2024-01-27 es 682533 text/html 590 ![CDATA[Resolución del director general de Personal Docente y Centros Concertados por la cual se amplía la dotación de personal de apoyo educativo para la atención a la diversidad en la enseñanza privada concertada para el curso 2023-24]] CAIB 2024-01-27 2024-01-25 49439 ![CDATA[<p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000"><strong>Hechos </strong></span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">1.El título II de la Ley Orgánica 2/2006, de 3 de mayo, de educación, establece, en el artículo 71.1, que las administraciones educativas tienen que disponer de los medios necesarios para que todos los alumnos logren el máximo desarrollo personal, intelectual, social y emocional, así como los objetivos que establece a todos los efectos esta Ley. </span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2.El Decreto 39/2011, de 29 de abril, por el cual se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos, pretende garantizar la igualdad de oportunidades de todos los alumnos para que puedan lograr el máximo desarrollo de sus capacidades. Este Decreto establece que los centros docentes tienen que llevar a cabo las actuaciones necesarias para conseguir que los alumnos logren los objetivos y las competencias básicas de las diversas etapas educativas. </span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3.En fecha 26 de agosto de 2023 se publicó, BOIB núm. 118, la Resolución provisional del director general de Planificación, Ordenación e Infraestructuras Educativas por la cual se determina la ampliación de la dotación de personal de apoyo educativo para la atención a la diversidad en la enseñanza privada concertada para el curso 2023-2024.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">4.En fecha 16 de septiembre de 2023 se publicó, BOIB núm. 128, la Resolución definitiva del director general de Planificación, Ordenación e Infraestructuras Educativas por la cual se determina la dotación de personal de apoyo educativo para la atención a la diversidad en la enseñanza privada concertada para el curso 2023-2024.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5.Con posterioridad a la Resolución definitiva de 16 de septiembre de 2023, el Servicio de Atención a la Diversidad (de ahora en adelante SAD) ha emitido un informe, en fecha 18 de enero de 2024, que informa favorablemente sobre: </span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">a) Incrementar 12 horas la dotación de personal de apoyo (PT) al CC Sagrat Cor (07003675) debido al número de alumnado que requiere apoyo individual.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">b) Incrementar en 6 horas la dotación de personal de atención a la diversidad (AD) al CC Sant Vicenç de Paül (07001447), para atender las condiciones médicas complejas que presenta una alumna del centro.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">c) Incrementar en 6 horas la dotación de personal de apoyo (PT) al CC Beata Francinaina Cirer (CC 07001541) para abordar el alto porcentaje de alumnado NESE y de alumnado con necesidades específica de audición y lenguaje.</span></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">d) Incrementar en 24 horas la dotación de apoyo (PT) al CC Beato Ramon Llull para este curso escolar para la aplicación de un programa intensivo de regulación de conducta.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">6.Hay crédito adecuado y suficiente en las partidas correspondientes.</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><strong>Fundamentos de derecho</strong></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">1.La Ley orgánica 2/2006, de 3 de mayo, de educación (BOE núm. 106, de 4 de mayo), modificada per la Ley orgánica 3/2020, de 29 de diciembre (BOE núm. 340, de 30 de diciembre).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">2.La Orden de la consejera de Educación y Cultura de 7 de mayo de 2008 por la cual se regula la dotación de los equipos docentes a los niveles educativos concertados (BOIB núm. 65, de 13 de mayo) modificada por Orden de la consejera de Educación y Cultura de 23 de junio de 2009 (BOIB núm. 96, de 4 de julio).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">3.El Decreto 39/2011, de 29 de abril, por el cual se regula la atención a la diversidad y la orientación educativa en los centros educativos no universitarios sostenidos con fondos públicos (BOIB núm. 67, de 5 de mayo).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%"><span style="color:#000000">4.El</span> Decreto 59/2022, de 27 de diciembre, por el cual se establecen las normas que tienen que regir las convocatorias para el establecimiento y la renovación de los conciertos educativos a partir del curso académico 2023-2024 (BOIB núm. 169, de 29 de diciembre).</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:100%">5.El informe del Servicio de Atención a la Diversidad (SAD) al cual se hace referencia al hecho número 5, informan favorablemente sobre el aumento de la dotación de apoyo (PT) a cada uno de los centros mencionados.</span></span></p> <p style="text-align:center"><span style="font-family:Times New Roman,Times,serif;
