&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;&lt;strong&gt;1. &lt;/strong&gt;A raíz de la aprobación de la Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las Illes Balears, la fórmula de la acción concertada, como figura de colaboración entre el sector público y el privado, se postula como la más adecuada a los principios que deben regir el sistema de servicios sociales. Así pues, en el artículo 2 de la citada Ley, se prevé que las administraciones competentes de las Illes Balears, para complementar el sistema público y garantizar una adecuada equidad y calidad de las prestaciones incluidas en la cartera de servicios o del servicio de orientación profesional, pueden encargar la prestación de estos servicios de su competencia, mediante el sistema de acción concertada, a entidades sin ánimo de lucro del tercer sector social, tal y como se definen en los artículos 3 y 4 de la Ley 3 /2018, de 29 de mayo, del tercer sector de acción social, o en su caso, a entidades privadas, preferentemente del tercer sector social, cuando existan análogas condiciones de eficacia, calidad y costes, de acuerdo con los requisitos que establece esta Ley y con respeto a los principios de publicidad, transparencia y no discriminación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;&lt;span style="background-color:#ffffff"&gt;2. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:#ffffff"&gt;Desde las Direcciones Insulares de Centros y Programas de Atención Integral a la Infancia y Adolescencia y la Dirección Insular de Personas con Discapacidad, se han emitido en fecha de 15 y &lt;/span&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="background-color:#ffffff"&gt;15 de febrero de 2024 los respectivos informes, por los que, según las necesidades actuales, indican los conciertos sociales que convocarán durante el año 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cuanto a la competencia,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1.&lt;/strong&gt; La Ley orgánica 1/2007, de 28 de febrero, de reforma del Estatuto de Autonomía de las Islas Baleares (BOIB núm. 32 ext., de 1 de marzo de 2007; corrección de errores BOIB núm. 29, de 28 de febrero de 2008), en concreto el artículo 70.4 relativo a la competencia propia de los consejos insulares en materia de servicios sociales y asistencia social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. &lt;/strong&gt;La Ley 14/2001, de 29 de octubre, de atribución de competencias a los consejos insulares en materia de servicios sociales y seguridad social, establece en su artículo 14 la potestad reglamentaria normativa atribuida a los consejos insulares en materia de servicios sociales, dentro del marco de la regulación básica establecida por el Gobierno de las Islas Baleares (BOIB núm. 135, de 10 de noviembre de 2001 y BOE núm. 284, de 27 de noviembre de 2001).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3.&lt;/strong&gt; Los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67, de 18 de mayo de 2019) aprobados por acuerdo del Pleno del Consejo de Mallorca de fecha 11 de abril de 2019, en especial lo establecido en el artículo 2 de acuerdo con el que el Instituto Mallorquín de Asuntos Sociales, como organismo autónomo creado por el Consell de Mallorca, adscrito al Departamento de Derechos Sociales del Consell de Mallorca, es el organismo que ejerce las competencias&amp;nbsp;atribuidas por cualquier título al Consejo de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;4. &lt;/strong&gt;&lt;span style="color:#000000"&gt;Decreto de la Presidencia del Consejo de Mallorca por el que se nombran a los miembros del Consejo Ejecutivo de 10 de julio de 2023 (BOIB núm. 95, de 11 de julio de 2023) por el que se nombra al sr. Guillermo Sánchez Cifre consejero ejecutivo de Bienestar Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. &lt;/strong&gt;El órgano competente para aprobar esta resolución es la Presidencia del IMAS, de acuerdo con el artículo 7.2 de los Estatutos del IMAS (BOIB núm. 67, de 18 de mayo de 2019). No obstante, y de acuerdo con el artículo 8.2.1, las Vicepresidencias del IMAS suplirán a la Presidencia y asumirán sus atribuciones en caso de vacante, ausencia, enfermedad, imposibilidad física u otra causa legal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En cuanto al fondo,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6.&lt;/strong&gt; Resolución de la Presidencia del IMAS de día 2 de diciembre de 2022 de actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB nº 158, de 6 de diciembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7.&lt;/strong&gt; La Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca aprobada definitivamente en Pleno del Consejo de Mallorca de 13 de julio de 2017 (BOIB núm. 97, de 18 de julio de 2017 y corrección de errores materiales publicada BOIB nº 161, de 30 de diciembre de 2017) y Prorrogada por el Acuerdo de Pleno de 14 de diciembre de 2023 hasta el 31 de diciembre de 2024 (BOIB nº 176, de 30 de diciembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.&lt;/strong&gt; La Ley 12/2018, de 15 de noviembre, de servicios a las personas en el ámbito social en la comunidad autónoma de las I&lt;span style="color:#000000"&gt;slas Baleares&lt;/span&gt; (BOIB núm. 146 de 22 de noviembre de 2018), regula en el Capítulo I el « Régimen de colaboración privada en la gestión de servicios sociales para las personas mediante acción concertada».&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;En virtud de la competencia legalmente atribuida,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.&lt;/strong&gt; APROBAR la previsión de los servicios por parte de la Dirección Insular de Personas con Discapacidad e Innovación Social durante el año 2024, detallados en el Anexo I de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.&lt;/strong&gt; APROBAR la previsión de los servicios por parte de la de Centros y Programas de Atención Integral a la Infancia y Adolescencia durante el año 2024, detallados en el Anexo II de esta Resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.&lt;/strong&gt; APROBAR la Guía de aplicación en el modelo de atención a los servicios sociales para personas con discapacidad de Mallorca para toda la concertación y el Modelo de evaluación de seguimiento de la acción concertada, aplicable a los servicios concertados por la Dirección Insular de Personas con Discapacidad.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto.&lt;/strong&gt; PUBLICAR esta Resolución en el Boletín Oficial de las Islas Baleares, así como en el&amp;nbsp;Tablón de Anuncios del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Esta resolución no pone fin a la vía administrativa y contra ella puede interponerse, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consejo de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, dentro del plazo de un mes, a contar a partir del día siguiente al de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación de dicho recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución). No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:115%"&gt;&lt;span style="color:#000000"&gt;Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;Previsión de servicios a concertar por la Dirección Insular de Personas con Discapacidad.&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Los servicios de la Dirección Insular de Personas con Discapacidad, incluidos en la Cartera Insular de Servicios Sociales y de los Servicios a Menores y Familia de Mallorca, a concertar durante el año 2024, son los que se detallan a continuación:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;En relación al precio plaza, es de aplicación para cada servicio lo indicado en la Resolución de la Presidencia del IMAS de actualización y fijación de precios de los servicios para personas con discapacidad, incluidos en la cartera insular de servicios sociales, que pueden ser objeto de concertación social (BOIB núm. 158, de 6 de diciembre de 2023).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Esta previsión tiene carácter estimativo y en tanto a plazos, nombre, plazas y cuantificación puede variar, dadas las necesidades reales de la Dirección Insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;&lt;span style="color:#000000"&gt;1) Concertación por el procedimiento de urgencia del Servicio de Ocupacional p&lt;/span&gt;&lt;span style="color:#000000"&gt;ara&lt;/span&gt;&lt;span style="color:#000000"&gt; personas con discapacidad intelectual y/o trastorno del desarrollo:&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Plazas: 127&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Complemento de transporte: 10&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Precios del servicio:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
