&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Pozos de abastecimiento de agua potable y concesiones»&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;2&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. Esta Alcaldía tiene atribuida por ley la facultad de delegar determinadas atribuciones, de acuerdo con el artículo 21.3 de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Razones de oportunidad y conveniencia para la agilización y mejora del servicio, aconseja delegar las atribuciones de áreas que se dirán a continuación y que difieren de las atribuidas inicialmente mediante el Decreto 1415/2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;3. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;La delegación atribuida inicialmente por medio del Decreto 1415/2023, se configuraba como una delegación genérica dada la designación de segundo teniente de alcalde, a favor del concejal &lt;/span&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sr. Eugenio Garrido Vivas.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Sin embargo, la actual delegación se configura como especial, dado el cese como teniente de alcalde del sr. Garrido mediante el Decreto 24/2024 de fecha 05 de enero.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En consecuencia, de acuerdo con los artículos 21.3 de la LRBRL y 43, 44, 120 y 121 del Reglamento de organización, funcionamiento y régimen jurídico de las Entidades Locales,&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mantenimiento de vías públicas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mantenimiento de mobiliario urbano&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Mantenimiento de caminos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Limpieza viaria y de edificios municipales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Limpieza y mantenimiento de jardines y parques&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Limpieza de playas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Gestión de recogida de residuos urbanos&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Organización y explotación de playas&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Red de alcantarillado y pluviales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Red de agua potable&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;em&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dirección de brigada municipal&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/em&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Tercero.- &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Las delegaciones mencionadas comprenden tanto las facultades de dirección interna de los servicios, la instrucción y propuesta de resolución de los expedientes de su ámbito de actuación así como los de gestionarlos en general, pero sin incluir la facultad de resolver mediante actos administrativos que afecten a terceros.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; De conformidad con lo dispuesto en el artículo 44 del Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales, aprobar por Real Decreto 2568/1986, de 28 de noviembre, estas delegaciones tendrán efecto desde el día siguiente a la fecha de notificación de este Decreto a los/las concejales/as afectados/as y serán de carácter indefinido, sin perjuicio de la potestad de advocación de esta Alcaldía.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En caso de ausencia, vacante enfermedad o cualquier otro impedimento de los/las concejales/as delegados/as, esta Alcaldía asumirá, directa y automáticamente, las competencias delegadas, como titular de la competencia originaria, entendiéndose a estos efectos ejercitada la potestad de advocación en base a la presente Resolución, sin necesidad de nueva resolución expresa en este sentido.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinto.- &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Notificar esta Resolución a los/as concejales/as afectados/as, entendiéndose aceptada la competencia delegada de forma tácita, si en el plazo de 24 horas siguientes no se manifiesta nada en contra o se hace uso de la delegación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Sexto.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Las delegaciones conferidas requerirán para su eficacia la aceptación de concejal/a delegado/a, se publicarán en el BOIB y de ellas se dará cuenta al Pleno del Ayuntamiento en la primera sesión que tenga lugar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptimo.-&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El/la concejal/a delegado/a queda obligado/da a informar a esta Alcaldía sobre la gestión y las disposiciones que dicte, y previamente, de las decisiones de trascendencia en los términos previstos en el artículo 115 del ROF.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Octavo. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Dicha delegación se ejercerá en régimen de dedicación parcial de un 50% de la jornada, de acuerdo con el Decreto de alcaldía 2885/2023 el cual después efectos desde el 1 de enero de 2024, con unas retribuciones de acuerdo con lo establecido en las bases de ejecución de los presupuestos vigentes en cada momento. Este régimen de dedicación será objeto de publicación de acuerdo con el artículo 75 de la ley 7/85, de 2 de abril reguladora de las bases de régimen local y el artículo 8.1.f) de la ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En lo no previsto en esta resolución regirán la Ley 7/1985, de 2 de abril, reguladora de bases de régimen local; la Ley 20/2006, de 15 de diciembre, municipal y de régimen local de las Illes Balears, y el Reglamento de organización, funcionamiento y régimen jurídico de las entidades locales, en el marco de las reglas que para las delegaciones se establecen a dichas normas.»&lt;/span&gt;&lt;/p&gt;
