    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado 9.3. de la Convocatoria de ayudas para el desarrollo rural de la isla de Menorca, relacionados directa o indirectamente con los ámbitos agrario y / o ambiental, dentro de la Estrategia de Desarrollo Local Participativo de Mallorca, de fecha 27&amp;nbsp;de enero&amp;nbsp;de 2022&amp;nbsp;especifica que la resolución se publicará con carácter informativo a los interesados mediante su publicación en el Boletín Oficial de las Islas Baleares de acuerdo con los términos previstos en el artículo 45.2 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo dispuesto en el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas .&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente en Materia Agraria del FOGAIBA con fecha 23 de enero&amp;nbsp;de 2024, firmó la siguiente resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;span style="color:#000000"&gt;Antecedentes&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Con fecha de 7 de mayo de 2022 se publicó, en el BOIB núm. 60, Acuerdo por el que se aprueban las Bases de la convocatoria, para el año 2022, de ayudas de minimis al desarrollo rural de la isla de Mallorca, vinculadas a proyectos relacionados con los ámbitos agrario y/o ambiental y enmarcados en la Estrategia de Desarrollo Local Participativo 2014-2020 de Mallorca. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la mencionada convocatoria, el plazo de presentación de solicitudes terminó el día 7 de junio y tuvieron entrada en el Registro del Grupo de Acción Local, Asociación Mallorca Rural un total de 40 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. La Comisión Evaluadora del GAL en sus reuniones de 20 y 28 de septiembre de 2022 propuso denegar un total de 10 de las solicitudes presentadas por no cumplir los requisitos de la convocatoria. Esta propuesta fue ratificada por la Junta Directiva de la Asociación Mallorca Rural, órgano decisorio competente, en su reunión de 27 de octubre de 2022 y se comunicó al FOGAIBA para la denegación de estos expedientes. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Estos expedientes, relacionados en el Anexo I adjunto no cumplen con alguno de los requisitos previstos en la convocatoria para poder ser beneficiarios de la ayuda, por los motivos indicados en el mencionado anexo que se corresponden con los indicados por el Grupo de Acción Local. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5. El Servicio de Ayudas al Desarrollo Rural ha emitido la propuesta provisional de denegación de la ayuda a los interesados relacionados en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 21 de diciembre de 2023 se notificó, mediante publicación en la página web http://www.caib.es, la citada propuesta provisional a los interesados, concediéndoles un plazo de 10 días para presentar las alegaciones oportunos. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. A día de hoy, y una vez finalizado el plazo, los interesados relacionados en el Anexo I no han subsanado los motivos de denegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Decreto 65/2007, de 25 de mayo, de constitución, organización y funcionamiento del Organismo Pagador de los gastos del Fondo Europeo Agrícola de Garantía (FEAGA) y del Fondo Europeo Agrícola de Desarrollo Rural (FEADER), a la comunidad autónoma de las Islas Baleares BOIB núm. 082 de 2007; en virtud de la Orden de la consejera de Agricultura y pesca de 23 de diciembre de 2005, por la que se dispone la asunción de la ejecución de la política de mejora y fomento de los sectores agrario y pesquero por parte del Fondo de Garantía Agraria y Pesquera de las Islas Baleares, establece en el artículo 1 que el FOGAIBA asume la ejecución de la política de la Consejería de Agricultura y Pesca en lo referente a la aplicación de las medidas de fomento y mejora de los sectores agrario y pesquero , a partir del 1 de enero de 2006. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;XVI. Ley 30/1992, de 26 de noviembre de régimen jurídico de las administraciones públicas y del procedimiento administrativo común&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif"&gt;&lt;em&gt;RESOLUCIÓN&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa des&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;favorablemente y &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;se &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;propo&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ne&amp;nbsp;al vicepresidente del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1. Denegar las solicitudes presentadas por los interesados relacionados en el Anexo I, por incumplimiento de requisitos que se indican en el citado anexo.&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Declarar concluido el procedimiento y proceder al archivo de los expedientes detallados en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;3. Publ&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;icar &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;esta &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;resolución &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en el Boletín Oficial de las Islas Baleares.&lt;/em&gt;&amp;nbsp;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;
