![CDATA[Corrección de errores de la Propuesta de resolución del director general de Energía y Cambio Climático de 6 de julio de 2023 por la que se conceden las subvenciones para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR 2023)]] CAIB es CAIB 683101 6729 ![CDATA[<p><strong style="font-family:&quot;Times New Roman&quot;,Times,serif">Hechos</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">1. El 17 de diciembre de 2022, en el BOIB nº. 164, se publicó la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022 por la que se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2023 por al fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios en el Programa Operativo FEDER 2021-2027.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El 6 de julio de 2023 se emitió <span style="color:black">la Propuesta de resolución del director general de Energía y Cambio Climático &nbsp;por la que se conceden las subvenciones para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR 2023) (BOIB nº101, de 20 de juilo de 2023).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Con posterioridad, se ha detectado un error material en el anexo de la&nbsp; Propuesta mencionada, por lo que se procede a su rectificación.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Fundamentos de derecho</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. El artículo 56 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, dispone que la rectificación de los errores materiales, aritméticos y de hecho en actas y disposiciones administrativas corresponde al órgano que ha dictado el acto o disposición. Asimismo, la rectificación de errores especificará, en su caso, los efectos jurídicos que se deriven y se notificará o publicará preceptivamente cuando haga referencia a actos que han sido notificados o publicados.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">2. El artículo 109.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece que las administraciones públicas pueden rectificar en cualquier momento, de oficio o a instancia de los interesados, los errores materiales, de hecho o aritméticos existentes en sus actos.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por todo ello, dicto la siguiente</span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>Resolución</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1. Aprobar la rectificación del error material existente en la <span style="color:black">Propuesta de resolución del director general de Energía y Cambio Climático de 6 de julio de 2023</span><span style="color:black"> por la que se conceden las subvenciones para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR 2023) (BOIB nº101, de 20 de juilo de 2023).,</span> en los&nbsp;
