&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Mediante el Acuerdo del Consejo de Administración de la Entidad Pública Empresarial de Telecomunicaciones e Innovación de las Illes Balears (IBETEC) de 23 de mayo de 2022, se aprobó la oferta pública de estabilización correspondiente al personal laboral del IBETEC, en el marco de la Ley 20/2021, de 28 de diciembre, de medidas urgentes para la reducción de la temporalidad en el empleo público (BOIB núm. 68, de 26 de mayo de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Mediante la Resolución del director gerente del IBETEC de 20 de diciembre de 2022, se aprobó la convocatoria del proceso de estabilización por concurso oposición para cubrir las plazas de personal laboral del IBETEC (BOIB núm. 168, de 27 de diciembre de 2022).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Mediante la Resolución del director gerente del IBETEC de 30 de octubre de 2023, se modificaron los apartados 19.1.3 y 19.2 del anexo 2 de las bases específicas que constan en la Resolución del director gerente del IBETEC de 20 de diciembre de 2022 por la cual se aprueba la convocatoria del proceso de estabilización por concurso oposición para cubrir las plazas de personal laboral del IBETEC (BOIB núm. 150, de 4 de noviembre de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el apartado 19.2 del anexo 2 de esta convocatoria (según la modificación realizada por la mencionada Resolución de 30 de octubre de 2023), los tribunales encargados de la selección serán nombrados por la secretaria general de la Consejería de Economía, Hacienda e Innovación y tienen la consideración de órganos dependientes de su autoridad.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Además, de conformidad con el apartado mencionado, el nombramiento de los miembros de los tribunales se tiene que publicar en el &lt;/span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; y en la página web del IBETEC (&lt;/span&gt;&lt;em&gt;www.ibetec.cat&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;) una vez finalizado el periodo de presentación de instancias.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el apartado 19.1.2 sobre la composición de los órganos de selección, los tribunales tienen que estar constituidos, como mínimo, por tres miembros titulares, con el mismo número de suplentes. Se tiene que constituir un tribunal para cada grupo de los previstos en el artículo 15 del Convenio colectivo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Todos los miembros de los tribunales tienen que poseer una titulación académica de igual o de superior nivel que el exigido a los aspirantes para el ingreso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;La mitad más uno tienen que poseer una titulación académica correspondiente a la misma área de conocimientos que la exigida a los aspirantes, si esta es específica.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Asimismo, el apartado 19.1.3 (según la modificación realizada por la mencionada Resolución de 30 de octubre de 2023) establece que la determinación de la composición de los tribunales se tiene que llevar a cabo de acuerdo con las siguientes normas:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;em&gt;&lt;span style="color:black"&gt;a)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; El presidente o presidenta será designado libremente por la secretaria general de la Consejería de Economía, Hacienda e Innovación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;b)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; Los vocales tienen que ser nombrados por sorteo entre el personal laboral fijo en situación de servicio activo en el IBETEC que pertenezcan al grupo de que se trate, si lo hay. En caso contrario, pueden ser de otro grupo, siempre respetando lo que establece la base 19.1.2. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;span style="color:black"&gt;El sorteo se tiene que hacer con la participación de la representación del personal.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;c)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; En caso de que el IBETEC no disponga de personal suficiente para nombrar a los vocales, se designarán a propuesta de la secretaria general de la Consejería de Economía, Hacienda e Innovación de entre el personal funcionario de carrera adscrito a la Consejería de Economía, Hacienda e Innovación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;&lt;em&gt;&lt;span style="color:black"&gt;d)&lt;/span&gt;&lt;/em&gt;&lt;span style="color:black"&gt; La secretaría corresponderá a la persona designada por votación del tribunal de entre las personas designadas como vocales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Igualmente, regula que la composición de los órganos de selección se tiene que ajustar, salvo razones fundamentadas y objetivas, debidamente motivadas, al criterio de paridad entre hombres y mujeres con capacitación, competencia y preparación adecuadas. Se entiende por representación equilibrada la presencia de mujeres y hombres de forma que ningún sexo no supere el 60 % del conjunto de personas a que se refiere ni sea inferior al 40 %.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;De acuerdo con el apartado 12, la fase de oposición consta de un solo ejercicio con carácter eliminatorio, con una prueba de tipo test de un temario referido únicamente a la parte general, relacionado con las funciones comunes propias de la actividad administrativa, que es el mismo para cada grupo de clasificación, distinguiendo los ejercicios cuando se trate de plazas de administración general y de plazas de administración especial.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;El anexo 3 de la convocatoria fija los ejercicios y los temarios comunes por grupos de titulación tanto para la administración general como para la administración especial.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;4. El 9 de febrero de 2023 finalizó el periodo de presentación de solicitudes para participar en este proceso.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;5. El IBETEC no dispone de personal suficiente para nombrar a los vocales de los tribunales calificadores de este proceso, por lo que corresponde a la secretaria general de la Consejería de Economía, Hacienda e Innovación nombrarlos, de acuerdo con los apartados 19.1.3.&lt;/span&gt;&lt;em&gt;c)&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; y 19.2 de las bases específicas de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. El anexo 1 del Decreto 12/2023, de 10 de julio, de la presidenta de las Illes Balears, por el que se establecen las competencias y la estructura orgánica básica de las consejerías de la Administración de la Comunidad Autónoma de las Illes Balears, según el cual la Entidad Pública Empresarial de Telecomunicaciones e Innovación de las Illes Balears (IBETEC) está adscrita a la Consejería de Economía, Hacienda e Innovación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Los apartados 19.1 y 19.2 de las bases específicas de la convocatoria del proceso de estabilización por concurso oposición para cubrir las plazas de personal laboral de la Entidad Pública Empresarial de Telecomunicaciones e Innovación de las Illes Balears (IBETEC), publicada en el BOIB núm. 168, de 27 de diciembre de 2022, de acuerdo con la modificación publicada en el BOIB núm.&amp;nbsp;150, de 4 de noviembre de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Por todo esto, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. Nombrar a los miembros de cada uno de los tribunales calificadores, para cada uno de los grupos profesionales, del proceso de estabilización por concurso oposición para cubrir las plazas de personal laboral de la Entidad Pública Empresarial de Telecomunicaciones e Innovación de las Illes Balears (IBETEC), convocado por la Resolución de 20 de diciembre de 2022, en los términos establecidos en el anexo de esta Resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2. Informar a las personas nombradas de la obligación de abstenerse de intervenir en el proceso selectivo si concurre alguna de las circunstancias previstas en el artículo 23 de la Ley 40/2015, de 1 de octubre, de Régimen Jurídico del Sector Público, y en el apartado 19.1.4 de las bases específicas de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;3. Publicar en el &lt;/span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; y en la página web del IBETEC (&lt;/span&gt;&lt;em&gt;www.ibetec.cat&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;) esta Resolución, la cual desplegará efectos desde el 2 de enero de 2024.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Contra esta Resolución, que no agota la vía administrativa, se puede interponer un recurso de alzada ante el consejero de Economía, Hacienda e Innovación, en el plazo de un mes a contar desde el día siguiente de la publicación en el &lt;/span&gt;&lt;em&gt;Boletín Oficial de las Illes Balears&lt;/em&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;, de acuerdo con el artículo 58 de la Ley 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears, y los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, sin perjuicio de interponer cualquier otro que se considere pertinente.&lt;/span&gt;&lt;/p&gt;
