    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El apartado&amp;nbsp;8.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 14&amp;nbsp;de abril&amp;nbsp;de 2023&amp;nbsp;por la&amp;nbsp;que se convocan, para el ejercicio&amp;nbsp;2016,&amp;nbsp;ayudas para el fomento de la producción integrada,&amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 8&amp;nbsp;de enero&amp;nbsp;de 2024, firmó la siguiente &amp;nbsp;resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril, por la que se aprueba la convocatoria de las ayudas para el Fomento de las razas autóctonas en peligro de extinción para el año para el 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes de la convocatoria terminó el día 30/06/2023, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 299 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de estas ayudas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;El 18&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2/2023 se formuló una propuesta provisional denegatoria por 1 expediente indicado en el anexo I, que fue publicada en la página web del FOGAIBA el 1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;8&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;2&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/2023 hasta el &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;05&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;/&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;0&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1/202&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;4&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;. &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;Se ha avisado a los afectados mediante &amp;nbsp;un sms del 19/12/2023. No se han presentado alegaciones a esta propuesta.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril, por la que se aprueba la convocatoria de las ayudas para el Fomento de las razas autóctonas en peligro de extinción año para el año 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;La Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Una vez evaluadas las solicitudes de ayuda por los órganos gestores se ha detectado que el solicitante indicado en el anexo I no ha realizado la declaración anual obligatoria del censo de la explotación 051 IB 5843 del año 2022 y 2023, por tanto, incumple la normativa de identificación y registro.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;Informe y Propuesta &lt;/em&gt;&lt;em&gt;de denegación &lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y proposo al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;1.Denegar la solicitud presentada por &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l interesado &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;que figura &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;en &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;e&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;l Anexo I&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&amp;nbsp;&lt;/em&gt;&lt;em&gt;&lt;em&gt;por no tener animales inscritos en su explotación 051 IB 5843.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:114%"&gt;&lt;em&gt;&lt;em&gt;2. Contra esta resolución -que no agota la vía administrativa-. Puede interponerse recurso de alzada ante la consellera de Agricultura Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
