10430 CAIB 550 es 2024-03-02 CAIB 10429 CAIB ![CDATA[Resolución del síndico mayor por la que se aprueban la lista de personas que alcanzan un nuevo nivel de carrera profesional y la de las que no lo alcanzan]] 128047 2024-02-28 2024-03-02 683733 text/html es ![CDATA[<p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución del síndico mayor por la que se aprueban la lista de personas que alcanzan un nuevo nivel de carrera profesional y la de las que no lo alcanzan</strong></span></span></p> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Antecedentes</strong></span></span></p> <ol> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Mediante la Resolución del síndico mayor de 30 de noviembre de 2023 (BOIB n.º 164, de 2 de diciembre de 2023), se aprobó la convocatoria ordinaria para acceder a los diferentes niveles que integran la carrera profesional horizontal del personal funcionario de carrera y laboral de la Sindicatura de Cuentas de las Illes Balears.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">El 12 de febrero de 2024, el Comité de Valoración elevó al síndico mayor la propuesta definitiva sobre la estimación o la desestimación de las solicitudes de acceso a cada nivel, así como de las personas excluidas, con la especificación de las respectivas causas de desestimación o exclusión, de acuerdo con la base 5.8 de la convocatoria.</span></span></p> </li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></span></p> <ol> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La base 5.9 de la convocatoria establece que el síndico mayor ha de dictar una resolución definitiva, en la que ha de constar de manera individualizada el alcance o no del nivel de carrera correspondiente, con la especificación de las respectivas causas de desestimación o exclusión. Esta resolución se ha de publicar en el <em>Boletín Oficial de las Illes Balears</em>.</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">La base 6 de la convocatoria dispone que el reconocimiento administrativo del nivel correspondiente se retrotrae a la fecha de publicación de la convocatoria en el <em>Boletín Oficial de las Illes Balears</em>. Los efectos económicos se retrotraen como máximo a 1 de enero de 2023 y no pueden ser anteriores a la fecha en que, para la persona solicitante, se cumplen cinco años desde que ha alcanzado el nivel reconocido anteriormente o, en su caso, desde que ha alcanzado los requisitos para acceder al nivel inicial.</span></span></p> </li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, </span></span></p> <p style="text-align:center"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resuelve</strong></span></span></p> <ol> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Aprobar la lista definitiva de las personas que alcanzan un nuevo nivel de carrera profesional (anexo 1), así como la de las que no lo alcanzan (anexo 2).</span></span></p> </li> <li> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Publicar esta Resolución y sus anexos en el <em>Boletín Oficial de las Illes Balears y </em>en el tablón de anuncios de la sede electrónica de la SCIB, &lt;https://seu.sindicaturaib.org&gt;.</span></span></p> </li> </ol> <p><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px">Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante el Consejo de la Sindicatura en el plazo de un mes a contar desde el día siguiente de su publicación, de conformidad con la disposición adicional primera del Reglamento de régimen interior de la SCIB y los artículos 121 y siguientes de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.</span></span></p> <p> </p> <p style="text-align:center"><em><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif;
