&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;PRIMERO.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Aprobar el convenio de colaboración entre el Consejo Insular de Eivissa y Cáritas Diocesana de Eivissa en materia de servicios sociales, para la ejecución del proyecto «Urgencia social y ayuda alimentaria, año 2023», que obra en el expediente, con CSV: 14615035162463331203, en virtud del cual se subvenciona a la entidad Cáritas Diocesana de Eivissa, con núm de NIF R0700071D, la cantidad máxima de ciento veinte mil dos cientos diecinueve euros con setenta y cuatro céntimos (120.219,74 €) con cargo a la aplicación presupuestaria núm. 2310 48915, de los vigentes presupuestos de la Corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;SEGUNDO. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Autorizar Y disponer el gasto de la cantidad de ciento veinte mil dos cientos diecinueve euros con setenta y cuatro céntimos (120.219,74 €) con cargo a la aplicación presupuestaria 2310 48915 de los vigentes presupuestos, a favor de la entidad Cáritas Diocesana de Eivissa con NIF R0700071D.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;TERCERO. &lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Publicar el convenio de colaboración, que obra en el expediente, en el BOIB y en el Portal de Transparencia del Consejo Insular de Eivissa de conformidad con la Ley 19/2013, de 9 de diciembre, de transparencia, acceso a la información pública y buen gobierno.&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CONVENIO DE COLABORACIÓN ENTRE EL CONSEJO INSULAR DE EIVISSA Y CÁRITAS DIOCESANA DE IBIZA EN MATERIA DE SERVICIOS SOCIALES, PARA LA EJECUCIÓN DEL PROYECTO «URGENCIA SOCIAL Y AYUDA ALIMENTARIA, AÑO 2023»&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Partes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vicent Marí Torres, presidente del Consejo Insular de Eivissa, en nombre y representación de esta Institución, de conformidad con lo que dispone el artículo 21 de la Ley 4/2022, de 28 de junio, de consejos insulares y el art. 52 del Reglamento orgánico del Consejo Insular.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Juan Torres Marí, con DNI núm. 41433346-L, director de Cáritas Diocesana de Ibiza (NIF R0700071D), en nombre y representación de esta entidad, de acuerdo con lo que dispone el artículo 10 de sus estatutos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ambas partes reconocen su capacidad jurídica para establecer este documento y en especial, la representación de las entidades que se citan.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Antecedentes&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;I.&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;El&lt;strong&gt;&lt;span style="background-color:null"&gt; &lt;/span&gt;&lt;/strong&gt;Estatuto de autonomía de les Illes Balears, según la redacción dada por la Ley orgánica 1/2007, de 28 de febrero, que reformó el citado estatuto, establece en el artículo 12 los principios rectores de la actividad pública y dispone que las instituciones propias de la comunidad autónoma deben promover, entre otras, la cohesión social y el derecho a la salud, la educación y la protección social. Así mismo, en su artículo 16.4 prevé que las administraciones públicas, en el marco de sus competencias respectivas, han de promover las condiciones necesarias para que los derechos sociales de la ciudadanía de las Illes Balears y de los grupos y colectivos en los que se integran sean objeto de una aplicación real y efectiva. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el artículo 21 se indica que, a fin de combatir la pobreza y facilitar la inserción social, los poderes de las Illes Balears deben garantizar el derecho de la ciudadanía de las Illes Balears en estado de necesidad a la solidaridad [...].&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;II. Como señala la Ley 4/2009, de 11 de junio, de servicios sociales de las Illes Balears, en su Exposición de motivos, en las sociedades democráticas, la política social tiene por objeto reducir las desigualdades y mejorar las condiciones de vida del conjunto de la población con la finalidad de facilitar el ejercicio de los derechos de la ciudadanía y de fomentar la cohesión y el progreso social. La construcción de una sociedad de progreso viene determinada en buena parte por su grado de cohesión social, que se basa en la igualdad de oportunidades y en la promoción social e individual. Los servicios sociales son un instrumento para favorecer la autonomía de las personas, para mejorar las condiciones de vida, para eliminar situaciones de injusticia social y para favorecer la inclusión social. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el artículo 3 de esta ley figura que la actuación de los poderes públicos en materia de servicios sociales persigue entre otros &lt;/span&gt;&lt;em&gt;&lt;span style="background-color:null"&gt;“d) prevenir y atender las situaciones de vulnerabilidad de las personas y de los grupos en situación de exclusión social”&lt;/span&gt;&lt;/em&gt;&lt;span style="background-color:null"&gt;.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Y en el artículo 6 se establece que son destinatarias de los servicios sociales, con carácter prioritario, las personas que se encuentran en alguna o algunas de las situaciones siguientes, entre otras:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dificultades de integración familiar o comunitaria derivadas de enfermedades mentales y enfermedades crónicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dificultades de integración social vinculadas a condiciones laborales precarias, desocupación y pobreza.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Necesidad social, como la relacionada con la falta de vivienda o con la desestructuración familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dificultad de integración familiar o comunitaria derivada de la drogodependencia y de otras adicciones.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Vulnerabilidad, exclusión y aislamiento social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Necesidad social, como la relacionada con la falta de vivienda o con la desestructuración familiar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Problemas de convivencia y de cohesión social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Urgencias sociales&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;III. El Departamento de Benestar Social, Família i Igualtat es consciente de las dificultades económicas que está padeciendo una parte importante de la población de la isla de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El encarecimiento de los productos de primera necesidad, así como, las dificultades para acceder a una vivienda digna a precios razonables, ha generado que los colectivos más vulnerables aumenten su situación de precariedad. En consecuencia, Cáritas Diocesana de Ibiza ha visto incrementado el número de personas que acuden a su entidad con la demanda de cobertura de necesidades básicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;IV. El Consejo Insular de Eivissa ejerce competencias en materia de servicios sociales, asistencia social y seguridad social, en virtud de las atribuciones que efectuaron la Ley 12/1993, de 20 de diciembre y la Ley 14/2001, de 29 de octubre, en los términos y al alcance que se establecen.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;V. Cáritas Diocesana de Ibiza (de ahora en adelante Cáritas) destacada con la Medalla de Oro del Parlament de les Illes Balears, es un organismo creado por la Diócesis de Ibiza para el ejercicio de su acción institucional socio caritativa y está debidamente inscrita en el Registro de Servicios Sociales con el núm. 765.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Ambas partes nos reconocemos mutuamente la capacidad legal necesaria para formalizar este convenio, de acuerdo con las siguientes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;CLÁUSULAS&lt;/span&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Primera. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Es objeto de este convenio establecer la colaboración entre el Consejo Insular de Eivissa y Cáritas, para el desarrollo del proyecto «Urgencia social y ayuda alimentaria, año 2023», dirigido a personas en situación de vulnerabilidad y exclusión social.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La finalidad del proyecto es atender fundamentalmente a personas y familias en situación de urgencia social derivada de la situación de empobrecimiento y de exclusión social con necesidades básicas no cubiertas. Mayoritariamente, son personas en una situación de precariedad laboral, personas en situación de aislamiento, personas inmigrantes y otros colectivos con diversidad cultural, mujeres con graves problemáticas sociales y personas sin techo que viven en la calle y/o pernoctan en centros de acogida. La cobertura de necesidades básicas va acompañada de una atención integral de la persona usuaria encaminada a la inserción social en los diferentes ámbitos (vivienda, cobertura sanitaria, situación legal...).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Esta intervención se realiza en coordinación con los servicios sociales comunitarios del municipio donde reside la persona usuaria. &lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Segunda.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Cáritas llevará a cabo el proyecto que figura en la memoria explicativa presentada en fecha 03/11/2023, con RGE núm. 2023032176, con un presupuesto total de doscientos sesenta y dos mil novecientos ochenta y cinco euros con setenta y cinco céntimos (262.985,75€&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Tercera.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El Consejo Insular de Eivissa subvencionará a Cáritas la ejecución del proyecto «Urgencia social y ayuda alimentaria, año 2023» de acuerdo con la memoria citada en la cláusula segunda, con la cantidad máxima de ciento veinte mil mil dos cientos diecinueve euros con setenta y cuatro céntimos (120.219,74€) a cargo de la aplicación presupuestaria núm. 2310-48915 del presupuesto vigente de la corporación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El pago de la subvención se hará de manera fraccionada mediante dos justificaciones parciales:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. El 80% de la ayuda concedida (96.175,79€) a partir de la firma del convenio. Esta cantidad se deberá de justificar dentro del plazo máximo de tres meses desde la firma del convenio&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. El otro 20% de la ayuda concedida (24.043,95€) se hará efectivo una vez justificado el primer 80%. La justificación de este segundo pago se ha de realizar en el plazo máximo de tres meses contadores desde la fecha de su pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para las justificaciones se presentará una relación clasificada de los gastos realizados, con identificación del acreedor y del documento, su importe, fecha de emisión y en el su caso, fecha de pago y una declaración responsable de la presidencia de la entidad en que conste que todas las facturas detalladas únicamente se han presentado en este proyecto con el importe establecido en la citada relación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Además, por lo que respecta la segunda justificación, Cáritas deberá de presentar una memoria técnica justificativa de las actividades llevadas a cabo y una liquidación de ingresos y gastos correspondientes al total del proyecto presentado correspondiente al año 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el supuesto que no se justifique correctamente la totalidad de los gastos del proyecto, la aportación del Consejo se reducirá proporcionalmente de acuerdo con el importe de la justificación presentada y la entidad reintegrará el exceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así mismo, si finalmente el coste total del proyecto ejecutado es inferior al que se presupuestó, la cuantía de la ayuda se reducirá proporcionalmente y la entidad deberá de reintegrar la parte correspondiente que haya percibido en exceso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de que la actividad se encuentre subvencionada con otros recursos económicos, se deberá de justificar el importe, la procedencia y la aplicación de estos fondos.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para justificar debidamente los gastos subvencionables se deberá de aportar la siguiente documentación económica:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una relación clasificada de los gastos realizados, con identificación del acreedor del documento, su importe, la fecha de emisión y en su caso, la fecha de pago.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Facturas originales de los gastos correspondientes al coste total del proyecto con los correspondientes justificantes de pago, emitidas y pagadas desde el día 1 de enero de 2023 hasta el 31 de diciembre de 2023, excepto la Seguridad Social correspondiente al mes de diciembre de 2023, que se aceptará hasta el 31 de enero de 2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La entidad será la responsable de estampillar las facturas y el resto de documentos. Los gastos que sean cofinanciados deberán indicar la cantidad imputable a cada una de las subvenciones recibidas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se aceptarán recibos acompañados de un contrato o de un acuerdo como justificativos del objeto de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se aceptarán nóminas originales en el cas de que se justifiquen gastos correspondientes al personal contratado por la entidad&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Se podrán imputar gastos de seguridad social del personal contratado por la entidad; en estos casos, deberán presentar los correspondientes recibos de liquidación de cotizaciones originales TC1, TC2 y el correspondiente resumen detallado de las nominas de los trabajadores y trabajadoras.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para justificar debidamente los gastos subvencionables se deberá de aportar la acreditación del abono del gasto dependiente de los medios de pago que se hayan utilizado:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;a. Pago mediante transferencia bancaria o ingresos en cuenta bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Documento bancario acreditativo del pago en el que figuren el concepto de la transferencia o el ingreso, la fecha del documento, el importe y los datos del ordenante y de destinatario, que han de coincidir con el beneficiario y con el emisor de la factura respectivamente.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;b. Pago en metálico&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Una factura original firmada y sellada por el proveedor en el cual se debe especificar el gasto a que corresponde el pago, su fecha y la expresión “recibido en metálico” o similar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;c. Pago mediante cheque nominativo:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Copia del cheque nominativo o pagaré nominativo emitido a nombre del proveedor que emite la factura o documento equivalente, siempre que esté vencido.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracto de la cuenta corriente del beneficiario de la ayuda en la que figure el cargo de este cheque o pagaré.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;d. Pago mediante tarjeta de crédito o débito:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracto de la cuenta en que figure el cargo del pago con tarjeta.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p style="margin-left:40px"&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;e. Pago mediante domiciliación bancaria:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul style="margin-left:40px"&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Extracto bancario o recibo en el que figure el cargo de la domiciliación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para conceder la ayuda y en consecuencia, poder proceder al pago, será necesario que previamente quede acreditado que Cáritas está al corriente de las obligaciones tributarias y de la Seguridad Social y las obligaciones tributarias o de otro tipo ante el Consejo Insular de Eivissa.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Para el pago de la subvención en el Consejo Insular de Eivissa podrá solicitar cualquier documentación o informes que se consideren adecuados.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Cuarta&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. En cumplimiento de lo que dispone el artículo 11 del Texto refundido de la Ley de subvenciones (de la CAIB), aprobado por Decreto legislativo 2/2005, de 28 de diciembre, relativo a las obligaciones del beneficiario de las subvenciones, Cáritas queda sometida a las obligaciones siguientes:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Llevar a cabo la actividad o la inversión o adoptar el comportamiento que fundamenta la concesión de la subvención,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Justificar la realización de la actividad, como también el cumplimiento de los requisitos y las condiciones que determinan la concesión de la subvención.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Someterse a las actuaciones de comprobación que lleven a cabo los órganos competentes&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Comunicar a este Consejo Insular la obtención de otras subvenciones para la misma finalidad&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Dejar constancia de la percepción y la aplicación de la subvención en los libros de contabilidad o en los libros de registro que deba de llevar el beneficiario de acuerdo con la legislación mercantil o fiscal que sean aplicable&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Conservar los documentos justificativos de la aplicación de los fondos percibidos mientras puedan ser objeto de actuaciones de comprobación y control&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Reintegrar los fondos percibidos en los supuestos previstos en el artículo 44 de esta Ley&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así mismo, también queda sometida a todas aquellas obligaciones que se deriven del citado Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre y de la Ley 38/2003, de 17 de noviembre, general de subvenciones y de su Reglamento, aprobado por Real decreto 887/2006, de 21 de julio, en todo lo que le sea de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;En el caso de que Cáritas reciba otras ayudas, su importe no puede ser, en ningún caso, de una cuantía que, aisladamente o conjuntamente con subvenciones o ayudas de la misma administración o de otras entidades públicas o privadas, supere el coste de la actividad que la entidad beneficiaria debe realizar.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;El incumplimiento de las obligaciones que contrae la asociación beneficiaria puede dar lugar al régimen sancionador previsto en la Ley.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;Cáritas dará difusión al hecho de que el desarrollo del proyecto objeto de la presente subvención recibe el soporte del Consejo Insular de Eivissa.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Quinta.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; El Departamento de Benestar Social, Família i Igualtat del Consejo Insular de Eivissa comprobará la justificación de la aplicación de la subvención, la realización de la actividad y el cumplimiento de la finalidad para la cual se concede, de acuerdo con lo que establece el artículo 39 del Texto refundido de la Ley de subvenciones, aprobado por Decreto legislativo 2/2005, de 28 de diciembre y el resto de normativa de aplicación.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Sexta.&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; Se creará una comisión técnica integrada por dos representantes de cada una de las partes, que será la encargada de hacer el seguimiento del presente convenio. Esta comisión se reunirá a instancias de cualquiera de las partes, cuando se considere oportuno.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Séptima.&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt; Las partes se comprometen a cumplir las exigencias previstas en el Reglamento (UE) 2016/679, de 7 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos y en la Ley orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Octava&lt;/strong&gt;&lt;span style="font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt;. El convenio se resolverá por las siguientes causas:&lt;/span&gt;&lt;/p&gt;

&lt;ul&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Incumplimiento de las obligaciones por parte de cualquiera de las partes firmantes, o de ambas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La disolución de la asociación que suscribe el convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;La anulación o la revocación del acto de concesión de la subvención Imposibilidad material o legal de cumplir las obligaciones que se derivan del objeto del convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
	&lt;li&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Denuncia de cualquiera de las partes, manifestada por escrito.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/li&gt;
&lt;/ul&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Novena. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Este convenio se rige por sus propias clausulas y en todo aquello que no esté previsto es de aplicación la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas y la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Así mismo, también será de aplicación la normativa en materia de subvenciones establecida en la Ley 38/2003, de 17 de noviembre, general de subvenciones, su reglamento de desarrollo, aprobado por Real decreto 887/2006, de 21 de julio y el Real decreto 2/2005, de 28 de diciembre que aprueba el Texto refundido de la Ley de subvenciones de las Illes Balears.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Décima. &lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;Las partes que suscriben este convenio es comprometen a intentar resolver en común las diferencias que puedan surgir en la aplicación y la interpretación de este convenio. Pero si esto no es posible, las cuestiones litigiosas que puedan afectar la interpretación y la ejecución del referido convenio han de ser del conocimiento y de la competencia del orden jurisdiccional contencioso administrativo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;span style="background-color:null"&gt;Onceava&lt;/span&gt;&lt;/strong&gt;&lt;span style="background-color:null"&gt;. El presente convenio tendrá vigencia desde la formalización, con efectos retroactivos al 1 de enero de 2023, fecha de inicio de las actividades objeto del convenio, hasta al 31 de diciembre de 2023.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:null"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="background-color:null"&gt;Y en prueba de conformidad, ambas partes firman este convenio.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
