&lt;p&gt;&lt;strong&gt;«Antecedentes&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1.&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;En fecha 4 de abril de 2023, el consejero&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; ejecutivo de Transición, Turismo y Deportes aprobó la convocatoria de subvenciones dirigida a las asociaciones de familias de alumnos para&lt;/span&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; la organización de actividades físicas y/o deportivas extraescolares dentro del curso escolar 2022/2023. El extracto de esta convocatoria se publicó en el BOIB nº. 54, de 27 de abril de 2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;2. La instrucción del procedimiento de concesión de las subvenciones se ha realizado por la secretaría técnica del Departamento de Medio Ambiente, Medio Rural y Deportes, a través de la Dirección Insular de Deportes. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;Los informes individuales del órgano instructor determinan que los beneficiarios cumplen todos los requisitos para acceder a las subvenciones y han servido de base para elaborar la propuesta de resolución de concesión y reconocimiento de obligaciones de subvenciones, por un importe total de 5.439,90 €. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:normal"&gt;3. En fecha 31 de mayo de 2023 finalizó el plazo de presentación de solicitudes, y presentaron solicitud de subvención junto con la documentación justificativa un total de 13 asociaciones, en relación a los gastos correspondientes a las actuaciones realizadas. Consta en el expediente los informes de concesión y justificación relativo a la documentación justificativa presentada por las asociaciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. La existencia de crédito adecuado y suficiente queda garantizado en la aplicación presupuestaria 30.34101.48901 del presupuesto 2023 del Consejo de Mallorca.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Visto el informe jurídico favorable a la concesión y reconocimiento de obligaciones a favor de diversas entidades en el marco de la convocatoria mencionada&lt;span style="color:black"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;6. Visto que se somete el expediente a la fiscalización previa de la Intervención Delegada de la Misericordia. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;1. La Ordenanza general de subvenciones del Consejo de Mallorca aprobada el día 23 de diciembre de 2016 (BOIB nº. 21, de 18 de febrero de 2017) y modificada por Acuerdo del Pleno de 14 de junio de 2018 (BOIB nº. 96, de 4 de agosto de 2018).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Ley 38/2003, de 17 de noviembre, General de subvenciones y el real Decreto 887/2006, de 21 de julio, por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cual se aprueba el reglamento de la Ley General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La convocatoria de subvenciones dirigida a las asociaciones de familias de alumnos para&lt;span style="display:none"&gt;&amp;lt;A[para|por]&amp;gt;&lt;/span&gt; la organización de actividades físicas y/ o deportivas extraescolares dentro del curso escolar 2022/2023.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De acuerdo con el decreto de Presidencia del Consejo de Mallorca (BOIB nº. 106, de 29 de julio de 2023) que establece las competencias de los departamentos del Consejo de Mallorca, corresponde al vicepresidente segundo y consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo del Departamento de Medio Ambiente, Medio Rural y Deportes las competencias en materia de deporte. &lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. El art. 33.2 k) de la Ley 4/2022, de 28 de junio, de consejos insulares (BOIB nº. 88, de 7 de julio de 2022), corresponde a los consejeros&lt;span style="display:none"&gt;&amp;lt;A[consejeros|consellers]&amp;gt;&lt;/span&gt; ejecutes como titulares de sus departamentos las atribuciones de resolver las convocatorias de ayudas y subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. El art. 39.2 h) del Reglamento orgánico del Consejo de Mallorca (BOIB nº. 89, de 19 de julio de 2018), corresponde a los consejeros&lt;span style="display:none"&gt;&amp;lt;A[consejeros|consellers]&amp;gt;&lt;/span&gt; ejecutivos y consejeras&lt;span style="display:none"&gt;&amp;lt;A[consejeras|conselleres]&amp;gt;&lt;/span&gt; ejecutivas reconocer y liquidar las obligaciones propias de los servicios del departamento y solicitar al Departamento de Hacienda que ordene los pagos correspondientes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:white"&gt;Por todo lo expuesto, la consejera&lt;span style="display:none"&gt;&amp;lt;A[consejera|consellera]&amp;gt;&lt;/span&gt; ejecutiva de Promoción Económica y Desarrollo Local, por suplencia del consejero&lt;span style="display:none"&gt;&amp;lt;A[consejero|conseller]&amp;gt;&lt;/span&gt; ejecutivo de Medio Ambiente, Medio Rural y Deportes; de acuerdo con el Decreto de la Presidencia del Consejo Insular de Mallorca de 28 de julio de 2023 por&lt;span style="display:none"&gt;&amp;lt;A[por|para]&amp;gt;&lt;/span&gt; el cual se establecen las suplencias de los consejeros&lt;span style="display:none"&gt;&amp;lt;A[consejeros|consellers]&amp;gt;&lt;/span&gt; ejecutivos y consejeras&lt;span style="display:none"&gt;&amp;lt;A[consejeras|conselleres]&amp;gt;&lt;/span&gt; ejecutivas dicta la siguiente:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
