Expte. 2024/00000017V</span></strong></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Habiéndose presentado la siguiente propuesta, previa declaración de urgencia:</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">“Es voluntad del Consell Insular d'Eivissa, a través de su Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” fomentar todas aquellas iniciativas que en la isla supongan una promoción de actividades de ocio y de tiempo libre, dirigidas a niños y jóvenes, y que favorezcan la promoción del ocio y del tiempo libre en sus diversos ámbitos.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">En este sentido, en fecha 2 de enero de 2024, se dictó la providencia de inicio del expediente para el encargo de gestión de la producción técnica y ejecución del “Ciclo Familiar de Música y Teatro 2024” , que se celebrará entre los meses de enero y mayo de 2024 en el Recinto Ferial d'Eivissa.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">El Consell ejerce competencias en materia de ocio y ocio infantil y juvenil atribuidas por la Ley 1/2007, de 28 de diciembre, de reforma del Estatuto de Autonomía de las Illes Balears y la Ley 21/2006, de 15 de diciembre, de atribución de competencias a los consells de Menorca, y d'Eivissa y Formentera en materia de juventud y ocio.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">El punto 7 del apartado tercero del Decreto de Presidencia núm. 2023000467, Estructura del Gobierno del Consell Insular d'Eivissa y creación de Departamentos (BOIB </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">núm. 88, de 29-06-23) establece que las competencias del Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” comprenden, entre otros:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em><span style="color:black">c) La actividad competencial propia relativa a las actividades de ocio y tiempo libre, juventud y equipamientos juveniles y ordenación de estas actividades.</span></em></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><em><span style="color:black">d) Este departamento también gestionará los servicios propios de su ámbito de actuación prestados en los distintos centros propiedad del Consell Insular.</span></em></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">En este sentido, los espectáculos que forman parte del “Ciclo Familiar de Música y Teatro 2024”, dirigidos a los niños y sus familias, tiene el objetivo de ofrecer al público infantil ibicenco eventos musicales de máximo nivel que suponen un beneficio cultural y lúdico favoreciendo el disfrute de espectáculos de primer nivel.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Por eso, el Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma”, como parte de su programación de fomento de ocio y tiempo libre para el año 2024, tiene previsto llevar a cabo el citado evento en el Recinto Ferial d'Eivissa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">El Consell Insular d'Eivissa no cuenta con los medios propios suficientes para llevar a cabo la programación y ejecución del citado ciclo de espectáculos. Sin embargo el artículo 11.1. de la Ley 40/2015 de 1 de octubre de régimen jurídico del sector público establece que</span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black">la realización de actividades de carácter material o técnico de la competencia de los órganos administrativos o de las entidades de derecho público puede encargarse a otros órganos o entidades de derecho público de la misma Administración o de otra, siempre que entre sus competencias estén estas actividades, por razones de eficacia o cuando no se posean los medios técnicos idóneos para ejercerlas (...)</span></em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Considerando que Ferias, Congresos y Eventos d'Eivissa SAU (FECOEV) es una sociedad mercantil de capital público del Consell Insular d'Eivissa, y de acuerdo con el art. 1 bis de sus estatutos tiene " <em>la condición de medio propio del Consell insular d'Eivissa (...)"</em>.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Asimismo, el art. 1.2 establece que </span><em>“El Consell insular d'Eivissa podrá encargar a la sociedad la ejecución de cualquier actuación material relacionada con el objeto social mencionado en el artículo 2 de los Estatutos (...)”</em><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">, el cual dispone que, </span><em>“Constituye el objeto de la sociedad:</em></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black"><strong>1.</strong> La realización de las actividades precisas para planificar, proyectar, coordinar y gestionar con las administraciones públicas, empresas y particulares las siguientes áreas de trabajo:</span></em></span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><em><span style="color:black">a. Coordinación, impulso y dirección técnica y facultativa de los procesos de reconversión y ordenación de actividades para impulsar la inversión y fomentar la actividad económica pública y privada.</span></em></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><em><span style="color:black">b. Coordinación, orientación y evaluación de programas y servicios de ordenación y reconversión turística.</span></em></p> <p style="margin-left:40px"><em><span style="color:black"><strong>2.</strong> Las actividades inherentes a un centro integrado de servicios relacionados con la promoción&nbsp;</span></em><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em><span style="color:black">económica, social y cultural de la isla d'Eivissa mediante:</span></em></span></p> <p style="margin-left:80px"><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">a. </span><em>La gestión integral de eventos relacionados con la promoción económica, turística, social, deportiva y cultural, tanto de carácter público como privado (...)”.</em></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Asimismo, el encargo debe cumplir lo establecido en el Acuerdo de fiscalización limitada previa para la adaptación de los requisitos adicionales previstos en el acuerdo del Consejo de Ministros de 30 de mayo de 2008, modificado el 7 de julio de 2011, y el 20 de julio de 2018, respecto al ejercicio de la función interventora en régimen de requisitos básicos, adoptado por el Pleno del Consell Insular d'Eivissa en sesión de fecha 29-11-2018, en relación a los expedientes de encargos de gestión.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell Insular d'Eivissa destinará a la producción técnica del “Ciclo Familiar de Música y Teatro 2024” la cantidad máxima de <strong>396.968,40 €</strong> (trescientos noventa y seis mil novecientos setenta y ocho con cuarenta céntimos) por el encargo de gestión eventual y directa a FECOEV, en los mismos términos que se han detallado antes. Esta cantidad irá con cargo a la aplicación presupuestaria <strong>3370-2279900</strong> del presupuesto general del Consell Insular d'Eivissa para el año 2024, y tendrá el carácter de aportación máxima de los gastos que se realicen, en ejecución de las acciones objeto de este encargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">A tal efecto, con fecha 6 de enero de 2024, expediente núm. 2/2024000000004, se hizo el preceptivo RC a futuros que dota de crédito el encargo de gestión directa y eventual para llevar a cabo en la producción técnica y ejecución de dicho evento, que se celebrará en el Recinto Ferial entre los meses de enero y mayo de 2024.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En fecha 30 de diciembre de 2023 se publicó en el BOIB núm. 176 el Acuerdo de Presidencia de establecimiento de precio público para el «Ciclo familiar de música y teatro» del Consell Insular d'Eivissa, que se celebrará en el Recinto Ferial d'Eivissa entre los meses de enero y mayo de 2024.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">En fecha 11 de enero de 2024 se emite memoria técnica donde se concretan tanto las características de los trabajos a encargar, como la justificación, los plazos, el presupuesto, las formas de pago, la posibilidad de modificaciones y prórrogas, etc.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Visto el informe técnico favorable, de fecha 11 de enero de 2024 sobre los criterios económicos y de eficacia que justifican que se encargue a Ferias, Congresos y Eventos d'Eivissa, SAU (FECOEV) llevar a cabo la prestación del servicio para la producción técnica y ejecución del citado evento, que prevé la posibilidad de que el medio propio contrate prestaciones parciales con terceros, de que el importe de estas prestaciones no exceda del 50% de la cuantía del encargo, con las excepciones previstas en el artículo 32.7 de la Ley 9/2017 de 8 de noviembre, de contratos del sector público.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Asimismo, visto el informe jurídico favorable de fecha 11 de enero de 2024</span><strong>, </strong><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">con el visto bueno del secretario general de la corporación, en relación con el encargo de la gestión directa y eventual del Consell Insular d'Eivissa a un medio propio personificado, (Ferias, Congresos y Eventos d'Eivissa, S.A.U. (FECOEV) para llevar a cabo la producción técnica del “Ciclo Familiar de Música y Teatro 2024”).</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">En cuanto a la competencia para aprobar el encargo de gestión a un medio propio personificado, el artículo 28 de la citada Ley 4/2022, dispone que</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="color:black">1. Corresponden al consell executiu las siguientes atribuciones:</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="color:black">(...)</span></span></span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="color:black">h) Ejercer las competencias de órgano de contratación en todo tipo de contratos en los mismos casos que la legislación de contratos del sector público prevé para la Junta de Gobierno Local en los municipios de gran población<strong> </strong>, sin perjuicio de lo que pueda prever el reglamento orgánico.</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><span style="color:black">Por su parte, el apartado cuarto de la disposición adicional segunda de la Ley 9/2017, de 8 de noviembre, de contratos del Sector Público, dispone que</span></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><em><span style="color:black">4. En los municipios de gran población a que se refiere el artículo 121 de la Ley 7/1985, de 2 de abril, reguladora de las bases del régimen local, las competencias del órgano de contratación descritos en los apartados anteriores las ejercerá la junta de gobierno local, cualquiera que sea el importe del contrato o la duración del mismo, siendo competente el Pleno para aprobar los pliegos de cláusulas administrativas generales.</span></em></span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">De la valoración conjunta de ambas preceptas entienden que corresponde al Consell Executiu la aprobación de este encargo de gestión.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Visto, que este encargo de gestión a un medio propio personificado (Ferias, Congresos y Eventos d'Eivissa SAU, (FECOEV) se realizará de conformidad con la legislación vigente que sea de aplicación, y en todo caso, observando las prescripciones contenidas en los artículos, 11 y 86 Ley 40/2015, de 1 de octubre, del régimen jurídico del sector público y en los artículos 6 y 32 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Visto el punto 7 del apartado tercero del Decreto de Presidencia núm. 2023000467, Estructura del Gobierno del Consell Insular d'Eivissa y creación de Departamentos (BOIB núm. 88, de 29-06-2023), el artículo 28.1 de la mencionada&nbsp; </span><span style="background-color:white; color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Ley 4/2022, de 28 de junio, de consells insulars y el apartado cuarto de la disposición adicional segunda de la Ley 9/2017, de 8 de noviembre, de contratos del sector público.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black">Visto el informe propuesta favorable emitido por el gerente del Campamento de sa Cala des Jondal en fecha 11 de enero de 2024.</span></span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">En virtud de todo lo anterior y de lo que establece el artículo 72.d) del reglamento orgánico del Consell Insular d'Eivissa (BOIB núm. 136 de 18-09-2010, corrección en BOIB núm. 148, de 14-10-2010, modificación en BOIB núm. 48, de 16-04-2016), la consellera que suscribe, en virtud de las atribuciones que tengo conferidas por los Decretos de Presidencia 2023000467, de fecha 29 de junio de 2023, de estructura del Gobierno del Consell Insular d'Eivissa y creación de Departamentos y núm. </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">2023000472, de fecha 28 de junio de 2023, de nombramiento de las personas miembros del Consell Executiu y de las vicepresidencias del Consell Insular d'Eivissa </span><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">(ambos en el BOIB núm. 88, de 29-06-2023), y con carácter previo a la emisión del correspondiente informe de fiscalización previo, preceptivo y necesario, de la Intervención de la corporación, y para el caso de que dicho informe sea favorable y de conformidad, elevo al Consell Executiu del Consell Insular d'Eivissa, si lo estima adecuado, la siguiente</span></p> <p style="text-align:center"><strong><span style="color:black">PROPUESTA DE ACUERDO:</span></strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong><span style="color:black">Primero. El escudo del Consell Insular d'Eivissa deberá estar presente de forma destacada en todos los soportes publicitarios que se editen para promocionar los espectáculos. Antes de imprimir, editar o publicar cualquier material publicitario debe contar con el visto bueno del Departament de Joventut, Participació Ciutadana del Parc Insular de Serveis de “Sa Coma” y debe haber sido revisado por el Servicio de Normalización Lingüística.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>c.</strong> Queda prohibida cualquier forma de promoción o publicidad tanto en la cartelería como en el recinto que incite a las personas menores de edad, de forma directa o indirecta, al consumo de bebidas alcohólicas o tabaco.</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>d. </strong>Contar con un Plan de emergencia que contenga las medidas necesarias en materia de:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Vigilancia</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Ambulancias</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Limpieza</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Servicio de enfermería</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Control del acceso del público a las instalaciones los días de los espectáculos</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">- Medidas contra incendios</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>e.</strong> Habilitar<span style="line-height:1"> en la zona de público un espacio reservado, adaptado para personas con discapacidad, si procede.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="line-height:1"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>f.</strong> Hacerse cargo del estricto control del aforo de público, respetando la capacidad de aforo legal.</span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="line-height:1"><strong>g.</strong> Realizar to</span>dos los trámites administrativos y técnicos para conseguir la correspondiente autorización administrativa previa y preceptiva, para la celebración del evento.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:black"><strong>2. </strong>Cumplir lo establecido en la Ley 9/2017, de 8 de noviembre, de contratos del sector público, por la que se transponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consell 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014. Igualmente, para la realización del espectáculo, estará obligada al cumplimiento de la Ley 7/2014, de 26 de noviembre, de régimen jurídico de instalación, acceso y ejercicio de actividades de las Islas Baleares .</span></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>3. </strong>Cumplir lo establecido en la Ley 31/1995, de 8 de noviembre, de prevención de riesgos laborales, además de su desarrollo normativo y disposiciones relacionadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>4.</strong> Contratar los seguros que correspondan.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>5. </strong>Poner a disposición de las personas usuarias, en la recepción del recinto, hojas de reclamaciones y quejas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por su parte, el Consell Insular d'Eivissa se hará cargo únicamente de la venta de entradas de los diversos espectáculos, previa tramitación del preceptivo expediente de establecimiento de precios públicos de venta de entradas, y de la correspondiente liquidación ante la Sociedad General de Autores y Editores (SGAE).</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell Insular d'Eivissa quedará excluido de cualquier riesgo empresarial derivado de las acciones previstas al objeto de este encargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">FECOEV, SAU inhibirá al Consell Insular d'Eivissa de cualquier tipo de responsabilidad <span style="color:black">derivada </span>de la ejecución de las actividades objeto de este encargo.</span></p> <p><strong>2. Medio propio destinatario del encargo</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Ferias, Congresos y Eventos d'Eivissa, SAU (FECOEV), con NIF A07837602, es una sociedad mercantil de capital íntegramente público del Consell Insular d'Eivissa (que ha suscrito el 100% de capital), creada al amparo del artículo 103 de Real Decreto Legislativo 781/1986, de 18 de abril, por el que se aprueba el texto refundido de las Disposiciones Legales vigentes en materia de régimen local y artículos 89 y seg. del Reglamento de Servicios de las Corporaciones Locales, que adopta la forma de sociedad anónima (el artículo 1 de sus Estatutos vigentes publicados en el BOIB núm. 76, de 21-05-2015, corrección de errores en BOIB núm. 174, de 26 -11-2015; modificación en BOIB núm. 30, de 08-03-2018), que tiene entre su objeto social, la realización de las actividades precisas para planificar, proyectar, coordinar y gestionar con las administraciones públicas las actividades inherentes a un centro integrado de servicios relacionados con la promoción económica, social y cultural mediante la gestión integral de eventos relacionados con la promoción económica, turística, social, deportiva y cultural, así como al uso, gestión, explotación y administración de las instalaciones y de los bienes del recinto del edificio llamado Recinto Ferial d'Eivissa y del Hipódromo de Sant Rafel, así como otros que por acuerdo del Pleno del Consell Insular d'Eivissa se puedan adscribir en la sociedad, en alguna de las formas de gestión directa o indirecta previstas en la normativa (art. 2.2, letras </span><em>a </em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">y </span><em>c, </em><span style="font-family:&quot;Times New Roman&quot;,Times,serif">de sus Estatutos).</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">A tenor de lo establecido en el apartado tercero del artículo 1 bis de sus Estatutos, esta entidad tendrá la condición de medio propio del Consell Insular d'Eivissa</span><strong> </strong><span style="font-family:&quot;Times New Roman&quot;,Times,serif">siempre que se cumplan los requisitos legales para poder ser considerada como parte integrante del sector público. Más concretamente, tendrá la consideración de medio propio personalizado, respecto del Consell Insular si cumple lo establecido en el artículo 86 de la Ley 40/2015, de 1 de octubre, del régimen jurídico del sector público, y en el artículo 32 de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, por la que se transponen al ordenamiento jurídico español las directivas del Parlamento Europeo y del Consell 2014/23/UE y 2014/24/UE, de 26 de febrero de 2014.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">De conformidad con la instrucción de Secretaría del Consell Insular, aprobada por el Consell Executiu en fecha 13/05/2013, el Consell Insular puede encargar a FECOEV directamente la realización de actividades de su competencia por razones de eficacia. Asimismo, el presente encargo cumple lo establecido en el Acuerdo de fiscalización limitada previa para la adaptación de los requisitos adicionales previstos en el Acuerdo del Consejo de Ministros de 30 de mayo de 2008, modificado el 7 de julio de 2011, y el 20 de julio de 2018, respecto al ejercicio de la función interventora en régimen de requisitos básicos, adoptado por el Pleno del Consell Insular d'Eivissa en sesión de fecha 29/11/2018, en relación a los expedientes de encargos de gestión.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Visto que la citada empresa pública dispone de medios para poder ejecutar estas acciones de realización y producción del evento mencionado y, teniendo en cuenta que el Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” no cuenta con los medios técnicos y humanos idóneos para llevarlo a cabo, así como del espacio para la realización de los espectáculos objeto del encargo.</span></p> <p><span style="color:black; font-family:&quot;Times New Roman&quot;,Times,serif">Es por</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif"> todo lo anterior que el Consell Insular d'Eivissa, mediante el Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” ha propuesto que el Consell Insular d'Eivissa encargue a FECOEV la realización de las acciones previstas y necesarias para llevar a cabo la producción técnica y ejecución de los diversos espectáculos que forman parte del “Ciclo Familiar de Música y Teatro 2024”.</span></p> <p><strong>3. Justificación y necesidad</strong></p> <p><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif">De conformidad con el artículo 70.9 y 16 de la EAIB el Consell Insular d'Eivissa tiene competencias propias en materia del deporte, el ocio y la juventud , </span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">diseño y aplicación de políticas, planes y programas destinados a los niños y la juventud, </span><span style="background-color:white; font-family:&quot;Times New Roman&quot;,Times,serif">que ejerce desde que fue transferida la competencia mediante Ley 21/2006, de 15 de diciembre, de atribución de competencias a los consells de Menorca y d'Eivissa y Formentera en materia de juventud y ocio (BOIB núm. 184, de 23-12-2006), que establece la transferencia a los consells de Menorca y d'Eivissa y Formentera de las funciones reglamentaria, ejecutiva y de gestión en materia de juventud y ocio.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El artículo 4 de la mencionada Ley 21/2006, de 15 de diciembre, dice que los consells de Menorca y d'Eivissa y Formentera (desde el año 2007, Consell Insular d'Eivissa) ejercerán, dentro de su ámbito territorial y con sujeción al ordenamiento sectorial vigente, las funciones relativas a las actividades de ocio con niños y jóvenes, entre otros, programación y ejecución de actividades de tiempo libre infantil y juvenil. Igualmente en el artículo 9 de la misma Ley dice que los consells de Menorca y d'Eivissa y Formentera asumen, en su ámbito territorial, la promoción de actividades de desarrollo cultural dirigidas a jóvenes.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">El apartado tercero 7, del Decreto de Presidencia núm. 2023000467, Estructura del Gobierno del Consell Insular d'Eivissa y creación de Departamentos (BOIB núm. 88, de 29-06-2023) establece que las competencias del Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma” comprenden, entre otros:</span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><span style="color:#00000a"><em>c) La actividad competencial propia relativa a las actividades de ocio y tiempo libre, juventud y equipamientos juveniles y ordenación de estas actividades.</em></span></span></p> <p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>d) Este departamento también gestionará los servicios propios de su ámbito de actuación prestados en los distintos centros propiedad del Consell Insular.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Consell Insular d'Eivissa no cuenta con los medios propios suficientes para llevar a cabo la producción técnica y ejecución del “Ciclo Familiar de Música y Teatro 2024”. Sin embargo, el artículo 11.1 de la Ley 40/2015 de 1 de octubre de régimen jurídico del sector público, establece que</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><em>La realización de actividades de carácter material o técnico de la competencia de los órganos administrativos o de las entidades de derecho público puede encargarse a otros órganos o entidades de derecho público de la propia Administración o de otra, siempre que entre sus competencias estén estas actividades, por razones de eficacia o cuando no se posean los medios técnicos idóneos para ejercerlas (...).</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por otra parte, FECOEV, SAU es una sociedad mercantil de capital público del Consell Insular d'Eivissa, de acuerdo con el artículo 1 bis de sus Estatutos que “<em>tendrá la condición de medio propio del Consell Insular d'Eivissa (…)”. </em>&nbsp;Asimismo, el apartado 2 de este artículo establece que “<em>El Consell Insular d'Eivissa podrá encargar a la sociedad la ejecución de cualquier actuación material relacionada con el objeto social mencionado en el artículo 2 de los Estatutos sin que, por otra parte, la sociedad pueda participar en ninguna licitación de contratación pública convocada por la administración insular o sus entes instrumentales. (...)”.</em></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El artículo 2 de los citados Estatutos dispone que</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Constituye el objeto de la sociedad:</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>1. </strong>La realización de las actividades precisas para planificar, proyectar, coordinar y gestionar con las administraciones públicas, empresas y particulares las siguientes áreas de trabajo:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. Coordinación, impulso y di</span>rección técnica y facultativa de los procesos de reconversión y ordenación de actividades para impulsar la inversión y fomentar la actividad económica pública y privada.</p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px">b. Coordinación, orientación y<span style="font-family:Times New Roman,Times,serif; font-size:12px"> evaluación de programas y servicios de ordenación y reconversión turística.</span></p> <p style="margin-left:40px"><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>2.</strong> Las actividades inherentes a un centro integrado de servicios relacionados con la promoción económica, social y cultural de la isla d'Eivissa mediante:</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:Times New Roman,Times,serif; font-size:12px">a. La gestión integral de eventos relacionados con la promoción económica, turística, social, deportiva y cultural, tanto de carácter público como privado.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">b. El s</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">ervicio de mantenimiento de instalaciones y ajardinamiento público propiedad del Consell Insular d'Eivissa, siempre que éste lo requiera por la vía de encomienda de gestión o acuerdo de Pleno.</span></p> <p style="margin-bottom:0px; margin-left:80px; margin-right:0px; margin-top:0px"><span style="font-family:&quot;Times New Roman&quot;,Times,serif">c. El us</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">o, la gestión, l</span><span style="font-family:&quot;Times New Roman&quot;,Times,serif">a explotación y la administración de las instalaciones y de los bienes del recinto del edificio llamado Recinto Ferial de Eivissa y del Hipódromo de Sant Rafel, así como otros que por acuerdo de Pleno del Consell Insular d'Eivissa se puedan adscribir a la sociedad, en alguna de las formas de gestión directa o indirecta previstas en la normativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Asimismo, FECOEV, SAU dispone de las instalaciones necesarias y adecuadas para acoger el “Ciclo Familiar de Música y Teatro 2024”, con una estimación de participación de niños y sus familiares superior a los 7.000 usuarios.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Por eso, es voluntad del Consell Insular d'Eivissa, a través de su Departament de Joventut, Participació Ciutadana i del Parc Insular de Serveis de “Sa Coma”, fomentar todas aquellas iniciativas que en la isla supongan una promoción de actividades de ocio y de tiempo libre, tanto para residentes como para las personas visitantes, eventos de máximo nivel que supongan un beneficio cultural y lúdico y que favorezcan la promoción del ocio y del tiempo libre en sus diversos ámbitos y a su vez contribuir a la promoción y proyección exterior d'Eivissa, favoreciendo el disfrute de espectáculos con artistas diversos, y con esta finalidad quiere realizar el presente Encargo de gestión a FECOEV, SAU para la producción técnica y ejecución del “Ciclo Familiar de Música y Teatro” dirigido a los niños de la isla y sus familias, que se celebrará en el Recinto Ferial de Eivissa entre los meses de enero y mayo de 2024.</span></p> <div style="page-break-after:always"><span style="display:none">&nbsp;</span></div> <p><strong>​​​​​​​</strong><strong>4. Plazo de duración y extinción</strong></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">Las actuaciones a encargar se desarrollarán el día del evento, según el calendario establecido en el objeto de esta memoria técnica. No obstante, este encargo desarrollará sus efectos desde el momento de la notificación a la entidad encargada, lo que supondrá el orden de inicio de las actuaciones.</span></p> <p><span style="font-family:&quot;Times New Roman&quot;,Times,serif">La vigencia será hasta el día en que hayan quedado justificados todos los gastos ante el órgano gestor que realizará el seguimiento del encargo que, en cualquier caso, no podrá superar la fecha del 1 de </span><strong>septiembre de 2024.</strong></p> <p><strong>5. font-size:12px">directa a FECOEV, en los mismos términos antes detallados. Esta cantidad irá con cargo a la aplicación presupuestaria 3370-2279900 del presupuesto general del Consell Insular d'Eivissa para el año 2024, y tendrá el carácter de aportación máxima de los gastos que se realicen, en ejecución de las acciones objeto de este encargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En relación con el artículo 32.7 b) de la Ley 9/2017, de 8 de noviembre, de contratos del sector público, y conociendo los recursos con los que cuenta FECOEV y la posible necesidad de recurrir a la contratación de terceros para la ejecución parcial del encargo, se ha previsto que en caso de tener que contratar con terceros cualquier prestación parcial, éstas no superarán en ningún momento el 50% de la cuantía del encargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>6. Posibilidad de prórroga o modificaciones</strong></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Si mientras se está ejecutando el encargo de gestión se producen circunstancias que así lo aconsejen, el Consell Insular d'Eivissa podrá modificar el encargo inicial bien a iniciativa propia, bien a petición del propio medio, siempre y cuando esta modificación quede acreditada y justificada, y se produzca durante el plazo de duración del encargo y no afecte a actuaciones ya realizadas.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Esta modificación supondrá la tramitación del correspondiente expediente administrativo que requerirá de los mismos actos que el expediente inicial.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">En cuanto a la posibilidad de prórroga del encargo deberá justificarse que es necesaria, pudiendo realizarse en los mismos términos establecidos para la modificación del mismo, siempre antes del vencimiento de este encargo.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>8. Medidas de protección y seguridad</strong></span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">Los espectáculos deberán realizarse siguiendo las medidas de seguridad vigentes según la legislación vigente y de prevención de riesgos que las autoridades sanitarias dicten en el momento de celebración del espectáculo, si procede.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px"><strong>9.
