    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:null"&gt;De acuerdo con el que dispone la legislación vigente, se hace público que mediante el Decreto de Batlia n.º 2024-0348, de día 14 de febrero de 2024, se ha aprobado la actuación administrativa automatizada, sello de órgano y CSV, que se señala a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;“&lt;strong&gt;ASUNTO: actuación administrativa automatizada, sellos de órgano y CSV.&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta Resolución tiene por objeto la aprobación de nuevas aplicaciones por la actuación administrativa automatizada al ámbito del Ayuntamiento de Alcúdia y regularizar las ya operativas con el fin de optimizar la utilización de los recursos humanos y materiales disponibles para la ejecución de las actuaciones de secretaria, gestión tributaria y recaudación, aprovechando las ventajas de desarrollo de las tecnologías e incorporándolas para una mayor eficacia en su actuación y en una mejora del servicio al ciudadano.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Dado que el artículo 13 del Reglamento de actuación y funcionamiento del sector público por medios electrónicos, aprobado por el Real Decreto 203/2021, de 30 de marzo, dispone que la tramitación electrónica de una actuación administrativa podrá llevarse a cabo, entre otras formas, de manera automatizada en conformidad con lo establecido en el artículo 41 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, establece en el artículo 41 que en caso de actuación administrativa automatizada se tendrá que establecer previamente el órgano o órganos competentes, según los casos, para la definición de las especificaciones, programación, mantenimiento, supervisión y control de calidad y, si procede, auditoría del sistema de información y del código fuente. Así mismo, se tiene que indicar el órgano que se tiene que considerar responsable a efectos de impugnación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por otro lado, el artículo 85.1 del Reglamento General de las Actuaciones y los procedimientos de Gestión e inspección tributaria y de desarrollo de las normas comunes de los procedimientos de aplicación de los tributos, aprobado por el Real Decreto 1065/2007, de 27 de julio, exige que, en los supuestos de actuación automatizada, las aplicaciones informáticas que efectúen tratamientos de información el resultado de los cuales sea utilizado por la Administración tributaria para el ejercicio de las potestades y por las cuales se determine directamente el contenido de las actuaciones administrativas, tendrán que ser previamente aprobadas mediante resolución del órgano que tiene que ser considerado responsable a efectos de la impugnación de los correspondientes actos administrativos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;El artículo 42 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público indica que, en el ejercicio de la competencia de la actuación administrativa automatizada, cada Administración Pública podrá determinar los supuestos de utilización de sello electrónico, fundamentado en certificado electrónico reconocido o cualificado que reúna los requisitos exigidos por la legislación de firma electrónica.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Así el certificado de sello electrónico no solo sirve para la identificación electrónica de la Administración Pública titular o de aquellos de sus órganos por los cuales se dispone su creación, sino que es uno de los sistemas de firma electrónica reconocido por el artículo 42 de la Ley 40/2015 en el ejercicio de una competencia en las actuaciones administrativas automatizadas así como en el artículo 20 del Reglamento de actuación y funcionamiento del sector público por medios electrónicos, aprobado por el Real Decreto 203/2021, de 30 de marzo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Junto con el sello electrónico, los mismos preceptos disponen de un segundo sistema de firma electrónica de este tipo de actuaciones, llamado código seguro de verificación (CSV) vinculado a la Administración Pública, en los términos y condiciones establecidos, permitiéndose en todo caso la comprobación de la integridad del documento mediante el acceso a la sede electrónica,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Por todo lo expuesto, y en conformidad con el establecido en los artículos 41 de la Ley 40/2015 y 13 del Reglamento de actuación y funcionamiento del sector público por medios electrónicos, aprobado por el Real Decreto 203/2021, de 30 de marzo y del artículo 21.1.a) y s) de la Ley 7/1985, de 2 de abril, reguladora de las bases de régimen local,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Vista la propuesta de resolución PR/2024/657 de 13 / de febrero / 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Conforme las atribuciones que me confiere el artículo 21 de la Ley 7/85, de 2 de abril, Reguladora de las Bases de Régimen Local, dicto la siguiente&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;RESOLUCIÓN&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;PRIMERO&lt;/strong&gt;.- Aprobar, en el ejercicio de la competencia en la actuación administrativa automatizada del Ayuntamiento de Alcúdia, la utilización, como sistema de firma electrónica, los sellos de órgano o el código seguro de verificación (CSV) en las siguientes actuaciones administrativas automatizadas, correspondientes al área de secretaría, gestión tributaria y recaudación municipal:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sello de órgano Ayuntamiento de Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:null"&gt;Con carácter general: todas las actuaciones y procedimientos que se vayan incorporando, con carácter automatizado, a la Plataforma de Tramitación Electrónica del Ayuntamiento de Alcúdia o su sede electrónica que estará disponible a https://alcudia.eadministracio.cat.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Con carácter específico:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Expedición automática de recibos de presentación en el registro electrónico del Ayuntamiento.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Foliado automático de expedientes electrónicos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Emisión automática de copias auténticas de documentos electrónicos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Digitalizaciones telemáticas con Sede Electrónica y Notific@.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Actos automáticos de comunicación con la ciudadanía&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Asignación del número de Decreto de Batlia e inclusión en el libro electrónico de Decretos, previa «validación» por parte del secretario de la Corporación y de la firma del decreto por la autoridad competente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Expedición de certificados y volantes de empadronamiento&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Certificados automáticos y evidencias de actuaciones dentro de expedientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Certificado exposición pública tablero anuncios&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificando de notificación telemática&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificando registro salida&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;- Justificantes de operaciones con integraciones (INSIDE, PLACE, PID,..)&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sello de órgano de Tesorería&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Aprobación de liquidaciones y envío en el libro de actuaciones automatizadas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Inicio procedimiento de constreñimiento de liquidaciones pendientes de cobro.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Certificado estar al corriente con obligaciones tributarias con el Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;SEGUNDO&lt;/strong&gt;. - Los órganos competentes en relación con las actuaciones automatizadas son los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Para la definición de las especificaciones o detalle del procedimiento de creación y emisión del certificado: Secretaría del Ayuntamiento de Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Para el diseño informático, programación y mantenimiento y auditoría del sistema de información y código fuente: Departamento de Informática del Ayuntamiento de Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Para la supervisión y control de calidad: Secretaría del Ayuntamiento de Alcúdia.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;strong&gt;TERCERO&lt;/strong&gt;.- Crear los Sello de órgano del Ayuntamiento de Alcúdia con las siguientes características:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sello de órgano Ayuntamiento de Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Nombre: Sello Ayuntamiento Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;La responsabilidad de la utilización a efectos de impugnación corresponde en el Ayuntamiento de Alcúdia&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Las características técnicas generales del sistema de firma y certificado son las siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:80px"&gt;&lt;span style="color:null"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;61921de5ae9b9e6d624e88573699e233&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
