    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;La Junta de Gobierno de Palma en sesión ordinaria de día 21 de febrero de 2024 ha adoptado el siguiente acuerdo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;1. Aprobar el Plan Normativo Municipal 2024 con las siguientes iniciativas reglamentarias:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ÁREA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Área de Turismo, Cultura, Deportes, Restauración y Coordinación Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;​​​​​​​&lt;/span&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;INICIATIVA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobación del Reglamento del Servicio Municipal de Actividades y Servicios Deportivos del Ayuntamiento de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SITUACIÓN ACTUAL:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; No existe ningún reglamento de actividades y servicios deportivos aprobado en el Ayuntamiento de Palma.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;De acuerdo con el artículo 85.2 de la Ley 7/1985, de bases de régimen local, la gestión se lleva a cabo mediante el Instituto Municipal de Deportes del Ayuntamiento de Palma. Éste realizará su gestión con sus propios medios, ocasionalmente contratará determinadas actividades de acuerdo con los Estatutos que lo regule.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;Este Reglamento tiene por objeto regular las competencias, organización y funcionamiento así como describir las prestaciones que ofrece el Servicio Municipal de Actividades y Servicios Deportivos con el fin de mejorar la atención y adecuarla a las necesidades de sus usuarios y de la ciudadanía por lo general. Asimismo, tiene por objeto facilitar la convivencia así como favorecer la participación y el fomento del deporte de todos los colectivos de la comunidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;MOTIVACIÓN:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De acuerdo con el artículo 312 de la Ley 9/2017 de contratos del sector público, los contratos de servicios que comporten prestaciones directas a favor de la ciudadanía, y que en este caso se realizan mediante el Instituto Municipal de Deportes del Ayuntamiento de Palma, se deberá cumplir la siguiente prescripción: “a) Antes de proceder a la contratación de un servicio de esta naturaleza se debe haber establecido su régimen jurídico, que declare expresamente que la actividad de que se trata queda asumida por la administración respectiva, como propia de la misma, determine el alcance de las prestaciones a favor de los administrados y regule los aspectos de carácter jurídico, económico y administrativo relativos a la prestación de servicio”.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESPONSABLE:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El Área de Turismo, Cultura, Deportes, Restauración y Coordinación Municipal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ÁREA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt; Área de Infraestructuras, Accesibilidad y Polígonos Industriales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;INICIATIVA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Nueva Ordenanza Municipal de Obras en &lt;/span&gt;&lt;u&gt;&lt;span style="background-color:null"&gt;S&lt;/span&gt;&lt;/u&gt;&lt;span style="background-color:null"&gt;uelo Público Municipal y de Ocupación de la Vía Pública por Obras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SITUACIÓN ACTUAL:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Vigente la Ordenanza de Instalación de Conducciones de Servicios en la Vía y Espacios Públicos en Suelo Urbano, BOCAIB núm. 88 de 20 de julio de 1990. En preparación el borrador de la nueva ordenanza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;MOTIVACIÓN:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Esta Ordenanza surge de la necesidad de actualizar la normativa vigente y de integrar en un solo texto los criterios que se están aplicando de conformidad con las diferentes resoluciones y/o directrices que se han dictado en los últimos años con el única finalidad de otorgarle un carácter normativo que permita actuar de forma coherente y con la seguridad jurídica necesaria para la regulación de la materia de la que es objeto.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESPONSABLE:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Área de Infraestructuras, Accesibilidad y Polígonos Industriales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;ÁREA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt; Área delegada de Seguridad Ciudadana y Civismo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;INICIATIVA:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobación de la Ordenanza Municipal para el Fomento de la Convivencia Cívica en Palma&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SITUACIÓN ACTUAL: &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Actualmente esta materia se regula mediante la Ordenanza Municipal Reguladora del Uso Cívico de los Espacios Públicos de Palma, aprobada en sesión plenaria del Ayuntamiento de Palma de día 28 de febrero de 2011, así como su modificación aprobada en sesión plenaria de día 26 de julio de 2018. Desde la última modificación hasta la actualidad se han revisado aspectos que deben adecuarse normativamente, así como nuevas situaciones que deben regularse para poder garantizar un clima de civismo, de convivencia social y respeto mutuo entre la ciudadanía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;RESPONSABLE:&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Área delegada de Seguridad Ciudadana y Civismo&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#202124"&gt;&lt;span style="background-color:null"&gt;2. Publicar el acuerdo en el Portal de Transparencia y en el BOIB.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
