    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado 9.5. de la Convocatoria de ayudas para el desarrollo rural de la isla de Menorca, de fecha 26&amp;nbsp;de mayo&amp;nbsp;de 2021, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014 a 2020 de Menorca, para el año 2021, especifica&amp;nbsp;&amp;nbsp;que la resolución se publicará con carácter informativo a los interesados mediante su publicación en el Boletín Oficial de las Illes Balears de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 22 de junio de 2017 se aprobó, mediante Resolución de la Autoridad de Gestión del Programa de Desarrollo Rural de las Islas Baleares, la Estrategia de Desarrollo Local Participativo Rural de Menorca. En la posterior modificación del EDLP (Resolución de día 3 de marzo de 2020) se aprobaron las bases de las subvenciones destinadas a fomentar intervenciones que minimicen la contaminación del agua, concretándose en la construcción de filtros verdes de fecha 26 de mayo de 2021 y publicada en el Boletín Oficial de las Islas Baleares núm. 71 y de día 1 de junio de 2021. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha 5 de julio de 2021, Dª.MARIA DE L&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;E&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;S NE&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;US TORRES BONED con NIF***1228** presentó solicitud de ayuda para acogerse a la línea de ayuda destinada a fomentar intervenciones que minimicen la contaminación del agua, concretándose en la construcción de filtros verdes. De acuerdo con el apartado Sexto de la Resolución de Convocatoria, el plazo de presentación de solicitudes fue de tres meses, a contar a partir del día siguiente al de la publicación de la convocatoria en el BOIB. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3.Con fecha 16 de septiembre de 2021 y con número de registro de entrada 035/2021, la persona interesada señalada en el anexo de esta resolución presentó el desistimiento de la solicitud de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;4.El artículo 94.1 de la Ley 39/2015, de 1 de octubre del procedimiento administrativo común de las administraciones públicas, establece que «Todo interesado podrá desistir de su solicitud o, cuando esto no esté prohibido por el ordenamiento jurídico, renunciar a sus derechos». En el punto 4 del mismo artículo se contempla que «la Administración debe aceptar por completo el desistimiento o la renuncia, y debe declarar concluso el procedimiento, salvo que, habiéndose personado terceros interesados, éstos insten a ello la continuación en el plazo de diez días desde que fueron notificados del desistimiento o renuncia».&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y se propone al vicepresidente en materia agraria del FOGAIBA que dicte una resolució&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n en los siguientes t&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;érminos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Aceptar el desistimiento de la solicitud de ayuda presentada por la persona interesada que figura en el anexo de esta resolución, que es un total de un expediente y que comienza y termina con MARIA DE LES NIEUS TORRES BONED, relativa a la línea de ayuda «subvención destinada a fomentar intervenciones que minimicen la contaminación del agua» por el motivo especificado en el citado anexo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2.Declarar concluido el procedimiento y archivar el expediente detallado en el anexo de esta Resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Notificar esta resolución a la persona interesada.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
