&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(&lt;span style="color:#000000"&gt;FOGAIBA) &lt;/span&gt;en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&lt;span style="color:#000000"&gt;&amp;nbsp;43&lt;/span&gt;&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015&lt;span style="color:#000000"&gt;, &lt;/span&gt;de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;El vicepresidente&amp;nbsp;en Materia Agraria&amp;nbsp;del &lt;span style="color:#000000"&gt;FOGAIBA, con fecha 22&amp;nbsp;de febrero&amp;nbsp;de 2024, firmó la siguiente &lt;/span&gt;resolución, &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;em&gt;"INFORME PROPUESTA DE RESOLUCIÓN / RESOLUCIÓN DE DE&lt;/em&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;NEGACIÓN&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) por la que se convocan, para el año 2022, subvenciones para inversiones en la transformación y comercialización de productos agrícolas ecológicos. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la mencionada Resolución, el plazo de presentación de solicitudes terminó el día a 30/12/2022, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 11 solicitudes de ayuda. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Una vez evaluadas la solicitud de ayuda &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;presentada por JAUME POU RIPOLL, expediente ITC2022_2/004, se le comunica la Propuesta provisional de concesión parcial de día 19/05/2023. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;5. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;n fecha 08/06/2023 el interesado presenta alegaciones a la citada propuesta. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;6. Vistas las alegaciones presentadas, el Servicio gestor ha revisado el expediente, y se ha concluido que lo que procede es proponer la denegación, dado que el interesado no cumple con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el Anexo I adjunto. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;7. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;n fecha 15/09/2023 se firma la propuesta provisional de denegación, y se notifica al interesado, concediendo un plazo de 10 días para presentar las alegaciones oportunas. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;8. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Co&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;n fecha 02/10/2023 el interesado ha presentado alegaciones (GOIBE620919/2023), las cuales no se aceptan. El motivo de la denegación se detalla en el Anexo I.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;3. Real decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, general de subvenciones. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;4. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;INFORME Y PROPUESTA&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Analizadas las alegaciones presentadas por el interesado, detalladas en el Anexo I, este servicio gestor las desestima, tal y como se motiva en el citado anexo, por incumplir los requisitos de la convocatoria: &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;punto 7 &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;artículo 4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&amp;nbsp;de la convocatoria : las actividades propuestas no se consideran ni técnica ni económicamente viables. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Por todo ello, se propone al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;1.&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Denegar la ayuda solicitada por los interesados que figuran en el Anexo I, que son un total de 1 expediente y que comienza con JAUME POU RIPOLL y termina con JAUME POU RIPOLL, relativa a la línea de ayudas “Transformación y comercialización de productos agrícolas ecológicos 2022”, por no cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el mencionado anexo. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo I. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

Se desestiman el resto de alegaciones presentadas ya que no han aclarado los siguientes puntos y por tanto se mantiene la conclusión de proyecto no viable:&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;La memoria agronómica con los cuadros de las capacidades productivas y procedencia antes y después de la inversión presentados en las alegaciones siguen sin estar sustentados por detalle de insumos y precios (no salen las producciones de los demás productores suministradores de la fábrica ni productos transformados de las nuevas líneas de transformación, ni precios detallados de los productos transformados con los distintos formatos, los gastos de producción, etc), ni la Viabilidad técnica del proyecto con sus salidas comerciales. La producción inicial en la memoria dice 15.000kg y en el cuadro 39.847kg. El interesado alega que la producción de 15.000 kg se refería a kg destinados a transformación, pero en el cuadro de materias primas destinadas a transformación vuelve a poner 39.847 kg, por tanto continúan las contradicciones, junto con otros datos inconexos, como los alegaciones diciendo que sí existe un servicio logístico, pero sin valorarlo económicamente en ninguna parte. No presenta un plan de negocio detallado y completo con gastos fijos y variables, transporte y logística, precios unitarios de todos los productos, flujos de caja, cálculo del TIR, y demás datos que puedan demostrar la viabilidad económica de este proyecto. El porcentaje de beneficio calculados no tiene ningún estudio que lo sustente; los incrementos de 165% no están justificados, y no puede resumirse un beneficio como un porcentaje lineal. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-size:10px"&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;&lt;span style="line-height:114%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;No se demuestra la solvencia del solicitante por asumir el gasto total, sin contabilizar la recepción de la subvención. &lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
