    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. En el Boletín Oficial de las Illes Balears (BOIB) n.º 95, de 11 de julio de 2023, se publicó la Resolución del presidente del Instituto de Industrias Culturales de las Illes Balears de 6 de julio de 2023 por la que se convocan las subvenciones para apoyar la aceleración de las industrias culturales y creativas de las Illes Balears en el marco del Plan de Recuperación, Transformación y Resiliencia (financiado por la Unión Europea – Next Generation EU).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. En el plazo establecido en el apartado 7.1 de la convocatoria ―es decir, del 13 al 30 de julio de 2023 (ambos incluidos)―, el Instituto de Industrias Culturales de las Illes Balears (ICIB) recibió un total de diecisiete solicitudes.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Como consecuencia de un problema técnico con el trámite telemático que tuvo lugar entre las 23.09 h del 30 de julio de 2023 y las 11.00 h del 31 de julio de 2023, y una vez efectuadas las comprobaciones previas oportunas, el ICIB tuvo que admitir una solicitud presentada el día 31 de julio por la imposibilidad constatada de registrarla en el plazo previsto.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. De acuerdo con el apartado 10 de la convocatoria, una vez finalizado el plazo de presentación de solicitudes, la Comisión Evaluadora valoró los proyectos solicitados según los criterios de valoración fijados en el punto 27 del anexo 1.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. De conformidad con el apartado 13.1 de la convocatoria, la Comisión Evaluadora se reunió el día 2 de noviembre de 2023 para examinar las solicitudes presentadas y, posteriormente, extendió el acta de la sesión, a la cual se adjuntó el informe que sirvió de base para dictar la Propuesta de resolución.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. En fecha 23 de noviembre de 2023, el presidente del ICIB dictó la Propuesta de resolución de esta convocatoria de ayudas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;7. El día 24 de noviembre de 2023, se publicó la Propuesta de resolución en la Sede Electrónica de la CAIB.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;8. De acuerdo con el apartado 14.4 y 14.5 de la convocatoria, los beneficiarios deben comunicar al órgano instructor la aceptación o la renuncia respecto a la subvención propuesta en el plazo de cinco días hábiles a contar desde la publicación de la Propuesta de resolución en la web del ICIB. En cualquier caso, la aceptación se entenderá producida automáticamente si no se hace constar lo contrario en el plazo de diez días hábiles a contar desde el día siguiente de su publicación en la página web.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9. De acuerdo con el apartado 14.3 de la convocatoria, una vez publicada la Propuesta de resolución, los solicitantes disponen de un plazo de diez días hábiles para formular alegaciones. Así, en el plazo mencionado, se presentaron las alegaciones siguientes:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.1. La Associació Xarxa Cinema presentó una alegación en relación con el expediente ACC 15 2023, en que solicita la inclusión de la entidad como posible beneficiaria de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.2. Carmen Vidal Balanzat presentó una alegación en relación con el expediente ACC 10 2023, en que acredita el cumplimiento de los apartados 5.3 y 5.6 de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.3. Cines Mallorquines, SL, presentó una alegación en relación con el expediente ACC 8 2023, en que argumenta el cumplimiento de los apartados 1.3 y 2.3 de la convocatoria y solicita la admisión de la solicitud.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.4. Iguana Teatre, SL, presentó una alegación en relación con el expediente ACC 1 y 2 2023, en que argumenta el cumplimiento de los apartados 1.3 y 2.3 de la convocatoria y solicita la admisión de la solicitud.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;9.5. Marta Jiménez Jiménez presentó una alegación en relación con el expediente ACC 11 2023, en que solicita la modificación de la cantidad concedida de la ayuda.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10. Respecto a las alegaciones formuladas, se acordó lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.1. Alegación sobre el expediente ACC 15 2023: se estima la alegación y se admite la solicitud. La Comisión Evaluadora revisa y valora la documentación presentada de acuerdo con los criterios de valoración establecidos en el apartado 27 de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.2. Alegación sobre el expediente ACC 10 2023: se estima la alegación y se admite la solicitud. La Comisión Evaluadora revisa y valora la documentación presentada de acuerdo con los criterios de valoración establecidos en el apartado 27 de la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.3. Alegación sobre el expediente ACC 8 2023: se desestima la alegación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.4. Alegación sobre el expediente ACC 1 y 2 2023: se desestima la alegación.&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;10.5. Alegación sobre el expediente ACC 11 2023: se estima la alegación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;11. El personal del ICIB ha comprobado que las personas beneficiarias cumplen los requisitos que la normativa establece para poder recibir subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Consideraciones jurídicas&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones (BOE n.º 276, de 18 de noviembre de 2003).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el texto refundido de la Ley de Subvenciones (BOIB n.º 196, de 31 de diciembre de 2005).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. La Orden de la consejera de Educación y Cultura de 1 de julio de 2009 por la que se establecen las bases reguladoras de las subvenciones en materia de educación y cultura (BOIB n.º 100, de 11 de julio de 2009).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. El Decreto 50/2018, de 21 de diciembre, por el que se aprueban los Estatutos del Instituto de Industrias Culturales de las Illes Balears (BOIB n.º 160, de 22 de diciembre de 2018; corrección de errores: BOIB n.º 6, de 12 de enero de 2019). De acuerdo con el artículo 19.9 de los Estatutos del ICIB, en el caso devacante, ausencia, enfermedad o cualquier otro impedimento para actuar del director gerente, sus funciones les asumirá el presidente, sin que tenga derecho a percibir retribución alguna por este concepto. El presidente podrá delegar las funciones del director gerente en un miembro del Consejo de Dirección, sin que tenga derecho a percibir retribución alguna por este concepto.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. La Resolución del presidente del Instituto de Industrias Culturales de las Illes Balears de 24 de octubre de 2023 por la que se delegan les funciones de director gerente en la directora general de Cultura, como miembro del Consejo de Dirección del ente (BOIB n.º 147, de 28 de octubre de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;6. La Resolución del presidente del Instituto de Industrias Culturales de las Illes Balears de 6 de julio de 2023 por la que se convocan las subvenciones para apoyar la aceleración de las industrias culturales y creativas de las Illes Balears en el marco del Plan de Recuperación, Transformación y Resiliencia (financiado por la Unión Europea – Next Generation EU) (BOIB n.º 95, de 11 de julio de 2023).&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Por todo ello, dicto la siguiente&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Resolución&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;1. Aprobar y conceder subvenciones por el importe total de 157.275,42 € a favor de los beneficiarios incluidos en el anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;2. Autorizar y disponer el gasto indicado para cada uno de los beneficiarios con cargo a los capítulos 4 y 7 del presupuesto del ICIB, con los importes detallados en el anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;3. Excluir de la concesión de subvenciones las solicitudes indicadas en el anexo.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;4. Informar a los beneficiarios de que la subvención se debe justificar en los términos establecidos en la convocatoria.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;5. Publicar esta Resolución en el Boletín Oficial de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Interposición de recursos&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Contra esta Resolución, que agota la vía administrativa, podrá interponerse un recurso potestativo de reposición ante el presidente del Instituto de Industrias Culturales de las Illes Balears, en el plazo de un mes a contar a partir del día siguiente de su publicación en el Boletín Oficial de las Illes Balears, de acuerdo con el artículo 124 de la Ley 39/2015, de 1 de octubre, del ProcedimientoAdministrativo Común de las Administraciones Públicas, y el artículo 57 de laLey 3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;También podrá interponerse directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso-administrativo del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses a contar desde el día siguiente de la notificación, de acuerdo con el artículo 46 de la Ley 29/1998, de 13 de julio, Reguladora de la Jurisdicción Contencioso-administrativa.&lt;/span&gt;&lt;/p&gt;
