    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;Por Resolución de esta Alcaldía de día&lt;/span&gt;&lt;span style="color:#000000"&gt; 18 de enero de 2024&lt;/span&gt;&lt;span style="color:#000000"&gt;, se ha dictado &lt;/span&gt;&lt;span style="color:#000000"&gt;lo&lt;/span&gt;&lt;span style="color:#000000"&gt; siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Antecedentes &lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; Vista la convocatoria del proceso de estabilización por el sistema concurso de méritos para la cobertura de &lt;span style="color:#000000"&gt;dos&lt;/span&gt; (2) plazas de personal funcionario de carrera de la Escala administración especial, subescala Técnica, clase auxiliar, especialidad informática de sistemas del Grupo C, subgrupo C1, del &lt;span style="color:#000000"&gt;Ayuntamiento&lt;/span&gt; de Llucmajor las bases de la cual se publicaron en e BOIB nº 154 de 26 de noviembre de 2022 y el anuncio de la cual se publicó en el BOE nº 307 de 23 de &lt;span style="color:#000000"&gt;diciembre&lt;/span&gt; de 2022. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segon.-&lt;/strong&gt; Visto el Decreto 2023004409 de día 30 de octubre de 2023 en el cual se establece que &lt;span style="color:#000000"&gt;los&lt;/span&gt; Sres. Jaime Garcias Garau &lt;span style="color:#000000"&gt;y&lt;/span&gt; Francisco José Enseñat Miró han superado el proceso selectivo del concurso extraordinario de méritos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Visto el anuncio de valoración de méritos y requisitos de las personas aspirantes, realizado por el Tribunal el día 19 de septiembre de 2023 y publicado el día 21 de septiembre de 2023. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;En consecuencia,&lt;strong&gt; RESUELVO:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.-&lt;/strong&gt; &lt;span style="color:#000000"&gt;Nombrar&lt;/span&gt; a:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;funcionarios de carrera informático de sistemas, Escala administración especial, subescala Técnica, clase auxiliar, especialidad informática de sistemas del Grupo C, subgrupo C1, derivada de la Oferta de Ocupación Pública Extraordinaria de 2022 del Ayuntamiento de Llucmajor. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.-&lt;/strong&gt; Publicar esta Resolución en el Boletín Oficial de las Islas Baleares &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Tercero.-&lt;/strong&gt; Requerir a los Sres. Jaime Garcias Garau y Francisco José Enseñat Miró para que tomen posesión en el plazo máximo de tres días hábiles, &lt;span style="color:#000000"&gt;a contar&lt;/span&gt; a partir del día siguiente a la publicación de esta Resolución en el Boletín Oficial de las Islas Baleares. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto&lt;/strong&gt;&lt;/span&gt;&lt;strong&gt;.-&lt;/strong&gt; Dar traslado de esta Resolución al Pleno del Ayuntamiento, así como a la Unidad de Recursos Humanos para su conocimiento y efectos. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Contra esta resoluci&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ón los interesados podrán interponer un recurso potestativo de reposición ante este Ayuntamiento, en el plazo de un mes a contar del día siguiente de la publicación, &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;de &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;conformidad con lo dispuesto en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;También podrán interponer alternativamente un recurso contencioso-administrativo ante el Juzgado de lo Contencioso-administrativo con sede en Palma, en el plazo de dos meses, de conformidad con lo establecido en los artículos 30, 112.3 y 114.1 c) de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas, y 8, 10 y 46 de la Ley 29/1998, de 13 de julio, reguladora de la jurisdicción contencioso-administrativa.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;En caso de optar por interponer el recurso de reposición, no se podrá interponer un recurso contencioso-administrativo hasta que se haya notificado la resolución expresa del recurso de reposición o haya transcurrido un mes desde su interposición sin haber recibido la notificación, fecha en que se podrá entender desestimado por silencio administrativo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Todo &lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;ello&lt;/em&gt;&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;em&gt; sin perjuicio de que puedan interponer cualquier otro recurso que estimen oportuno.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
