font-size:12px">Contra el acuerdo plenario, que pone fin a la vía administrativa, los interesados podrán interponer alternativamente o recurso de reposición potestativo ante el Pleno del Ayuntamiento, en el plazo de un mes a contar desde el día siguiente al de la recepción de la notificación, en conformidad con los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, o recurso contencioso-administrativo, ante el Juzgado del Contencioso-Administrativo, en el plazo de dos meses, a contar desde el día siguiente al de la recepción de la notificación, en conformidad con el artículo 46 de la Ley 29/1998, de 13 de julio, de la Jurisdicción Contencioso-Administrativa.</span></p> <p><span style="font-family:Times New Roman,Times,serif; font-size:12px">El Artículo 123,2 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, advierte que, si se optara para interponer el recurso de reposición potestativo no podrá interponer recurso contencioso-administrativo hasta que aquel sea resuelto expresamente o se vaya a producir su desestimación por silencio.
