    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3. de la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de 17&amp;nbsp;de diciembre&amp;nbsp;de 2021 por la que se convocan, subvenciones para inversiones en las explotaciones agrarias, correspondientes al año 2021, especifica que la resolución expresa se notificará a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1&amp;nbsp;de octubre, del procedimiento administrativo común&amp;nbsp;de &amp;nbsp;de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43&amp;nbsp;de la Ley 39/2015, de&amp;nbsp;1 de octubre, del procedimiento administrativo común&amp;nbsp;de &amp;nbsp;de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en Materia agraria del FOGAIBA, con&amp;nbsp;fecha 29&amp;nbsp;de enero&amp;nbsp;de 2024, firma la siguiente resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.&amp;nbsp;Resolución de la presidenta del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA), de día 26 de octubre &amp;nbsp;de 2021, por la que se convocan, para el año 2021, subvenciones para inversiones en las explotaciones del sector de los frutos secos, modificada mediante resolución de 14 de diciembre de 2021. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado segundo de la mencionada modificación de Resolución, el plazo de presentación de solicitudes finalizó el día 30/12/2021. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Una vez evaluadas las solicitudes de ayuda por los órganos gestores, y de acuerdo con los criterios de elegibilidad establecidos, los interesados señalados en el Anexo adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el citado anexo. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El día 19&amp;nbsp;de setembre&amp;nbsp;de 2023 el Servicio de Ayudas al Desarrollo Rural ha emitido el informe propuesta de resolución de concesión desfavorable y propuesta provisional de denegación de la ayuda a los interesados relacionados en el anexo adjunto. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 19&amp;nbsp;de septiembre de 2023 se notificó, mediante publicación en la página web del FOGAIBA, la mencionada propuesta provisional a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. El día 28 de septiembre de 2023 se presentó una solicitud de cambio de titular y también alegaciones a la propuesta de denegación. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8. Analizadas las alegaciones no se pueden aceptar, ya que en el momento de la solicitud la persona solicitante había fallecido, y según el punto 3 del artículo 1732 del Código Civil: El mandato termina por muerte o por concurso del mandante o del mandatario, por tanto la representación no es válida, además de que en el momento de la solicitud no estaba aceptada la herencia.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Orden del Conseller de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020 .&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y se propone al vicepresidente del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Denegar la ayuda solicitada por l&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;os&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;interesado&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;s&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;que figura&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;en el Anexo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;adjunto&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;, que &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;son&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;un total de &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1 &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;expediente y que comienza &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;con JOSE RAMON MILLA, relativa a la línea de ayudas "Inversiones en las explotaciones agrarias ", por no cumplir con alguno de los requisitos que se establecen en la convocatoria y que se especifican en el mencionado anexo.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo adjunto.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3. Public&lt;em&gt;ar esta resolución en el Butlletí Oficial de les Illes Balears.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Interposición de recursos&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Contra esta resolución, que no agota la vía administrativa, podrá interponerse recurso de alzada ante el conse&lt;/em&gt;&lt;em&gt;ll&lt;/em&gt;&lt;em&gt;er de Agricultura&lt;/em&gt;&lt;em&gt;, &lt;/em&gt;&lt;em&gt;Pesca&lt;/em&gt;&lt;em&gt;&amp;nbsp;y Medio Natural&lt;/em&gt;&lt;em&gt;, en el plazo de un mes, a contar desde el día siguiente a la notificación de la resolución, de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la &lt;/em&gt;&lt;em&gt;C&lt;/em&gt;&lt;em&gt;omunidad autónoma de las I&lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;l&lt;/em&gt;&lt;em&gt;e&lt;/em&gt;&lt;em&gt;s Balears, y el artículo 68.1 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
