&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Procedimiento: Disposiciones Normativas (Aprobación, Modificación o Derogación)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Pleno de esta Corporación municipal en sesión ordinaria &lt;/span&gt;&lt;span style="color:#000000"&gt;celebrada día 25 de enero de 2024, ha adoptado, entre otros, el acuerdo de aprobación inicial de la modificación de la Ordenanza Municipal reguladora de Actividades Recreativas, Artísticas, Establecimientos y Espectáculos Públicos, de sus horarios y su actividad tanto en zona privada como pública que en su parte bastante dice:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;«&lt;strong&gt;PRIMERO.- APROBAR&lt;/strong&gt; inicialmente la modificación de la Ordenanza Municipal Reguladora de Actividades Recreativas, Artísticas, Establecimientos y Espectáculos Públicos, de sus horarios y su actividad tanto en zona privada como pública, del Ayuntamiento de Andratx, en base a lo expuesto en los fundamentos jurídicos del presente informe y visto el cumplimiento de los principios de necesidad, eficacia, proporcionalidad, seguridad jurídica, transparencia, y eficiencia, con el siguiente cuerpo normativo: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;“&lt;strong&gt;ORDENANZA REGULADORA LAS ACTIVIDADES RECREATIVAS, ARTÍSTICAS, ESTABLECIMIENTOS Y ESPECTÁCULOS PÚBLICOS, DE SUS HORARIOS Y SU ACTIVIDAD TANTO EN ZONA PRIVADA COMO PÚBLICA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Motivaciones&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La modernización socio-económica de nuestra población en estos últimos años ha sido muy importante, con lo que este ayuntamiento ve la necesidad de adaptar la regulación de horarios de los establecimientos, para asegurar el cumplimiento de la legislación en materia de actividades de la Comunidad Autónoma de las Illes Balears, y a su vez que esta Ordenanza que nos compete, este coordinada con las de nueva creación en referencia a ruidos y vibraciones, así como de ocupación de la vía pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La motivación fundamental de la regulación de los horarios de los establecimientos del sector de la restauración es asegurar la tranquilidad, buena convivencia, de los vecinos de nuestro municipio y sus visitantes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Tener en cuenta que la correcta ordenación de los horarios incide directamente en la seguridad ciudadana, orden público, limpieza de nuestras calles, así como el control de ruidos que se produce por la actividad del sector de la restauración.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El artículo 25 de la Ley 7/2013, de 26 de noviembre, de régimen jurídico de instalación, acceso y ejercicio de actividades en las Illes Balears, modificada por la Ley 6/2019, de 8 de febrero, dispone en su apartado primero que las administraciones públicas, en el ámbito de sus competencias, deberán adecuar su función de regulación de los horarios y de autorización y control de actividades a las disposiciones de la presente ley. En especial, las administraciones competentes velarán por evitar las molestias y los problemas de orden público que el funcionamiento de la actividad pueda producir en el exterior derivados de ruidos y vibraciones y de concentraciones humanas o de vehículos que puedan afectar a la seguridad o a la salud pública.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presente ordenanza viene a recoger tanto las inquietudes socioeconómicas del municipio de Andratx, como la protección medioambiental en cuestión de ruidos y vibraciones. Dado ambas inquietudes, se ha procedido a la redacción de dicha ordenanza para regular el horario de las actividades de restauración que se vienen desarrollando en el Término Municipal de Andratx, y así también de dicha ordenanza haga cumplimiento de la legislación autonómica y estatal vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Hay que destacar, que dicha ordenanza, se coordinará con las demás ordenanzas de este municipio. Con el objetivo de facilitar a los ciudadanos y al sector de la restauración de este municipio puedan ejercer, con más facilidad y defensa, jurídica sus derechos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las definiciones de las actividades, que esta ordenanza recoge, son las que vienen estipuladas en la Ley 8/2012, de 19 de julio, del Turismo de las Illes Balears. Atendiendo el procedimiento que los establecimientos deben de seguir para su registro, el cual viene regulado en Decreto 20/2015, de 17 de abril, de principios generales y directrices de coordinación en materia turística; de regulación de órganos asesores, de coordinación y de cooperación del Gobierno de las Illes Balears, y de regulación y clasificación de las empresas y de los establecimientos turísticos, dictado en el desarrollo de la Ley 8/2012, de 19 de julio de 19 de julio, de Turismo de las Illes Balears, se considera oportuno unificar criterio con la Conselleria de Turismo a efectos de coordinación y agilidad. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 1&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Definiciones&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las definiciones que a continuación se redactan son a efectos de cumplimiento de las leyes: Ley 8/2012, de 19 de julio , del Turismo de las Illes Balears, la cual viene regulada en Decreto 20/2015, de 17 de abril, de principios generales y directrices de coordinación en materia turística; de regulación de órganos asesores, de coordinación y de cooperación del Gobierno de las Illes Balears, y de regulación y clasificación de las empresas y de los establecimientos turísticos, dictado en el /desarrollo de la Ley 8/2012, de 19 de julio de 19 de julio, de Turismo de las Illes Balears, Ley 8/2014. de 1 de agosto, del juego y de las apuestas en las Illes Balears, Ley 55/2007, de 28 de diciembre, del Cine.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Definiciones:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.- Restaurante:&lt;/strong&gt; se entiende por restaurante el establecimiento que ofrece, mediante un precio, consumo de comidas y bebidas, y que dispone de cocina debidamente equipada y de comedor independiente para su consumo. En el desarrollo de su actividad pueden ofrecer comidas o cenas, y también cualquier otro servicio que pueden prestar los bares cafetería.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.- Bar Cafetería: &lt;/strong&gt; se entiende por bar cafetería el establecimiento que, disponiendo de una cocina adecuada, ofrece mediante un precio todo tipo de bebidas y comidas en barra o mesas. Estos establecimientos deben poder suministrar a los clientes, en cualquier momento dentro de su horario de apertura, la totalidad de las comidas y bebidas que ofrezcan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.- Bar de copas: &lt;/strong&gt;son los establecimientos que sirven ininterrumpidamente durante su apertura, mediante precio, bebidas, sin disponer de servicio de comidas. Se deben entender incluidos en esta clasificación, a título orientativo, no exclusivo: los bares musicales/ pubs y los bares situados en discotecas, salas de fiesta o salas de baile.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.- Catering: &lt;/strong&gt;son los establecimientos que disponen de cocina adecuada y suministran alimentos mediante un precio para su consumo directo a un determinado número de clientes o consumidores en banquetes, convenciones, cócteles o acontecimientos similares, que no se dan de manera continuada y regular en el tiempo. Estas empresas deben disponer de la infraestructura necesaria para la preparación y distribución de alimentos y cumplir la normativa específica. También deben de disponer de seguro de responsabilidad civil que cubra los riesgos derivados de su actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.- Salas de fiesta: &lt;/strong&gt; son los establecimientos que ofrecen al público servicios consistentes en la presentación de espectáculos artísticos, de pequeño teatro, folclóricos, eróticos, coreográficos, humorísticos, audiovisuales, variedades, atracciones de cualquier tipo de escena o pista, baile público con participación de los asistentes, amenizados mediante la participación humana o medios mecánicos o electrónicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.- Salas de baile:&lt;/strong&gt; son los establecimientos que ofrecen servicio de baile público con participación de los asistentes, amenizado por participación humana o medios mecánicos o electrónicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.- Discotecas: &lt;/strong&gt;son los establecimientos que organizan baile público con participación de los asistentes, amenizado exclusivamente por medios mecánicos o electrónicos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.-Cafés concierto: &lt;/strong&gt;son los establecimientos que ofrecen al público intervenciones musicales mediante participación humana o medios mecánicos o electrónicos sin que haya participación del público ni ningún tipo de baile ni espectáculo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.-Café teatro: &lt;/strong&gt;se entiende por café-teatro el establecimiento que, disponiendo de una cocina adecuada, ofrece mediante un precio todo tipo de bebidas y comidas en barra o mesas. Estos establecimientos deben poder suministrar a los clientes, en cualquier momento dentro de su horario de apertura, la totalidad de las comidas y bebidas que ofrezcan, además de ofrecer al público representaciones teatrales o análogas, efectuadas por profesionales o bien por aficionados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.-Clubes de playa: &lt;/strong&gt;son los establecimientos que, situados en las inmediaciones del mar, ofrecen servicios de amenización, restauración, venta de productos, alquiler de tumbonas, así como otros servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.-Casinos de juego:&lt;/strong&gt; Tienen la consideración de casinos de juego los establecimientos que, reuniendo los requisitos exigidos, hayan sido autorizados para la práctica de los juegos que, en el Catálogo de Juegos y Apuestas de las Illes Balears, se recojan como «exclusivos de los casinos de juego», u otros que puedan autorizarse reglamentariamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12.-Salas de bingo:&lt;/strong&gt; Tienen la consideración de salas de bingo los establecimientos que hayan sido autorizados para la práctica del juego del bingo en sus distintas modalidades.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13.-Salones de juego: &lt;/strong&gt;Tienen la consideración de salones de juego aquellos establecimientos específicamente autorizados para instalar máquinas de tipo B. Asimismo, pueden practicarse, previa autorización, otros juegos de los incluidos en el Catálogo de Juegos y Apuestas de las Illes Balears que no sean exclusivos de otro tipo de establecimiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14.-Locales de apuestas:&lt;/strong&gt; Son aquellos establecimientos en los que se desarrolla una actividad de juego en la que se arriesgan cantidades de dinero sobre los resultados de un acontecimiento previamente determinado cuyo desenlace es incierto y ajeno a las personas participantes, y se determina la cuantía del premio que se otorga en función de las cantidades arriesgadas u otros factores fijados previamente en la regulación de la concreta modalidad de apuesta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15.-Cine:&lt;/strong&gt; Local o recinto de exhibición cinematográfica abierto al público mediante precio o contraprestación fijado por el derecho de asistencia a la proyección de películas determinadas, bien sea dicho local permanente o de temporada, y cualesquiera que sean su &lt;/span&gt;ubicación y titularidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16.-Gimnasio:&lt;/strong&gt; Local dotado de las instalaciones y los aparatos adecuados para hacer gimnasia y practicar ciertos deportes y/o artes marciales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19.-Espacios exteriores:&lt;/strong&gt; Aquellas zonas delimitadas, afectas a la actividad, de titularidad pública o privada, que están situadas al aire libre. También se incluyen bajo este concepto y a efectos de aplicación de esta Ordenanza los espacios próximos al establecimiento, públicos o privados (aunque no estén reflejados expresamente en el título habilitante), en los cuales la autoridad competente pueda constatar que la permanencia de personas está relacionada bien con el consumo en el propio establecimiento o bien con cualquier evento organizado por el mismo. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 2&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Grupos de Actividad&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;A efectos de esta Ordenanza se consideran los siguientes grupos de locales o actividades:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo II:&lt;/strong&gt; Bar de Copas, Café-Concierto, Café-Teatro, Cine y análogos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo III: &lt;/strong&gt;Bingos, salas de juego, de apuestas y otros análogos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo IV:&lt;/strong&gt; Discotecas, salas de baile, salas de fiesta y otros análogos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo V:&lt;/strong&gt; Club de Playa&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo VI:&lt;/strong&gt; Gimnasios y análogos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 3&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Horarios de apertura&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El horario de apertura de los establecimientos públicos y actividades recreativas será&lt;/span&gt;, durante todo el año, &lt;span style="color:#000000"&gt;el que se indica a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1) Grupo I &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Restaurantes, Bar, Bar-Cafeterías, Catering: &lt;/strong&gt;no&lt;span style="color:#000000"&gt; &lt;/span&gt;p&lt;span style="color:#000000"&gt;odrán abrir antes de las 07:00 horas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;No obstante, los establecimientos, que por necesidades del servicio, consideren indispensable abrir antes de 07:00 horas podrán solicitarlo mediante declaración responsable, en la cual se hará constar que: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Que se trata de un establecimiento en el que se ha ve&lt;/span&gt;nido &lt;span style="color:#000000"&gt;ofrec&lt;/span&gt;iendo servicio&lt;span style="color:#000000"&gt;, de manera habitual, a primera hora del d&lt;/span&gt;ía. Así mismo, se hará constar el horario de apertura, no pudiendo ser éste antes de las 6:00 horas. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Que el servicio en la terraza no comenzará antes de las 08:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Que, durante la apertura del establecimiento, el titular de la actividad se hace responsable del cumplimiento de los horarios de terraza establecidos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2) Grupo II &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Bar de Copas, Café-Concierto, Café-Teatro, Cine y análogos&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;:&lt;/strong&gt; no podrán abrir antes de las 10:00 horas, si bien la actividad musical no dará inicio antes de las 12:00 horas, siempre y cuando se disponga del correspondiente título habilitante, de acuerdo con la Ordenanza Municipal de Protección del Medio Ambiente Contra la Contaminación por Ruidos y Vibraciones vigente. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3) Grupo III &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Bingos, salas de juego, de apuestas y otros análogos&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;:&lt;/strong&gt; no podrán abrir antes de las 12:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4) Grupo IV &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Discotecas, salas de baile, salas de fiesta y otros análogos&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;: &lt;/strong&gt;no podrán abrir antes de las 18:00 horas. En el caso de organización de galas juveniles, se permitirá la apertura de estos establecimientos entre las 17:00 y las 22:00 horas, con las limitaciones de admisión, consumo y servicio de bebidas, establecidas por la legislación vigente para menores. En estos casos, deberán transcurrir, al menos 2 horas, desde la conclusión de la gala juvenil al inicio normal de la actividad, dentro del horario permitido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5) Grupo V&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;Club de Playa&lt;strong&gt;:&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt; &lt;/strong&gt;no podrán abrir antes de las 10:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6) Grupo VI &lt;/strong&gt;&lt;/span&gt;Gimnasios y análogos&lt;span style="color:#000000"&gt;&lt;strong&gt;: &lt;/strong&gt;no podrán abrir antes de las 07:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 4&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Horarios de cierre&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.-&lt;/strong&gt; El horario de cierre de los establecimientos públicos y actividades recreativas será, &lt;/span&gt;durante todo el año el que se indica a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1) Grupo I &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt; Restaurantes, Bar, Bar-Cafeterías, Catering&lt;/strong&gt;&lt;span style="color:#000000"&gt;: cerrarán, como máximo, a las 02:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2) Grupo II &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Bar de Copas, Café-Concierto, Café-Teatro, Cine y análogo&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;:&lt;/strong&gt; cerrarán, como máximo, a las 04:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3) Grupo III&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt; Bingos, salas de juego, de apuestas y otros análogos&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;:&lt;/strong&gt; cerrarán, como máximo, a las 04:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4) Grupo IV &lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;Discotecas, salas de baile, salas de fiesta y otros análogos&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;:&lt;/strong&gt; cerrarán, como máximo, a las 06:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5) Grupo V Club de Playa:&lt;/strong&gt; cerrarán, como máximo, a las 23:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6) Grupo VI Gimnasios y análogos:&lt;/strong&gt; cerrarán, como máximo, a las 23:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2&lt;/strong&gt;.- Ejecución del cierre: Conforme a lo establecido en el artículo 25.4 de Ley 7/2013, de 26 de noviembre, de régimen de instalación, acceso y ejercicio de actividades en las Illes Balears,, a partir de la hora de cierre, las personas titulares o promotoras de las actividades de espectáculos públicos, recreativas y de establecimientos públicos deben cumplir las siguientes obligaciones: (FALTA PONER ART)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Dejar de servir bebidas y otros servicios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Parar la música. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Impedir la entrada de usuarios. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Pedir a los usuarios que abandonen el establecimiento en un plazo razonable que en ningún caso podrá ser superior a veinte minutos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Dejar de ejecutar cualquier espectáculo, juego o similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Encender la iluminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 5&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Horarios especiales para locales con licencias multidisciplinares&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En el caso que se disponga de título habilitante incluido en el Grupo I junto a cualquiera de los grupos restantes (actividad multidisciplinar), el establecimiento no podrá abrir antes de haber transcurrido más de 4 horas desde el cierre y no podrá ejercer la actividad musical, si tuviera autorización, hasta las 12:00 de la mañana. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 6&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Terrazas y Espacios Exteriores&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1&lt;/strong&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;.-&lt;/strong&gt; Los locales que cuenten con terraza tanto pública como privada en la que su uso esté previsto y autorizado, deberán cesar la actividad total en la terraza a la&lt;/span&gt; misma hora estipulada para el establecimiento&lt;span style="color:#000000"&gt;. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Sin embargo, los establecimientos &lt;/span&gt;con&lt;span style="color:#000000"&gt; título habilitante d&lt;/span&gt;e &lt;span style="color:#000000"&gt;actividad musical en terraza, harán cesar la dicha actividad e&lt;/span&gt;n ésta a las 24:00 horas, quedando la actividad musical de forma exclusiva en el interior del local, a efectos de &lt;span style="color:#000000"&gt;cumplimiento de la Ordenanza Municipal de Protección del Medio Ambiente Contra la Contaminación por Ruidos y Vibraciones vigente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.-&lt;/strong&gt; El &lt;/span&gt;t&lt;span style="color:#000000"&gt;itular de la actividad será &lt;/span&gt;responsable de velar por la seguridad, salubridad e higiene de las inmediaciones del establecimiento, siendo a su vez responsable de hacer cumplir con la prohibición de la utilización de vasos, copas o análogos recipientes de cristal, fuera de las mismas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.-&lt;/strong&gt; El titular de la a&lt;/span&gt;ctividad será responsable del correcto cierre de &lt;span style="color:#000000"&gt;la terraza&lt;/span&gt;, la cual deberá ser&lt;span style="color:#000000"&gt; completamente recogida, qu&lt;/span&gt;edando el mobiliario asegurado y/o recogido, así como&lt;span style="color:#000000"&gt; despejad&lt;/span&gt;o&lt;span style="color:#000000"&gt; de clientes&lt;/span&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 7&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Fiestas populares, Ferias, Navidad, Fin de Año, Semana Santa y otros eventos de interés general&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El Alcal&lt;/span&gt;de/esa, en relación a las fiestas populares de este municipio, y sin perjuicio de lo regulado respecto a horarios en los artículos 2, 3, 4 y 5 de la presente Ordenanza, podrá autorizar horarios especiales para la celebración de las mencionadas festividades. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La autorización de estos horarios especiales se llevará a cabo mediante Decreto de Alcaldía, en el cual se indicarán las condiciones a seguir por parte de los establecimientos que deseen acogerse al mismo, pudiendo ser denegada la mencionada autorización en caso de incumplimiento de los condicionantes que se estipulen. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 8&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Zonas de protección especial&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt; acústico-ambiental&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.- &lt;/strong&gt;Que, acogiéndose a la Ordenanza Municipal de Ruido y Vibraciones, la administración local, podrá declarar de oficio o a instancia de parte, zonas de especial protección, cuya consecuencia será la repercusión en el horario de apertura y cierre de los locales que se encuentren en dicha zona.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;E&lt;/span&gt;n tal caso, &lt;span style="color:#000000"&gt;dicha zona se convertiría por su geolocalización en una zona de residencia de &lt;/span&gt;protección&lt;span style="color:#000000"&gt; especial dadas la características de la zona en cuestión, los horarios de cierre serán los que a continuación se detallan para los &lt;/span&gt;Grupos II, III y IV, no viéndose afectados el resto de Grupos&lt;span style="color:#000000"&gt;:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo II Bar de Copas, Café-Concierto, Café-Teatro, Cine y análogos:&lt;/strong&gt; La apertura no sufre variación, siendo el cierre a las 02:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo III Bingos, salas de juego, de apuestas y otros análogos:&lt;/strong&gt; La apertura no sufre variación, siendo el cierre a las 02:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Grupo IV Discotecas, salas de baile, salas de fiesta y otros análogos:&lt;/strong&gt; La apertura no sufre variación, siendo el cierre a las 02:00 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.- &lt;/strong&gt;Que, &lt;/span&gt;habiendo declarado la zona de especial protección, los horarios establecidos anteriormente podrán ser revisados de oficio o a instancia de parte, a efectos de cumplimiento de calidad acústica, por parte de los inspectores sonométricos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 9&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Actividades artísticas en la vía pública&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.-&lt;/strong&gt; Las actuaciones de carácter artístico, no comerciales, tanto de forma individualizada como en grupo estarán sujetas a autorización municipal previa, entendiendo como aquellas las que se detallan a continuación, sin que en ningún caso puedan colocar mesas o puestos fijos: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Actividades musicales, batucada, danza, espectáculo con marionetas, actividades circenses (malabares, payasos, trapecistas, etc…), pintores y caricaturistas (en lienzos, papel, cartón, cartulinas) con venta de productos realizadas exclusivamente por el propio artista maquillaje (artístico, infantil, adultos, etc.), trenzas de cabello realizadas por el propio artista, estatuas humanas, venta de globos de forma itinerante &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.-&lt;/strong&gt; La solicitud&lt;span style="color:#000000"&gt; deberá presentarse de forma telemática mediante la sede electrónica de este Ayuntamiento (Seu Electrònica de Andratx (sedelectronica.es)) o de forma presencial en las Dependencias municipales, con al menos 15 (quince) días previos a llevar a cabo la actuación, debiendo la misma contener la siguiente documentación: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Fotocopia del DNI, NIE, o pasaporte.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Certificado de empadronamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Fotografía tamaño carnet.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Características de la actividad artística a desarrollar (Anexo 4).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Declaración responsable de su actividad. (Anexo 2)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.-&lt;/strong&gt; &lt;span style="color:#000000"&gt;Las autorizaciones para la realización de actividades artísticas en la vía pública estarán sujetas a las tasas previstas en las Ordenanzas Fiscales vigentes.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4.-&lt;/strong&gt; Las solicitudes de licencia de ocupación de vía pública que se hayan presentado fuera del plazo establecido, no serán admitidas a trámite. &lt;span style="color:#c9211e"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;​​​​​​​&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5.-&lt;/strong&gt; Si una vez transcurrido el plazo de quince días desde la presentación de la solicitud no se ha dictado y notificado la resolución, ésta debe entenderse desestimada. En ningún caso las solicitudes supondrán la concesión de la licencia automáticamente. &lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#c9211e"&gt; &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.- &lt;/strong&gt;En el caso de prórroga de la licencia anual para la realización de actividades artísticas en la calle, se podrá obtener la licencia mediante declaración responsable de la persona, mientras no varíe la normativa reguladora. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.- &lt;/strong&gt;En todos los casos el Ayuntamiento se reserva la facultad para modificar, revocar, suspender temporalmente o denegar las licencias sin derecho a ninguna compensación, excepto la devolución de la parte proporcional de las tasas si corresponder, por motivos de interés público, que impidan la utilización del dominio de actividades de mayor interés público, para la realización de actos públicos o institucionales, seguridad, obras, ordenación del espacio urbano o del tráfico o cualquier otra causa justificada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Además, s&lt;/span&gt;e podrán revocar las licencias en los supuestos que a continuación se indican, con pérdida del importe ingresado en concepto de tasas y sin derecho a indemnización, así como la inhabilitación para obtener futuras licencias durante el plazo legalmente establecido previa instrucción del correspondiente expediente de revocación de licencia. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Por incumplimiento manifiesto y reiterativo de las condiciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Por producción de molestias a terceros acreditadas en el expediente, a consecuencia de la transmisión de ruidos y vibraciones superiores a los niveles legalmente permitidos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Cuando se realice una actividad diferente de la autorizada.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.-&lt;/strong&gt; &lt;span style="color:#000000"&gt;Las zonas en las que se realicen dichas actividades artísticas nunca podrán obstaculizar salidas de viviendas, locales, salidas de emergencia o vehículos, así como siempre dejar el paso suficiente a los transeúntes por las aceras. En las calles de uso peatonal, siempre se dejará espacio para el uso de los vehículos de emergencia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.- &lt;/strong&gt;Los horarios de dichas actividades serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Áreas delimitadas en la Ordenanza de Ruidos y Vibraciones vigente como zonas recreativas: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Músicos y espectáculos: De 19:00 horas a 23:30 horas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Pintores y estatuas: De 10 horas a 21.40 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Zonas de protección especial, delimitada en la Ordenanza de Ruidos y Vibraciones vigente: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Músicos y espectáculos: De 19:00 horas a 22:30 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Pintores y estatuas: De 10 horas a 21.40 horas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10.- &lt;/strong&gt;Las condiciones que han de cumplir son:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Un amplificador autónomo y nunca podrán superar la potencia máxima de 20 W.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) No se podrán utilizar instrumentos que por sus características sonoras puedan ocasionar molestias, especialmente trompetas sin silenciador y percusión con piel de timbal. Los platillos y baquetas de la batería se adaptarán para la vía pública, y así evitar las molestias acústicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) En caso de queja vecinal por exceso de ruido la Policía Local podrá desplazar la actividad a los efectos de evitar dichas molestias.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Durante la realización de la actividad artística en la vía pública, deberá constar en lugar visible la tarjeta de identificación artística. Además deberá contener&lt;/span&gt; el número de licencia, la tipología de la actividad, los datos del artista y la duración del permiso (anual o temporada). &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;e) &lt;/span&gt;Pintores, caricaturistas y estatuas no pueden acompañar su actividad con ningún tipo de música &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11.-&lt;/strong&gt; Serán responsables de las infracciones cometidas en materia de ocupación de la vía pública, los y las responsables de la actividad realizada. En el caso de incumplimiento de las prescripciones de una licencia, será responsable su titular. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12.- &lt;/strong&gt;Estará completamente prohibido:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a. Deteriorar el espacio público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b. Situarse fuera del espacio autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c. Excederse en el horario autorizado para la actividad y ubicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d. Excederse en el número de integrantes según el espacio autorizado.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e. Hacer reservas de espacios.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f. En ningún caso se podrá dificultar el transito de peatones y el de los servicios de limpieza, de urgencia o seguridad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;g. Situarse interfiriendo la visibilidad y la entrada de monumentos, edificios históricos o bienes de interés cultural.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;h. Pedir donaciones fuera del espacio donde se realiza la actividad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;div style="page-break-after:always"&gt;&lt;span style="display:none"&gt;&amp;nbsp;&lt;/span&gt;&lt;/div&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;​​​​​​​&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;i. Las actividades de los y las artistas tienen que ser respetuosas y por eso no se permiten actuaciones que puedan herir la sensibilidad de la ciudadanía ni su dignidad, despreciando personas o colectivos por razón de origen, etnia, género o religión o se puedan interpretar como un delito de odio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;j. En aplicación del arte. 232 de la Ley Orgánica 10/1995, de 23 de noviembre, del Código penal, llevar a cabo actividades o espectáculos que utilicen o presten menores de edad o personas con discapacidad necesitadas de especial protección para la práctica de la mendicidad, aunque sea por vía encubierta. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 10&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;Infracciones y sanciones &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.-&lt;/strong&gt; Los tipos de infracciones y las sanciones, serán los recogidos en la normativa reguladora de actividades autonómica vigente, así como en relación al procedimiento se atenderá a lo dispuesto en el Decreto 14/1994 de 10 de&lt;/span&gt; febrero, por el que se aprueba el Reglamento del procedimiento a seguir en el ejercicio de la potestad sancionadora.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2.- &lt;/strong&gt;Además de lo establecido anteriormente, se establecen como infracciones leves según lo dispuesto en la normativa reguladora de actividades autonómica vigente, los tipos siguientes: &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) El incumplimiento del horario estipulado específicamente para los locales con licencia multidisciplinar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) No velar por la seguridad, salubridad e higiene en las inmediaciones del establecimiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Incumplimiento del deber de hacer cumplir la prohibición de utilización de vasos, copas o análogos recipientes de cristal fuera de las inmediaciones del establecimiento. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Incumplimiento de cualquiera de las condiciones de lo estipulado en el artículo 9 de la presente ordenanza. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Incumplimiento de cualquiera de las condiciones de lo estipulado en el artículo 10 de la presente ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Artículo 11&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px; width:100%"&gt; &lt;/span&gt;​​​​​​​Restablecimiento de la legalidad infringida y de la realidad física alterada&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Las legalizaciones y los procedimientos de restablecimiento de la legalidad infringida y de la realidad física alterada se realizarán de acuerdo con la normativa reguladora de actividades autonómica vigente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición Derogatoria &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Queda derogada la &lt;/span&gt;Ordenanza municipal reguladora de los horarios de establecimientos y espectáculos públicos y actividades recreativas, aprobada mediante acuerdo de Pleno en fecha de 26 de mayo de 2016&lt;span style="color:#000000"&gt;, así como las normas u otras disposiciones en todo lo que se oponga, contradiga o resulte incompatible con el que con mayor exigencia se establece en esta ordenanza. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición final primera&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presente Ordenanza entrará en vigor una vez cumplimentados los trámites previstos en la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Disposición final segunda&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;La Alcaldía-Presidencia, en el ejercicio de sus competencias podrá interpretar, aclarar y desarrollar los artículos de la presente Ordenanza.”&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SEGUNDO.- CONCEDER&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; un trámite de información pública y audiencia, por un plazo de treinta y cinco días, a efectos de que las personas interesadas, &lt;/span&gt;&lt;span style="color:#000000"&gt;pueden examinar el expediente y formular reclamaciones, reparos u observaciones. Así mismo, se advierte que de no formularse ninguna reclamación o sugerencia, el acuerdo inicialmente adoptado se entenderá aprobado definitivamente. Todo ello en virtud del artículo 102 del la &lt;/span&gt;&lt;span style="color:#000000"&gt;Ley 20/2006. de 15 de diciembre, municipal y de régimen local de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;TERCERO.- CONCEDER&lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt; un trámite de a&lt;/span&gt;&lt;span style="color:#000000"&gt;udiencia previa a las asociaciones vecinales y de defensa de las personas consumidoras y usuarias establecidas en su ámbito territorial que estén inscritas en el registro municipal de asociaciones vecinales y cuyos fines guarden relación directa con el objeto de la disposición.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;CUARTO.- &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;SOLICITAR &lt;/strong&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;informe al Instituto Balear de la Mujer, sobre el impacto de género del presente acuerdo de modificación de la Ordenanza Municipal Reguladora de Actividades Recreativas, Artísticas, Establecimientos y Espectáculos Públicos, de sus horarios y su actividad tanto en zona privada como pública, del Ayuntamiento de Andratx, mediante el cual se deberá indicar le impacto potencial de dicha modificación en relación a la situación de mujeres y hombres como colectivo, y las posibles repercusiones en materia de igualdad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Lo que se hace público, para general conocimiento y efectos oportunos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
