&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;1. En el BOIB número 143 de 21 de octubre de 2023, se publicó la Resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales de 16 de octubre de 2023, de aprobación de la convocatoria pública de ayudas económicas del Instituto Mallorquín de Asuntos Sociales a entidades que desarrollen programas de voluntariado social, socio sanitario o comunitario para la gente mayor de Mallorca en los años 2023-2024.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;2. Con esta resolución se autorizó el gasto dimanante de este expediente por el importe total de SESENTA MIL EUROS (60.000,00 €), con cargo en&lt;/span&gt;&lt;span style="color:#000000"&gt; la partida 60.23130.48900 del vigente presupuesto de gastos del IMAS para e&lt;/span&gt;&lt;span style="color:#000000"&gt;l 2023, y núm de documento contable A 22023009286, y se delegó en la Gerencia del IMAS la resolución de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;3. El plazo de presentación de solicitud finalizó el 13 de noviembre de 2023 (15 días hábiles a contar desde el día siguiente de la publicación de la convocatoria en el BOIB). Las entidades Cruz Roja Española y Cáritas Diocesana de Mallorca presentaron solicitudes en el plazo previsto y en las cantidades económicas previstas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;4. Una vez revisadas las solicitudes admitidas y subsanadas, a ser posible las deficiencias que presentaban, la Comisión Evaluadora tal y como se establece en la base 10.4, se reunió el 17 de noviembre de 2023. Esta Comisión por unanimidad acordó elevar a definitivas las puntuaciones otorgadas en el informe técnico de valoración emitido el 17 de noviembre de 2023 (enmendado por la diligencia del órgano instructor de 23 de noviembre de 2023), y proponen al órgano instructor que conceda las ayudas en los plazos y cuantías del siguiente cuadro:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Considerando esto, el 20 de noviembre de 2020, el Jefe del Servicio de Atención Comunitaria y Promoción de la Autonomía Personal, firmó un informe en el que, habiendo comprobado que las entidades beneficiarias cumplen con los requisitos establecidos en la convocatoria, propone la concesión de las ayudas a estas entidades y por estos importes:&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;em&gt;«1. Conceder en el marco de la convocatoria de ayudas económicas del Instituto Mallorquín de Asuntos Sociales a entidades que desarrollen programas de voluntariado social, sociosanitario o comunitario para las Personas Mayores de Mallorca para los años 2023-2024, las siguientes ayudas:&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;6. Constan en el expediente los documentos contables necesarios para la disposición y reconocimiento de la obligación en concepto de anticipo.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;7. Dado que en la resolución de la Presidencia del Instituto Mallorquín de Asuntos Sociales de 16 de octubre de 2023, de aprobación de esta convocatoria, se resolvió «Delegar en la Gerencia del IMAS la resolución de esta convocatoria».Pero que, lo establecido en la BASE 26.2 c) g) de ejecución del presupuesto del IMAS para 2023 que establece que:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;« 2. c) Con carácter excepcional, la Presidencia del IMAS podrá conceder, y consecuentemente, reconocer anticipos de un máximo del 100% del importe de las subvenciones concedidas sin la obligación de conceder aval, previo informe del centro gestor del gasto acreditativo de las circunstancias que aconsejen la adopción de esta medida, siempre que los beneficiarios de las subvenciones sean administraciones públicas, sus organismos autónomos vinculados o entidades dependientes, sociedades mercantiles públicas y las Fundaciones del Sector Público, entidades sin ánimo de lucro o entidades asociativas que desarrollen proyectos o programas de acción social y cooperación internacional, y cuando así lo prevean las bases reguladoras y las convocatorias de subvenciones, convenios o propuestas de acuerdo de concesión de subvenciones nominativas y otras subvenciones de concesión directa.»&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;em&gt;Y visto que la base 14 de esta convocatoria se prevé que se pagará el 100% del importe de la subvención aprobada, en concepto de anticipo.&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por este motivo, y para que en una única resolución se pueda resolver la convocatoria y reconocer la obligación del pago en concepto de anticipo, la Presidencia del IMAS revoca la delegación prevista en la Gerencia del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;8. En el expediente constan informe jurídico e informe de fiscalización favorables.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;strong&gt;Consideraciones jurídicas&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;1. El Pleno del Consejo de Mallorca, por acuerdo de día 11 de abril de 2019, aprobó los Estatutos del Instituto Mallorquín de Asuntos Sociales (BOIB núm. 67 de 18 de mayo de 2019). El artículo 2.1 de los Estatutos dispone que el IMAS tiene por objeto fundamental el ejercicio, en forma directa y descentralizada, de las competencias atribuidas por cualquier título al Consejo de Mallorca en materia de servicios sociales y protección de menores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;2. De acuerdo con el artículo 70.4 del Estatuto de Autonomía, son competencias propias de los consejos los servicios sociales y la asistencia social y la política de protección y atención a personas dependientes.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;3. De acuerdo con el artículo 3 de los Estatutos del IMAS, este organismo tiene personalidad jurídica propia y la capacidad de obrar necesaria para cumplir sus fines.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;4. De acuerdo con el arte. 8 de la Ley 38/2003, general de subvenciones, con carácter previo al otorgamiento de las subvenciones, deben aprobarse las normas que establezcan las bases reguladoras de concesión en los términos previstos en la ley.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;5. Vista la Ordenanza General de Subvenciones del Consejo de Mallorca (OGS) aprobada en sesión de 23 de diciembre de 2016 (BOIB núm. 21, de 18 de febrero de 2017), y modificada por Acuerdo del Pleno del Consejo de Mallorca de fecha 14 de junio de 2018 (BOIB núm. 96, de 4 de agosto de 2018).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;6. Visto lo previsto en el artículo 9 de la Ley 40/2015, de 1 de octubre, de régimen jurídico del sector público.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;7. En virtud del punto 11.4 de esta convocatoria de ayudas económicas, las resoluciones de concesión o de denegación de las ayudas se notificará a las entidades interesadas y se publicará en el Boletín Oficial de las Islas Baleares, de acuerdo con el artículo 42 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas (LPAC).&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Por todo ello,&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;RESUELVO&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Primero.- REVOCAR&lt;/strong&gt; la delegación en la Gerencia del IMAS de la resolución de esta convocatoria.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Segundo.- OTORGAR, DISPONER Y RECONOCER &lt;/strong&gt;la obligación en concepto de anticipo, a favor de los beneficiarios que se relacionan a continuación de un importe total de 54.754,20 € con cargo en la partida presupuestaria 60.23130 48900 del presupuesto vigente de gastos del IMAS y de acuerdo con los documentos contables que figuran en el expediente según el siguiente cuadro:&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Tercero. CANCELAR&lt;/strong&gt;&lt;span style="color:#000000; font-family:&amp;quot;Times New Roman&amp;quot;,Times,serif"&gt; la autorización del gasto por la diferencia contable no otorgada por el importe de 5.245,80 €.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Cuarto. NOTIFICAR &lt;/strong&gt;a las personas interesadas y ORDENAR la publicación de esta resolución en el Boletín Oficial de las Islas Baleares, así como en la Base Nacional de Datos de Subvenciones, el Tablón de anuncios del IMAS, y en la sede electrónica del Consell de Mallorca.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;&lt;strong&gt;Quinto. DAR TRASLADO&lt;/strong&gt; de esta resolución a la Dirección Insular de Atención Comunitaria y Promoción de la Autonomía Personal, al Servicio de Gestión Económica ya la Intervención Delegada del IMAS.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Esta resolución no pone fin a la vía administrativa y contra ella puede interponerse, de acuerdo con el artículo 28.1 de los Estatutos del IMAS aprobados por Acuerdo del Pleno del Consejo de Mallorca de 11 de abril de 2019 (BOIB núm. 67, de 18 de mayo de 2019), recurso de alzada ante el Consejo Ejecutivo del Consejo Insular de Mallorca, dentro del plazo de un mes, a contar a partir del día siguiente al de la notificación de la presente resolución.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación expresa del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en el plazo de dos meses, contados a partir del día siguiente al de la notificación de la desestimación de dicho recurso.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;Contra la desestimación por silencio del recurso de alzada podrá interponerse recurso contencioso administrativo ante el Juzgado de lo Contencioso Administrativo, en cualquier momento a partir del día siguiente a la desestimación presunta (tres meses desde la interposición del recurso sin que se haya notificado la resolución).&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="line-height:100%"&gt;&lt;span style="color:#000000"&gt;No obstante lo anterior, se puede ejercitar, en su caso, cualquier otro recurso que se estime pertinente. Todo esto de conformidad con la Ley 29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso Administrativa, y de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas.&lt;/span&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
