&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El 3 de diciembre de 2022 se publicó en el BOIB núm. 157 la Resolución del director general del Servicio de Salud de las Islas Baleares de 1 de diciembre de 2022 por la que se aprueban las bases generales y el baremo de méritos que deben regir las convocatorias de los procesos de selección por medio de la modalidad de concurso extraordinario derivados de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta Resolución se modificó mediante Resolución de 28 de febrero de 2023 (BOIB Núm. 27 de 2 de marzo de 2023)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El 20 de diciembre de 2022 se publicó en el BOIB núm. 165 la Resolución del director general del Servicio de Salud de las Islas Baleares de 12 de diciembre de 2022 por la que se aprueban y publican las convocatorias específicas de procesos selectivos, por el sistema de concurso extraordinario y/o concurso-oposición, derivados de la oferta de empleo público adicional de estabilidad ordinaria y excepcional de estabilización para el año 2022, de la categoría técnico/técnica superior especialista en radiodiagnóstico, para acceder a plazas vacantes de personal estatutario fijo dependientes del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Esta Resolución se modificó mediante Resolución de 17 de marzo de 2023 (BOIB Núm. 37 de 23 de marzo de 2023)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El 25 de enero de 2024 se publicó en el BOIB núm. 12 la Resolución del director general del Servicio de Salud de las Islas Baleares de 21 de enero de 2024 por la que se modifica el punto 24 del anexo 1 de las resoluciones del mismo órgano por las que se aprueban las bases generales y el baremo de méritos que deben regir las convocatorias de los procesos de selección por medio de las modalidades de concurso-oposición y concurso extraordinario derivados de la oferta de empleo público adicional de estabilidad ordinario y excepcional de estabilización para el año 2022 del personal estatutario del Servicio de Salud de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Por medio de la Resolución del director general del Servicio de Salud de las Islas Baleares de 13 de diciembre de 2023 —publicada en el web &lt;em&gt;www.ibsalut.es&lt;/em&gt; y en la sede electrónica del Gobierno de las Islas Baleares— se aprobó la lista de candidatos que habían superado el proceso selectivo y se abrió un plazo de diez días hábiles para que presentaran la documentación oportuna.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Una vez vencido dicho plazo y revisada la documentación presentada, es procedente aprobar la resolución de nombramiento de personal estatutario fijo y de adjudicación de las plazas a los candidatos que han acreditado documentalmente que cumplen los requisitos exigidos en la convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Una vez comprobada la documentación presentada según el punto 8.2 &lt;em&gt;d)&lt;/em&gt; de las bases generales del concurso extraordinario, se ha excluido a los aspirantes siguientes por no cumplir alguno de los requisitos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sra. Cubero Beltrán, Virginia: no acredita el nivel B2 de catalán según la disposición transitoria adicional tercera de la Ley 4/2016, de 6 de abril, y no cumple con lo requerido en la disposición adicional tercera del Decreto Ley 6/22 de 13 de junio.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sr. Campillos García, Javier: no acredita el nivel B2 de catalán según la disposición transitoria adicional tercera de la Ley 4/2016, de 6 de abril, y no cumple con lo requerido en la disposición adicional tercera del Decreto Ley 6/22 de 13 de junio.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Sra. Samaniego García, Mónica: no acredita el nivel B2 de catalán según la disposición transitoria adicional tercera de la Ley 4/2016, de 6 de abril, y no cumple con lo requerido en la disposición adicional tercera del Decreto Ley 6/22 de 13 de junio.&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. El artículo 32 y los concordantes de la Ley 55/2003, de 16 de diciembre, del estatuto marco del personal estatutario de los servicios de salud.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. El artículo 62 y los concordantes del Texto refundido de la Ley del estatuto básico del empleado público, aprobado por el Real decreto legislativo 5/2015, de 30 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. El artículo 13 y los concordantes del Real decreto ley 1/1999, de 8 de enero, sobre selección de personal estatutario y provisión de plazas a las instituciones sanitarias de la Seguridad Social, vigente con rango reglamentario y sin carácter básico en virtud de la disposición transitoria sexta de la Ley 55/2003.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. La disposición transitoria segunda de la Ley 4/2016, de 6 de abril, de medidas de capacitación lingüística para la recuperación del uso del catalán en el ámbito de la función pública, sin perjuicio de la aplicación de la disposición adicional decimotercera del Decreto ley 6/2022, de 13 de junio, de nuevas medidas urgentes para reducir la temporalidad en el empleo público de las Islas Baleares, corregido por el Acuerdo del Consejo de Gobierno de 27 de junio de 2022 y modificado por la disposición final sexta de la Ley 4/2023, de 27 de febrero, de prestaciones sociales de carácter económico de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;1. Nombrar como personal estatutario fijo de la categoría técnico/técnica superior especialista en radiodiagnóstico dependiente del Servicio de Salud de las Islas Baleares a las personas que figuran en el anexo 1 de esta resolución.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este nombramiento está sujeto al hecho de que las personas que no hayan acreditado el requisito del nivel B2 de conocimientos de catalán y que estén en servicio activo en la fecha de vencimiento del plazo para presentar solicitudes en el Servicio de Salud de las Islas Baleares en esta misma categoría profesional están obligadas a acreditar dicho nivel en el plazo de dos años a contar desde la fecha de la toma de posesión; en caso contrario, serán removidas de la plaza por medio del procedimiento correspondiente y pasarán a estar en la situación de adscripción provisional.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. Adjudicar las plazas, según se indica en el anexo 2, a los candidatos que han superado las pruebas selectivas para el ingreso por el turno libre, después de haber presentado la documentación pertinente, de acuerdo con la petición efectuada por los candidatos y la puntuación obtenida en el proceso selectivo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. Determinar que la toma de posesión debe efectuarse en el plazo de un mes a contar desde el día siguiente a la fecha de publicación de esta resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt; y que perderán el derecho a tomar posesión de la plaza las personas que no se incorporen al destino correspondiente dentro de dicho plazo, excepto en los casos de imposibilidad acreditada y apreciada por el órgano convocante.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;4. Establecer que, antes de tomar posesión de la plaza, cada adjudicatario ha de hacer constar que no ocupa ningún puesto de trabajo en el sector público ni que lleva a cabo ninguna actividad de las que comprende el artículo 1 de la Ley 53/1984, de 26 de diciembre, de incompatibilidades del personal al servicio de las administraciones públicas. En el caso de que lleve a cabo alguna actividad privada —incluidas las de carácter profesional—, tiene la obligación de declararlo dentro del plazo de diez días hábiles a contar desde el día siguiente a la fecha de la toma de posesión, a fin de que el órgano competente acuerde la declaración de compatibilidad o incompatibilidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;5. Determinar que, de acuerdo con el párrafo segundo de la base 24 de la convocatoria, las personas que hayan obtenido un destino definitivo no pueden participar en ningún concurso de provisión de plazas durante un plazo mínimo de dos años a contar desde el día en que hayan tomado posesión de la plaza, excepto que en una primera convocatoria haya quedado desierta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Asimismo, durante el mismo periodo de dos años, no podrán concederse a las personas adjudicatarias comisiones de servicios. Excepcionalmente, esta prohibición queda sin efecto cuando exista una necesidad asistencial debidamente acreditada&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;6. Aplazar el nombramiento de personal estatutario fijo de las personas que han superado el concurso extraordinario pero están incursas en circunstancias de imposibilidad acreditadas debidamente.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;7.&amp;nbsp;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Publicar esta resolución en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta resolución, que agota la vía administrativa, puede interponerse un recurso de reposición ante el órgano que la dicta en el plazo de un mes a contar desde el día siguiente a la publicación, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y el artículo 57 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la Comunidad Autónoma de las Islas Baleares.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También puede interponerse directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-Administrativo del Tribunal Superior de Justicia de las Islas Baleares en el plazo de dos meses a contar desde el día siguiente a la publicación, de acuerdo con el artículo 8.2.&lt;em&gt;a)&lt;/em&gt; —en relación con el artículo 10.1.&lt;em&gt;a)&lt;/em&gt;— y el artículo 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
