CM-109, y solicitud de la declaración de ocupación urgente de los bienes y derechos relativos a la expropiación que deriva del mismo]] CAIB CAIB es 8458 2024-02-20 ![CDATA[<p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">En fecha 29-01-2024, el consejero ejecutivo de Territorio, Movilidad e Infraestructuras adoptó la resolución que se transcribe a continuación:</span></p> <p><strong><span style="line-height:115%">«Resolución del consejero ejecutivo de Territorio, Movilidad e Infraestructuras mediante la cual se aprueba la Relación definitiva de bienes y derechos afectados por las obras correspondientes al proyecto: “Proyecto constructivo de mejora de la carretera Ma-5120 entre el PK 10+700 y 11+400”. Término municipal Felanitx</span></strong><strong><span style="line-height:115%">. Exp. </span></strong><strong><span style="line-height:115%">CM-109</span></strong><strong><span style="line-height:115%">, y se solicita la declaración de ocupación urgente de los bienes y derechos relativos a la expropiación que deriva del mismo.</span></strong></p> <p><strong><span style="line-height:115%">Hechos y antecedentes</span></strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">1. Mediante Acuerdo del Consejo Ejecutivo de 25-10-2023 se aprobó definitivamente el proyecto de referencia. Este Acuerdo se publicó en el BOIB núm. 149, de 02-11-2023.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. Día 06-11-2023 el ingeniero autor del proyecto emitió Informe justificativo de la necesidad de ocupación urgente de los bienes y derechos afectados para la expropiación derivada de este proyecto.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">3. Mediante Resolución del consejero ejecutivo de Territorio, Movilidad e Infraestructuras de 17-11-2023, se ordenó iniciar el procedimiento de expropiación forzosa y, si procede, por la vía urgente, para la adquisición de los bienes y derechos necesarios para ejecutar este proyecto.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. La relación de bienes y derechos afectados por esta obra se han expuesto al público durante un periodo de quince días, conforme a lo que se establece en los artículos 18 y siguientes de la Ley de expropiación forzosa y en el artículo 17 del Reglamento de la Ley de expropiación forzosa, para que todas las personas interesadas puedan formular las alegaciones que consideren oportunas, y a los efectos previstos en el artículo 56.1 del Reglamento de la Ley de expropiación forzosa relativos a la ocupación urgente.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El trámite de información pública citado se ha realizado mediante la inserción del anuncio correspondiente en el BOIB núm. 168, de día 12-12-2023, en el diario Última Hora de día 12-12-2023, en el tablón de anuncios de la Sede electrónica del Consejo Insular de Mallorca y en el tablón de anuncios del Ayuntamiento de Felanitx. El plazo para presentar alegaciones ha sido el comprendido entre día 13-12-2023 y día 05-01-2024. No obstante, el anuncio ha sido expuesto en el tablón de anuncios de la Sede electrónica del Consejo Insular de Mallorca hasta día 15-01-2024.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. Que, consultado el Registro General del Consejo Insular de Mallorca, en el plazo de exposición pública no se han presentado alegaciones.</span></p> <p> </p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><span style="line-height:115%">6. En fecha 09-01-2024, el Ayuntamiento de Felanitx comunicó que los terrenos que conforman la Finca 13 son de Rafael Rosselló Adrover y que los terrenos que conforman la Finca 22 son de titularidad municipal. Por consiguiente, de acuerdo con esta información, se han rectificado los datos de estas dos fincas en la Relación de bienes y derechos afectados que ahora se aprueba, respecto de la que fue expuesta al público.</span></span></span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">7.
