    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El punto 3 del apartado Octavo de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12&amp;nbsp;de abril&amp;nbsp;de 2023, por la cual se convocan ayudas destinadas al pago compensatorio en zonas de montaña para el año 2023, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Islas Baleares, y se hará de acuerdo a los términos que prevé el artículo 45.2 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:#212121"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, en fecha 23&amp;nbsp;de noviembre&amp;nbsp;de 2023, firmó la siguiente resolución:&lt;/span&gt;&lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Con fecha 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril de 2023, por la que se aprueba la convocatoria para el año 2023 de las ayudas destinadas al pago compensatorio en zonas de montaña en las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la resolución antes mencionada, y de la Resolución de modificación de la Presidenta del FOGAIBA, para el año 2023, de determinadas ayudas comunitarias directas y al desarrollo rural en la Agricultura y en la Ganadería, de fecha 25 de mayo de 2023, publicada en el BOIB núm.71 de 30 de mayo de 2023, el plazo de presentación de solicitudes de la convocatoria terminó el 30/6/23, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 274 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de esta ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Co&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;n fecha &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;1&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;7 de o&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;c&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;t&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;ubre&amp;nbsp;de 2023 se notifica, mediante publicación en la página web http://www.caib.es, un requerimiento de documentación concediendo un plazo de 10 días para aportar la documentación solicitada, informando que transcurrido este plazo se darán por desistidas las solicitudes de ayuda si no se ha recibido la documentación. Los interesados del ANEXO I adjunto, no han aportado ningún documento.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

Reglamento UE 2021/2115 del Parlamento Europeo y del Consejo, de 2 de diciembre de 2021, por el que se establecen las normas en relación con la ayuda a los planes estratégicos que deben elaborar los Estados miembros en el marco de la política agrícola común (planes estratégicos de la PAC), financiada con cargo al Fondo Europeo Agrario de Garantía (FEAGA) y al Fondo Europeo Agrícola de Desarrollo Rural (FEADER), y por el que se derogan los reglamentos (UE) núm. 1305/2013 y (UE) 1307/2013. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Real Decreto 1054/2022, de 27 de diciembre, por el que se establece y regula el Sistema de información de explotaciones agrícolas y ganaderas y de la producción agraria, así como el Registro autonómico de explotaciones agrícolas y el cuaderno digital de explotación agrícola. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10. Real Decreto 1051/2022, de 27 de diciembre, por el que se establecen unas normas para la nutrición sostenible en los suelos agrarios. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11. Real Decreto 1050/2022, de 27 de diciembre, por el que se modifica el Real Decreto 1311/2012, de 14 de septiembre, que establece el marco de actuación para conseguir un uso sostenible de los productos fitosanitarios. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12. Real Decreto 147/2023, de 28 de febrero, por el que se establecen las normas para la aplicación de penalizaciones en las intervenciones previstas en el Plan estratégico de la política agrícola común, modificándose varios reales decretos por los que se regulan distintos aspectos relacionados con la aplicación en España de la política agrícola común para el período 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;13. Decreto legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;14. Orden 10/2023 de la consellera de Agricultura, Pesca y Alimentación, de 5 de abril de 2023, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco de las intervenciones para el desarrollo rural de las Islas Baleares 2023-2027. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;15. La ley 3/2019, de 31 de enero, agraria de las Islas Baleares. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;El resto de normativa de desarrollo y aplicación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;span style="color:#212121"&gt;&lt;em&gt;Propuesta de resolución de desitimiento&lt;/em&gt;&lt;/span&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa desfavorablemente y propongo al vicepresidente en Materia Agraria del FOGAIBA que dicte una resolución en los siguientes términos:&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Considerar desistidas las solicitudes presentadas por los interesados relacionados en el Anexo I, de la línea de ayuda "Pago compensatorio en zonas de montaña", por no presentar la documentación requerida.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Declarar concluido el procedimiento y archivar&lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;&amp;nbsp;los expedientes &lt;/em&gt;&lt;/em&gt;&lt;em&gt;&lt;em&gt;detallados en el Anexo I.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Notificar la resolución a los interesados del Anexo I, mediante la publicación en el BOIB.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
