67425 2024-02-02 CAIB 2024-02-08 682842 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En el Pleno del Ayuntamiento de 25 de Febrero de 2024 &nbsp;se adoptó el siguiente acuerdo:<span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span><span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"> </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">1.-Desestimar las enmiendas formuladas por el grupo PSIB-PSOE en relación al Proyecto de Ordenanza de Prestaciones Patrimoniales de carácter Público no Tributario que recoja las tarifas de la prestación del servicio de transporte urbano, de conformidad con el informe anexo del Departamento de Movilidad.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">2. Rectificar los errores materiales detectados en el Proyecto de Ordenanza de Prestaciones Patrimoniales de carácter Público no Tributario que recoja las tarifas de la prestación del servicio de transporte urbano, así como la introducción de una disposición transitoria de conformidad con el informe anexo del Departamento de Movilidad.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">3. Aprobar provisionalmente la Ordenanza de Prestaciones Patrimoniales de carácter Público no Tributario que recoja las tarifas de la prestación del servicio de transporte urbano, de acuerdo con el Proyecto de Ordenanza y la memoria justificativa que se adjuntan a la presente resolución.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">4. Disponer la apertura del periodo de información pública y de audiencia a los interesados de la Ordenanza aprobada por un plazo de 30 días a efectos de alegaciones, de conformidad a lo&nbsp; previsto en el artículo 100 del Reglamento Orgánico del Pleno del Ayuntamiento de Palma y a los efectos oportunos.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">5. Que una vez adoptado el acuerdo provisional referido, se publique en el BOIB y en uno de los diarios de mayor difusión de la Comunidad Autónoma el correspondiente anuncio de exposición al público del expediente, a efectos de reclamación. La citada exposición se hará en el tablón de edictos de este Excmo. LRBL en la actualidad el servicio de transporte urbano colectivo se explota por parte de un operador en forma de sociedad mercantil de capital íntegro del Ayuntamiento de Palma bajo la modalidad de gestión directa, de las competencias del Ayuntamiento de Palma en materia de transporte urbano colectivo dentro del término municipal de Palma. Todo ello en virtud del Acuerdo del Pleno del Excma. Ayuntamiento de Palma de fecha 20 de diciembre de 1984, por el que se acordó aprobar de forma definitiva el expediente de municipalización sin monopolio del Servicio de transportes urbanos colectivos de Palma de acuerdo con el artículo 56 y siguientes del Reglamento de Servicios y determinar como forma de gestión de los servicios mencionados, la forma directa a través de sociedad anónima, mediante la creación y constitución de la Empresa Municipal de Transportes Urbanos de Palma, S.A.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En uso de las facultades concedidas por los artículos 31.3 de la Constitución Española y por el artículo 106 de la Ley 7/1985, de 2 de abril, Reguladora de las Bases de Régimen Local, y en conformidad con el que disponen los artículo 20.6 del Texto refundido de la Ley de haciendas locales aprobado por el Real decreto legislativo 2/2004, de 5 de marzo, este Ayuntamiento establece la Prestación Patrimonial de Carácter Público No Tributario del servicio de transporte urbano colectivo&nbsp; que se regirá por la presente Ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La ordenanza municipal de prestaciones patrimoniales no tributarias del servicio de transporte urbano colectivo, el texto del cual se eleva a la consideración del Pleno de la Corporación, responde a determinados principios, necesidades y circunstancias que se pueden sintetizar en los siguientes aspectos:</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La Disposición final duodécima de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público, modifica el texto refundido de la Ley Reguladora de las Haciendas Locales, aprobado mediante Real Decreto Legislativo 2/2004, de 5 de marzo, añadiéndose un nuevo apartado 6 al artículo 20, en los siguientes términos:</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>«6. Las contraprestaciones económicas establecidas coactivamente que se perciban por la prestación de los servicios públicos a que se refiere el apartado 4 de este artículo, realizada de forma directa mediante personificación privada o mediante gestión indirecta, tendrán la condición de prestaciones patrimoniales de carácter público no tributario conforme a lo previsto en el artículo 31.3 de la Constitución</em>.</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>En concreto, tendrán tal consideración aquellas exigidas por la explotación de obras o la prestación de servicios, en régimen de concesión, sociedades de economía mixta, entidades públicas empresariales, sociedades de capital íntegramente público y demás fórmulas de Derecho privado.</em></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><em>Sin perjuicio de lo establecido en el artículo 103 de la Ley de Contratos del Sector Público, las contraprestaciones económicas a que se refiere este apartado se regularán mediante ordenanza. Durante el procedimiento de aprobación de dicha ordenanza las entidades locales solicitarán informe preceptivo de aquellas Administraciones Públicas a las que el ordenamiento jurídico les atribuyera alguna facultad de intervención sobre las mismas.»</em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Por ello se plantea aprobar una nueva Ordenanza de prestaciones patrimoniales de carácter público no tributario que recoja todas las tarifas por la prestación del servicio de Transporte urbano de la ciudad de Palma, incluyendo en ella la regulación de las denominadas bonificadas sociales, y del resto de tarifas que se vienen abonando hasta el momento por los usuarios, aprobadas en su momento por el Pleno del Ayuntamiento, con la finalidad de llevar a cabo una actualización de acuerdo con la normativa mencionada.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Por todo ello en ejercicio de las facultades concedidas por los artículos 133.2 y 142 de la Constitución, el Ayuntamiento de Palma establecerá la Prestación Patrimonial de Carácter Público No Tributario por Transporte urbano, que se regirá por la presente Ordenanza reguladora. Todo ello en aplicación de lo establecido al respecto por el nuevo apartado 6 del artículo 20 del texto refundido de la Ley reguladora de las Haciendas Locales, aprobado por Real Decreto Legislativo 2/2004, de 5 de marzo (TRLRHL), en su redacción aprobada por la Disposición Final Duodécima de la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Público (LCSP), cuya entrada en vigor se produjo el 9 de marzo del año 2018. Lo anterior en concordancia con lo establecido por las Disposición Adicional Cuadragésimo Tercera de la citada Ley de Contratos del Sector Público, y por la Disposición Adicional Primera de la Ley 58/2003, de 17 de diciembre, General Tributaria (LGT) en la redacción aprobada para la misma por la Disposición Final Undécima de la ya citada Ley 9/2017, de Contratos del Sector Público.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">A los efectos de dar cumplimiento a lo dispuesto en el artículo 129 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las Administraciones Públicas el ejercicio de esta potestad reglamentaria se rige, de acuerdo con los principios de necesidad, eficacia, proporcionalidad, seguridad jurídica, transparencia y eficiencia, justificando su adecuación a dichos principios de acuerdo a lo siguiente:</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">a) En virtud de los principios de necesidad y eficacia, esta iniciativa reglamentaria se justifica por una razón de interés general, basándose en el fin perseguido que es la regulación adecuada de las tarifas que se obtienen como retribución por la prestación de los servicios públicos, denominándose ahora Prestaciones Patrimoniales no Tributarias.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">b) En virtud del principio de proporcionalidad esta iniciativa contiene una regulación mínima e imprescindible para atender la necesidad perseguida por la norma, tras constatar que no existen otras medidas menos restrictivas de derechos, o que impongan menos obligaciones a los destinatarios.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">c) A fin de garantizar el principio de seguridad jurídica, esta iniciativa reglamentaria se ejerce de manera coherente con el resto del ordenamiento jurídico, nacional y autonómico, así como de la Unión Europea, para generar un marco normativo estable, predecible e integrado, claro y de certidumbre.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">d) En aplicación del principio de transparencia se posibilitará el acceso sencillo, universal y actualizado de acuerdo a la Ley 19/2013, de 9 de diciembre, mediante la publicación de dicha ordenanza a través del portal web municipal.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Artículo 1. Fundamento y naturaleza</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En uso de las facultades concedidas por los artículos 31.3 de la Constitución Española y por el artículo 106 de la Ley 7/1985, de 2 d'abril, Reguladora de las Bases de Régimen Local, y de conformidad con lo que disponen los artículos 20.6 del Texto Refundido de la Ley de Haciendas Locales aprobado por el Real Decreto Legislativo 2/2004, de 5 de marzo, este Ayuntamiento establece la prestación patrimonial de carácter público no tributario del servicio de transporte colectivo urbano, que se regirá por esta Ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">El servicio de transporte colectivo urbano se presta de forma directa a través de la sociedad anónima, Empresa Municipal de Transportes Urbanos de Palma, S.A., el titular de la totalidad de su capital es el Ayuntamiento de Palma. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Articulo 2. Supuesto de hecho de la prestación patrimonial </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Constituye el supuesto de hecho de la prestación patrimonial de carácter público no tributario el servicio público de transporte colectivo urbano, prestado por el Ayuntamiento de Palma por medio de gestión directa a través de la <em>Empresa Municipal de Transports Urbans de Palma, S.A.</em> en su área de competencia, a las personas que lo soliciten mediante la adquisición de los títulos de transporte válidos regulados en el anexo de la presente Ordenanza.</span></span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>​​​​​​​</strong></span></span><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Artículo 3. Personas obligadas al pago y devengo</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Estarán obligadas al pago las personas físicas mayores de 16 años usuarias del servicio de transporte colectivo, en el momento de iniciarse el servicio.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Artículo 4. Cuota y forma de pago</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">La cuota será la que resulte de aplicación de las tarifas contenidas en el Anexo de esta ordenanza y podrán ser abonadas en efectivo, mediante tarjeta prepago o tarjeta ciudadana.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">En caso de impago de las prestaciones patrimoniales de carácter público no tributario a la fecha de vencimiento especificada en la correspondiente factura, estas podrán hacerse efectivas por el Ayuntamiento a través de la vía de apremio, en base a lo establecido en el artículo 2.2 de Real decreto legislativo 2/2004, de 5 de marzo, por el cual se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Artículo 5. Personas beneficiarias de las tarifas bonificadas </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">A efectos de establecer los diferentes perfiles y baremos de reconocimiento de las personas beneficiarias de tarifas bonificadas se estará a lo dispuesto en el decreto regulador de los perfiles de la Tarjeta Ciudadana. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Artículo 6. Transbordo </strong>&nbsp;</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Se permitirá un transbordo gratuito por viaje entre líneas urbanas diferentes, hasta 90 minutos después de la 1ª validación, para los trayectos, i formas de pago, indicados en el anexo.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Disposición derogatoria </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Quedan derogadas cuantas disposiciones de igual o inferior rango se opongan a lo establecido en esta Ordenanza.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%"><strong>Disposición transitoria </strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:115%">Conceder un descuento del 100%&nbsp; en el&nbsp; precio de los abonos y títulos multiviaje establecidos en la presente Ordenanza, vendidos entre el 1 de enero y el 31 de diciembre de 2024, y la vigencia de los cuales se enmarque en este periodo, del servicio urbano de transporte público del término municipal de Palma.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif;
