&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3. de la Convocatoria de ayudas para el desarrollo rural de la isla de Mallorca, relacionadas directa o indirectamente con los ámbitos agrario y/o ambiental, dentro de la Estrategia de Desarrollo Local Participativo de Mallorca, de fecha 13 de noviembre de 2020 especifica que la resolución se publicará con carácter informativo a las personas interesadas mediante su publicación en el Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia Agraria del FOGAIBA con fecha 26 de octubre de 2023, firmará la siguiente resolución,&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha 4 de noviembre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;se publicó en el BOIB núm. 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;5&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2 la Resolución de concesión del vicepresidente en materia agraria del FOGAIBA de día 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;9&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ctubre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, al amparo de la Convocatoria para el año 2020 antes mencionada, en la que figuraba una concesión a favor del beneficiario que aparece en el anexo I adjunto, que es 1, y que comienza y termina con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;SECTOR RURAL S.L.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;con NIF &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;B57180739, con núm. de expediente EDLNP32020_1/006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. &lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. El artículo 21.1 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, establece la obligación de la Administración a dictar resolución expresa ya notificarla. En su párrafo segundo especifica que “En los casos de prescripción, renuncia del derecho, caducidad del procedimiento o desistimiento de la solicitud, así como la desaparición sobrevenida del objeto del procedimiento, la resolución consistirá en la declaración de la circunstancia que concurra en cada caso, con indicación de los hechos producidos y normas aplicables». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El artículo 43 del Texto refundido de la Ley de Subvenciones, aprobado por Decreto Legislativo 2/2005, de 28 de diciembre, dispone que «Pertoca la revocación de la subvención cuando, posteriormente a la resolución de concesión válida y ajustada a derecho , el beneficiario incumple total o parcialmente las obligaciones o compromisos contraídos a los que está condicionada la eficacia del acto de concesión de la subvención. A consecuencia de la revocación de la subvención, queda sin efecto, total o parcialmente, el acto de concesión y procede el reintegro de las cantidades indebidamente percibidas». &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Dado todo esto, se propone hacer la revocación total debido a la renuncia de la ayuda concedida por el beneficiario que se indica en el anexo I de esta resolución.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Acuerdo por el que se aprueban las Bases de la convocatoria, para el año 2020, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en el 'Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Orden del conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del Procedimiento &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;A&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;dministrativo común de las &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Propuesta de resolución&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt; &lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y propone al vicepresidente en materia agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Aceptar la renuncia de la ayuda concedida por Resolución del vicepresidente en materia agraria del FOGAIBA de día 19&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;setiembre&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;de 202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, presentada por el beneficiario detallado en el anexo I adjunto, que &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;es&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;un total de 1 expediente y que comienza con &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;SECTOR RURAL S.L. y termina con SECTOR RURAL S.L.&amp;nbsp;relativa a la línea de ayuda «Apoyo a la implementación en las operaciones incluidas los EDL No Programados MALLORCA» de la Convocatoria para el año&amp;nbsp;2020&amp;nbsp;, de ayudas al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca. EDLNP32020_1. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Revocar totalmente la ayuda concedida en la Resolución del vicepresidente en materia agraria del FOGAIBA de día 19&amp;nbsp;de setiembre&amp;nbsp;de 2021&amp;nbsp;antes citada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Declarar concluido el procedimiento y archivar el expediente. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la Resolución a cada uno de los beneficiarios del Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
