000,00 € para&nbsp;una UTA con orientación productiva de hortofruticultura/frutales en regadío a su explotación.</em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>3. El 25&nbsp;de julio de 2023&nbsp;NADAL&nbsp;JOSEP GALMÉS SITJAR presentó la solicitud del segundo pago de ayuda correspondiente al expediente núm. CEJA2021_1/035.</em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>4. Consultado el RIA de su explotación (230744) no se alcanza 1 UTA en la orientación productiva indicada en el plan empresarial presentado. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>5. Este cambio no afecta a la concurrencia de la convocatoria, ni a terceros. </em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>6. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que “Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. Como consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades percibidas indebidamente”.</em></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="background-color:#ffffff"><span style="color:#000000"><em>7. </em></span></span><em>Por todo ello, se propone la revocación parcial de 10.000,00 €, dado que el solicitante no llega a la UTA en la orientación productiva hortofruticultura/frutales en regadío a su explotación.</em></em></span></p> <p><strong><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>Fundamentos de derecho</em></em></span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><em>1.
