CAIB 9808 ![CDATA[Resolución del director-gerente de Servicios Ferroviarios de Mallorca de adjudicación de los puestos de trabajo del concurso de traslados derivado de la OPO 2019 y 2020 de Servicios Ferroviarios de Mallorca]] 2024-02-29 text/html 2024-02-26 120961 160 9809 ![CDATA[<p><strong>Hechos</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. En fecha 23 de diciembre de 2019 se acordó con el Comité de Empresa la oferta pública de empleo del año 2019 y 2020, así como la convocatoria de las plazas incluidas en estos procesos, una vez finalizado el concurso de traslados.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. El concurso de traslados acordado con el Comité de Empresa en fecha 23 de diciembre de 2019 incluía un total de diecisiete plazas de las categorías profesionales según el convenio colectivo de Servicios Ferroviarios de Mallorca (de ahora en adelante, SFM), de maquinista principal y gestores estaciones/factor de circulación; concretamente, siete plazas de maquinista principal (una plaza con residencia laboral en Inca y seis plazas con residencia laboral en Manacor) y diez plazas de gestor de circulación (seis con residencia laboral en Palma, una plaza en Inca y dos plazas en Manacor).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En este acuerdo se estableció que las plazas del concurso de traslados se harían efectivas en función de las necesidades del servicio, y en cualquier caso, una vez finalizados los procesos derivados de la OPO 2019 y 2020.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. El 17 de febrero de 2022 se publicó en el </span><em>Boletín Oficial de las Illes Balears</em><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> n.º 26 la resolución del director-gerente de Servicios Ferroviarios de Mallorca por la que se hace pública la convocatoria del concurso de traslados para el personal laboral de Servicios Ferroviarios de Mallorca.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. Los días 16 y 24 de marzo de 2022, la Comisión Técnica de Valoración publicó en el Portal del Empleado la propuesta provisional de adjudicación de los puestos de trabajo objeto de la convocatoria a efectos de formular observaciones y reclamaciones en el plazo de tres días hábiles.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. Los días 16 y 31 de marzo de 2022, la Comisión Técnica de Valoración elevó a definitiva la propuesta de adjudicación de los puestos de trabajo y se dio a esta propuesta definitiva la misma publicidad que a la propuesta provisional.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Así mismo, esta Comisión remite la lista definitiva de adjudicación de puestos de trabajo a la Dirección y Gerencia de Servicios Ferroviarios de Mallorca para que dicte la resolución correspondiente según establecen las bases del concurso de traslados en el punto 8.5.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">6. De acuerdo con el punto 9º de las bases, en lo referente a la adjudicación de destinos, se tenía que hacer efectivo en el plazo de veinte días hábiles desde que se dicta la resolución por parte del órgano competente de Servicios Ferroviarios de Mallorca; si bien, en caso de que las circunstancias del servicio lo aconsejen, por razones debidamente justificadas, el órgano competente se podrá reservar la facultad de posponer el traslado del trabajador que haya obtenido un nuevo destino, hasta el momento en que quede asegurada la prestación de servicio en los destinos afectados.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">7. El Consejo de Administración, en la sesión del día 27 de abril de 2022, aprobó la adjudicación de los nuevos destinos, si bien, según el informe del Departamento de Operaciones de 5 de agosto de 2022, se justifican las necesidades del servicio en virtud del punto 9.2 de las bases del concurso de traslados y por ello se pospone el cambio efectivo de determinadas plazas de este proceso hasta la resolución de las plazas de turno libre y promoción interna de la OPO 2019 y 2020.</span></p> <p><strong>Fundamentos de derecho</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. La Resolución del director-gerente de Servicios Ferroviarios de Mallorca de 14 de febrero de 2022 por la que se hace pública la convocatoria del concurso de traslados para el personal laboral de la entidad (BOIB n.º 26, de 17 de febrero de 2022).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Las actas de la Comisión Técnica de Valoración de 16 y 31 de marzo de 2022.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. El informe del Departamento de Explotación del día 5 de agosto de 2022.</span></p> <p style="text-align:center"><strong>Resolución</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Adjudicar los nuevos destinos resultantes de la ejecución del concurso de traslados del personal fijo de SFM derivado de la oferta de ocupación de 2019 y 2020, según el anexo.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. La toma de posesión se efectuará en el plazo de tres días hábiles, a partir del día siguiente al de la publicación de esta Resolución en el </span><em>Boletín Oficial de las Illes Balears.</em></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Comunicar esta Resolución a las personas interesadas.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4.
