&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;"&lt;strong&gt;CONCURSO DE BELENES PARA PARTICULARES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#202124"&gt;&lt;strong&gt;&lt;span style="display:block; line-height:1.6; margin-bottom:0px; margin-top:0px"&gt; &lt;/span&gt;BASES GENERALES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;1. OBJETO Y FINALIDAD&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El objeto de esta convocatoria, promovida por el Ayuntamiento de Andratx, tiene como misión la preservación de las tradiciones navideñas y el estimulo de la participación ciudadana durante las fiestas de Navidad.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Con este propósito, se abre un concurso de Belenes destinado a los particulares, con una cordial invitación a todos los ciudadanos para que tomen parte.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;2. DESTINATARIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Podrán participar en el concurso todas aquellas personas residentes en el término municipal de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los participantes tendrán que cumplir todos los requisitos establecidos en el artículo 13 de la Ley 38/2003, de 17 de noviembre, Ley General de Subvenciones. Se destaca la necesidad de encontrarse al corriente con las obligaciones tributarias ante la Seguridad Social, la Administración pública de la Comunidad Autónoma, la Agencia Estatal de Administración Tributaria (AEAT) y el Ayuntamiento de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La Tesorería Municipal del Ayuntamiento de Andratx expedirá, de oficio, una certificación que acreditará si los solicitantes cumplen con sus obligaciones fiscales para con este Ayuntamiento y si tienen o no deudas pendientes con el mismo, ya sea por conceptos tributarios o no tributarios.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;3. BASES REGULADORAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para todos los casos no previstos en esta convocatoria será de aplicación:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ley 38/2023, de 17 de noviembre, general de subvenciones (BOIB 276, de 18 de noviembre de 2003).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Real Decreto 887/2006, por el que se aprueba el reglamento que desarrolla la Ley General de Subvenciones (BOIB 176, de 25 de julio de 2006).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas (BOE 236. de 2 de octubre de 2015).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Ordenanza general de subvenciones de Andratx 2017 (BOIB 47, de 20 de abril de 2017).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Resto de normativa que resulte de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;4. CRÉDITO PRESUPUESTARIO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Durante el ejercicio presupuestario 2024, se destina la cantidad de 700 euros (€) a las subvenciones objeto de esta convocatoria, con cargo a la aplicación presupuestaria 933.22609 TRADICIONES.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;5. REQUISITOS Y CONDICIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Se priorizará que la ubicación de los Belenes sea visible desde la calle (principalmente ventanas, portales, etc.). Asimismo, podrá localizarse en el interior de las viviendas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los belenes que se presenten guardarán lo debido respecto a que representan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los belenes permanecerán montados durante el período mínimo comprendido entre el día 22 de diciembre de 2023 hasta el 5 de enero de 2024, ambos incluidos.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los participantes deberán ceder, siempre que estén de acuerdo y con carácter no exclusivo, los derechos de imagen de las fotografías de sus belenes, con carácter indefinido, a favor del Ayuntamiento de Andratx a efectos de su difusión por cualquier medio.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;6. CATEGORÍAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Como novedad de este año, las diversas categorías o modalidades de belenes, que han sido objeto de los anteriores concursos, se unifican en sólo dos categorías participantes: Belenes y Belenes infantiles.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;7. CRITERIOS DE VALORACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los criterios de valoración que tendrán que regir las votaciones por parte de los usuarios del Facebook del Ayuntamiento de Andratx serán los siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Belenes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;a) Originalidad de las figuras y de la composición&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;b) Perspectiva del belén&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;c) Relación entre el tamaño y la calidad de la composición&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;d) Valor artístico, detalles y buen gusto&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Belenes infantiles&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Trabajo manual realizado y la laboriosidad en la ejecución de los elementos, así como los elementos empleados (barro, corcho, papel, materiales reciclados....)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Originalidad en la composición&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Originalidad de las figuras&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Esfuerzo y participación en la realización por parte de los más pequeños de la casa.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;8.CRITERIOS PARA LA VOTACIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Desde el área de Patrimonio se publicarán las fotografías de los belenes en las redes sociales sociales y se abrirá el período de votación comprendido desde la publicación del álbum de fotografías en la página de Facebook del Ayuntamiento de Andratx hasta día 5 de enero de 2024 incluido, hasta las 12:00 h del mediodía.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las fotografías se publicarán en un álbum fotográfico en la página de Facebook del Ayuntamiento de Andratx, que servirá como sistema de votación a través de las interacciones. Se realizará un álbum por cada belén presentado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Cada perfil personal de Facebook podrá votar los álbumes que desee. La persona ganadora será la titular del álbum que más interacciones haya tenido en la página del Facebook del Ayuntamiento de Andratx. Se contabilizarán los me gusta del álbum, no de las imágenes adjuntas dentro del mismo.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Se entenderá como interacción los «me gusta&lt;span style="color:#000000"&gt;» exclusivamente. No se tendrá en cuenta como interacción/votación cualquier otra reacción, comentario o contenido compartido en otras páginas o perfiles.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Cuando existan dudas derivadas del origen de las fotografías, el Ayuntamiento de Andratx podrá solicitar al interesado, de forma motivada y aplicando todas las medidas de seguridad, la comparecencia por parte del técnico de patrimonio con el fin de comprobar que el Belén es el correspondiente a la documentación presentada.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9. PLAZO, PUESTO DE PRESENTACIÓN Y CONTENIDO DE LAS SOLICITUDES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.1. Presentación de las solicitudes&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El plazo de presentación de solicitudes (Anexo I) y el resto de documentación obligatoria será desde el siguiente día hábil a la publicación de esta convocatoria en el Boletín Oficial de las Islas Baleares (BOIB) hasta el día 21 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La inscripción a este concurso es totalmente gratuita.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las solicitudes se podrán presentar, de acuerdo con lo que establecen los artículos 14.2, 14.3, 16.4 y 66, de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las administraciones públicas, de las siguientes formas:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Presencialmente: Ante el Servicio de Atención Ciudadana (SAC) del Ayuntamiento de Andratx, con cita previa (de 8:00 a 13:30 de lunes a viernes) o cualquiera de las oficinas de registro de la Administración autonómica, de la Administración General del Estado, del resto de comunidades autónomas o de las entidades que integran la Administración local. También se podrán presentar ante las oficinas de Correos, dentro de un sobre abierto, a fin de que el personal de la oficina pueda indicar, mediante sello oficial, lugar, fecha y hora exacta en que se ha efectuado el registro.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;- Telemáticamente. A través de la Sede Electrónica del Ayuntamiento de Andratx mediante el trámite específico (en todo caso, sujetos obligados a relacionarse en a través de medios electrónicos con las administraciones públicas y, opcionalmente, personas físicas no obligadas). Es necesario disponer de uno de los métodos de identificación permitidos (certificado electrónico, DNI electrónico o&lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt; Cl@ve pin).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Si la solicitud no cumple los requisitos establecidos en la convocatoria, el órgano gestor debe requerir a la persona interesada para que lo mencione en el plazo máximo de 10 días hábiles, con indicación de que, si no lo hace, se considerará que ha desistido de la solicitud, previa resolución que debe ser dictada en los plazos previstos en el artículo 68 de la Ley 39/2015, de 1 de octubre, de Procedimiento Administrativo Común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;9.2. Contenido&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las solicitudes de participación en el concurso deben presentarse mediante las instancias y anexos que facilita el Ayuntamiento de Andratx y que se pueden encontrar en la Sede electrónica de éste.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La solicitud constará de la siguiente documentación:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Anexo I. Modelo de solicitud&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;b) Fotocopia del NIF&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;c) Poder/autorización de representación&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;d) Solicitud de transferencia bancaria para pagos (Modelo SEPA)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;e) Certificado de estar al corriente en el cumplimiento de las obligaciones tributarias ante la Agencia Tributaria de las Islas Baleares (ATIB)&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;f) Certificado de estar al corriente en el cumplimiento de las obligaciones tributarias ante la Agencia Estatal de Administración Tributaria.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;g) Certificado de estar al corriente en el cumplimiento de las obligaciones tributarias frente a la Seguridad Social.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;h) Una vegada presentada la sol·licitud (Annex I) al Registre d'Entrada de l'Ajuntament o a qualsevol de les formes previstes a l'article 16.4 de la Llei 39/2015, d'1 d'octubre, de Procediment Administratiu Comú de les administracions públiques, cada participant enviarà la documentació gràfica del betlem al correu electrònic &lt;/span&gt;&lt;/span&gt;&lt;span style="color:null"&gt;patrimoni@andratx.es. &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;El termini màxim per enviar les fotografies serà del dia 20 de desembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Documentació gràfica:&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Mínimo tres fotografías generales y al detalle del belén.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Los participantes autorizarán expresamente la captación, la reproducción y la&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;publicación de las imágenes generales y al por menor del belén facilitadas (Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Éstas podrán ser difundidas en los diversos medios y canales del Ayuntamiento (web municipal, redes sociales, material promocional, publicaciones externas, revistas, trípticos y otros medios propios).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;- Una fotografía del belén con su creador y/o participante.&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El derecho a la propia imagen es reconocido en el artículo 18.1 de la Constitución Española, regular por la Ley Orgánica 1/1982, de 5 de mayo, sobre el derecho a el honor, a la intimidad personal y familiar y a la propia imagen y Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y Garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Por lo que, la fotografía del belén con su creador y/o participante no será objeto de ser difundida en los diversos medios y canales del Ayuntamiento (web municipal, redes sociales, material promocional, publicaciones externas, revistas, trípticos y otros medios propios) sin el consentimiento expreso del participante (Anexo I).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;10. FINANCIACIÓN E IMPORTE DEL CONCURSO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El pago de estos premios, serán abonados con cargo a la partida correspondiente, una vez llevada a cabo la tramitación legalmente establecida.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;11. ÓRGANOS COMPETENTES PARA INSTRUIR Y RESOLVER EL&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;PROCEDIMIENTO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La tramitación y gestión de esta convocatoria estará sujeta a los principios enumerados en el artículo 8.3 de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La Junta de Gobierno Local será el órgano encargado de aprobar las bases y la convocatoria y de resolverla, de acuerdo con el Decreto número 2022-1843, de fecha 6 de julio de 2022, por la que la Alcaldía del Ayuntamiento de Andratx, delega un conjunto de competencias en la Junta de Gobierno Local, entre las que se encuentra la concesión de ayudas, subvenciones y becas económicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Recibido el informe por el órgano instructor que gestione las solicitudes para participar en el concurso de belenes y comprobado que los solicitantes cumplan con los requisitos exigidos, se dictará la propuesta de resolución correspondiente. Y posteriormente, la Junta de Gobierno Local resolverá la convocatoria, con indicación de los extremos contenidos en la propuesta de resolución definitiva.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;12. PROCEDIMIENTO Y NOTIFICACIÓN DEL PREMIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La convocatoria, con las bases que la rigen, se publicarán en el Boletín Oficial de las Islas Baleares (BOIB), en la página Web y en el tablón de anuncios de el Ayuntamiento de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las resoluciones de concesión de los premios del concurso de belenes se publicarán en la citada página web y el tablón de anuncios del Ayuntamiento de Andratx, en los términos de la disposición adicional séptima de la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El plazo máximo para resolver el procedimiento y notificarlo es de seis meses desde de la fecha de publicación del extracto de la convocatoria en el Boletín Oficial de las Islas Baleares.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Si no se resolviera en plazo el procedimiento de concesión de los premios, hemos de señalar que, según lo fijado en el artículo 25.4 y 5 LGS,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;transcurrido el plazo de seis meses desde la iniciación sin resolver y notificar resolución, los interesados ​​podrán entender desestimada su solicitud. A partir de ese momento podrán interponer el recurso potestativo de reposición (en un mes desde que se producen los efectos de silencio administrativo) o, directamente, el contencioso-administrativo ante el Juzgado Contencioso.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;13. ABONO DE LOS PREMIOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El abono del total del importe premiado se realizará mediante transferencia bancaria en la cuenta corriente designada por el beneficiario del premio (solicitud de transferencia bancaria para pagos (Modelo SEPA) una vez se haya comprobado que el solicitante cumple los requisitos para ser beneficiario del premio y se dicte la correspondiente resolución de concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;14. OBLIGACIONES DE LAS PERSONAS BENEFICIARIAS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Las personas beneficiarias deben cumplir las obligaciones establecidas en el artículo 8 de la Ordenanza Municipal de Subvenciones de Andratx y el artículo 14 de la Ley 38/2003 General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;15. REINTEGRO Y PÉRDIDA DEL DERECHO AL COBRO DE LA SUBVENCIÓN&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Para la aplicación del reintegro se ajustará a las causas y procedimiento establecidos en la presente convocatoria (destacando el artículo 13 de ésta), en los artículos 36 y siguientes de la Ley 38/2003 General de Subvenciones, 96 y siguientes del Reglamento General de Subvenciones, y 49 y siguientes de la Ordenanza reguladora de Subvenciones de Andratx.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;16. ACEPTACIÓN DE LAS BASES, DERECHOS Y OBLIGACIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La presentación al concurso supone la aceptación de las bases y de los derechos y obligaciones que se derivan.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;17. RENUNCIA&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;En cualquier momento del procedimiento, los interesados ​​podrán desistir de la su solicitud o renunciar al derecho de percibir los premios concedidos de conformidad con lo dispuesto en el artículo 94 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La renuncia deberá presentarse mediante instancia general de acuerdo con los artículos 14.2, 14.3 y 16.4 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;18. INFRACCIONES Y SANCIONES&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;El incumplimiento de los requisitos establecidos en estas bases o en la normativa de aplicación, podrá dar lugar a la aplicación del régimen de sanciones establecido en la Ley General de Subvenciones.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;19. PRESENTACIÓN DE RECURSOS&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Contra la resolución por la que se aprueban las presentes bases y de conformidad con lo que se dispone en los artículos 123 y 124 de la Ley 39/2015, de 1 de octubre, y 8, 45 y 46 de la Ley 29/1998, de 13 de julio, se podrá interponer un de los siguientes recursos:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;a) Con carácter potestativo, recurso de reposición ante el mismo órgano que va dictar el acto recorrido (salvo que se trate de un acto dictado por delegación en este caso corresponderá la resolución al órgano que ha hecho la delegación), en el plazo de un mes, a contar desde el día siguiente de la publicación de la convocatoria de las presentes bases. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;La interposición del recurso, salvo en los casos en que una disposición establezca lo contrario, no suspenderá la ejecución del acto impugnado, de conformidad con el que se dispone en el artículo 117 de la Ley 39/2015, de 1 de octubre.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;Si transcurriera un mes desde el día siguiente al de la interposición del recurso de reposición sin que éste haya sido resuelto, podrá entender que ha sido desestimado e interponer recurso contencioso-administrativo ante el Juzgado de lo Contencioso Administrativo de Palma, en el plazo de seis meses, a contar desde del día siguiente al de la desestimación presunta.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;(&amp;nbsp; &amp;nbsp; ) les fotografies generals i a detall del betlem aportades&lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;*&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;(&amp;nbsp; &amp;nbsp; ) la fotografia del betlem amb el seu creador i/o participant&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Compareixença del tècnic:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;span style="color:#000000"&gt;(&amp;nbsp; ) a la compareixença per part del tècnic de patrimoni&lt;/span&gt;&lt;span style="color:#000000"&gt; &lt;/span&gt;&lt;span style="color:#000000"&gt;per tal de comprovar que el Betlem és el corresponent a la documentació presentada &lt;/span&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;*&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

			&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Altres:&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
