    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.4. de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA), de fecha 21 de mayo de 2020, por la que se convocan, ayudas por la Cooperación entre agentes para desarrollar cadenas cortas de comercialización mediante acciones de promoción , correspondientes al año 2020, especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el Boletín Oficial de las Illes Balears de acuerdo con los términos que prevé el artículo 45.2 de la Ley 39/2015, de '1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) en cumplimiento de lo que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas . &lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente en materia agraria del FOGAIBA, en fecha 16 de noviembre de 2023, firmó la siguiente resolución,&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:0px; margin-right:0px; margin-top:0px; text-align:center"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;&lt;em&gt;"RESOLUCIÓN&amp;nbsp;DE REVOCACIÓN TOTAL&lt;/em&gt;&lt;/strong&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Antecedentes&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 14/07/2020 tuvo entrada en el Registro del GOBIERNO DE LAS ILLES BALEARS, número registro 17126/2020, la solicitud de ayuda presentada por AGRÍCOLA AUBOCASSER, S.L con NIF B65592347 , para la convocatoria 2020_1 línea de Cooperación entre agentes para desarrollar cadenas cortas de comercialización mediante acciones de promoción. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Con fecha 28/08/2021 se publicó en el BOIB nº116 la Resolución de concesión COCCI 2020_1-R3 en fecha 10 de agosto de 2021, donde se concedió la ayuda al interesado (expediente COCCI 2020_1/005 ). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.El 05/10/2022 el interesado presenta la solicitud de pago (REGAGE22e00044224990). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Analizada la documentación presentada y la memoria fotográfica de las actuaciones, se ha observado que todas las actuaciones se han realizado sin la publicidad del fondo de ayuda requerida en la convocatoria, es decir, sin el logotipo del fondo de la financiación Islas Sostenible y/o sin hacer referencia a este fondo en las actuaciones publicitarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Las facturas de mejoras web de Global Lles (1.595€) y la factura 355/021120 de Abril publicaciones SL referente a la edición ''video fiesta'' (800€) no son admisibles por no acreditar realmente qué incluyen ni se han publicitado con el logotipo Islas Sostenibles.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Factura 0021 con concepto “Evento 5 noviembre” de M.Monserrat; debido a que la fiesta no se pudo realizar por causa del COVID-19, no se considera admisible ninguno de los gastos presentados (1.284€). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Las tres facturas referentes a compras fiesta no son admisibles porque el producto de promocional objeto de promoción es el aceite, y se trata de botellas de vino (3.829,53€). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="margin-bottom:0px; margin-left:40px; margin-right:0px; margin-top:0px"&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Las facturas de FONK «Aubocassa Groth Strategy», referentes a ''promocion web'', no detallan qué redes sociales ni nº posts realizados, ni horas dedicadas, ni días y meses imputados, ni aporta una muestra significativa de las publicaciones o promoción realizadas en las que se puedan acreditar las actuaciones y el logotipo. Las facturas no detallan que sean para la campaña 'dando la lata', en todo caso de la documentación aportada de esta campaña se demuestra que no se realizó con el logo obligatorio (8.030,00€) . Eliminando las facturas no admisibles o que no se acredita el cumplimiento con la publicidad del fondo de ayuda (Importe total: 15.538,53€), no alcanza el 50% de la cantidad aprobada. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Dada la mencionada Resolución de concesión de la ayuda, y de acuerdo con lo que establece el apartado décimo de la convocatoria antes mencionada, el beneficiario se obliga, entre otros, a realizar las actuaciones auxiliadas dentro del plazo establecido ya justificar los gastos relacionados con la inversión para la recepción de los fondos comunitarios en la forma y plazos determinados en la convocatoria. El artículo décimo de la convocatoria en el apartado 2 dice que se tendrán que cumplir las normas de información y publicidad. El artículo undécimo en el apartado 8 establece que debe justificar correctamente como mínimo el 50% de la cantidad aprobada. El mismo artículo, en el apartado 4.a determina lo siguiente: «Habrá que aportar una memoria fotográfica justificativa de las actuaciones, en la que se vea la publicidad realizada del proyecto con el logotipo comunitario y el fondo de financiación». 6.En fecha 26 de octubre de 2023 se le notifica telemáticamente la Propuesta provisional de revocación total del expediente, comunicándole que dispone de diez días hábiles para presentar alegaciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7. A fecha de hoy, el interesado no ha presentado ninguna alegación.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho&lt;/em&gt;&lt;/em&gt;&amp;nbsp;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Islas Baleares 2014-2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;- Ley 39/2015, de régimen jurídico de las administraciones públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Conclusión &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente de la revocación por el incumplimiento de obligaciones y la no ejecución correcta, por incumplir las normas de publicidad obligatorias y tener otras irregularidades, de al menos el 50% de la inversión concedida, de acuerdo con los apartados 10 y 11 de la convocatoria. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;De acuerdo con la Propuesta de día 25/10/2023, dicto la siguiente &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Resolución &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1. Proceder a la revocación total de la resolución de ayuda concedida al interesado que figura en el Anexo I, que es un total de 1 expediente y que es AGRICOLA AUBOCASSER S.L con NIF B65592347, mediante Resolución de concesión del vicepresidente del FOGAIBA de día 10/08/2021, la cual concedía al interesado una ayuda por importe de 22.813,00 €. El motivo de la revocación es por el incumplimiento de los requisitos y obligaciones establecidos en la convocatoria (artículo 10º Obligaciones beneficiarios: publicidad; artículo 11º apartado 8: al menos 50%). No se ha realizado la publicidad con el logotipo del fondo de financiación en ninguna de las actuaciones. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. Revocar la ayuda concedida en la resolución del vicepresidente del FOGAIBA de 10/08/2021, correspondiente al expediente COCCI2020_1/005 por el importe indicado en el anexo de esta resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. En consecuencia, dejar sin efecto la citada resolución de concesión de la ayuda y proceder al archivo de las actuaciones del expediente COCCI2020_1/005. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4. Notificar la resolución al interesado que figura en el Anexo I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Interposición de recursos &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="line-height:1"&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Contra esta resolución -que no agota la vía administrativa- se puede interponer recurso de alzada ante la consejera de Agricultura, Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución , de acuerdo con el artículo 58.4 de la Ley 3/2003, de 26 de marzo, de régimen jurídico de la Administración de la comunidad autónoma de las Illes Balears, y los artículos 121 y 122, de la Ley 39/2015 del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;
