    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;En la sesión del día 21 de noviembre de 2023,&lt;em&gt; &lt;/em&gt;la Comisión Insular de Patrimonio Histórico de Mallorca, acordó, entre otros, lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1.- &lt;/strong&gt;&lt;em&gt;Incoar el expediente de declaración como Bien Catalogado del fondo documental y bibliográfico que formaban parte de los fondos propiedad de Bernat Riera Alemany, General Riera, recogidos en el listado incluido en el informe y detallados en las fichas del anexo I del informe técnico de 09/11/2023, que se adjunta y forma parte integrante del presente acuerdo.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;2.- Los efectos de esta incoación son los que genéricamente establecen la Ley 12/98, de 21 de diciembre, del Patrimonio Histórico de las Illes Balears y la normativa concordante.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;3.- El acuerdo de declaración deberá adoptarse en el plazo de un año, a contar desde la fecha de iniciación del procedimiento, el cual caducará una vez transcurrido este plazo. Caducado el procedimiento, no se podrá volver a iniciar hasta al cabo de un año, salvo que lo solicite el titular del bien.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;4.- Notificar esta resolución a los interesados, al Ayuntamiento de Palma y al Gobierno de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;5.- Publicar este acuerdo en el Boletín Oficial de las Illes Balears y en el Boletín Oficial del Estado, anotarlo en el Catálogo Insular del Patrimonio Histórico de Mallorca y comunicarlo al de la Comunidad Autónoma de las Illes Balears para que proceda a anotar -lo en el Catálogo General del Patrimonio Histórico de las Islas Baleares.&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Todo esto, de conformidad con lo que establece el artículo 14 y siguientes reguladores del procedimiento de declaración de bienes catalogados de la Ley 12/1998, de 21 de diciembre, del patrimonio histórico de las Illes Balears.”&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;strong&gt;1. MEMORIA DESCRIPTIVA&lt;/strong&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;La solicitud de declaración hace referencia a toda una serie de bienes pertenecientes a Bernat Riera Alemany (Andratx 1864-Palma 1926), conocido como General Riera. En la primera solicitud, el primer lote incluía libros, manuscritos correspondencia y documentos, placas estereoscopias, recopilaciones de prensa y un árbol genealógico de la casa Formiguera. El segundo lote incluía pinturas, muebles y elementos decorativos.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Bernat Riera Alemany, conocido como el General Riera, estudió medicina en Barcelona entre 1880 y 1884, desarrollando su labor profesional en Andratx y en el Cuerpo de Medicina Militar, principalmente en el Hospital Militar (1897-1926), pero también en Cuba (1895-1897), durante la Guerra de Cuba, y en otros hospitales del resto del estado.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Su interés por la medicina científica, principalmente sobre la higiene y las transmisiones infecciosas, le convirtió en un actor muy activo durante los debates y controversias surgidas en la sociedad mallorquina entre el siglo XIX y XX sobre el derribo de las murallas de Palma, del cual él era uno de los grandes defensores.&lt;/span&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;span style="color:black"&gt;Bernat Riera se casó &lt;/span&gt;Amparo Pou Moreno, vinculada familiarmente con el condado de Santa María de Formiguera.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Como se ha dicho, la propiedad ha desistido de la tramitación de la declaración de los bienes incluidos en el lote 2. En este lote se incluían piezas de mobiliario, pinturas de distintos autores y épocas. Se trataba de un conjunto muy heterogéneo, con obras de desigual calidad y, por tanto, sin valores susceptibles de ser considerados suficientes para su declaración.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El lote 1 lo conforman un conjunto bibliográfico que incluye libros de diferente temática (medicina, botánica, historia, etc.) y un conjunto documental, que constituye la parte con más valores patrimoniales, con documentación manuscrita y placas estereoscópicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este grupo documental incluye libros de cabreos y censales desde el s. XVI de la casa del conde de Santa María de Formiguera; correspondencia privada del General Riera y de Amparo Pou (con Archiduque, Emilio Castelar, etc,) o libros de viajes y dietarios donde se incluyen escritos y dibujos de Santiago Rossinyol, Costa y Llobera, Miquel des Sants Oliver, María Antonia Salvá, Caffaro, Juan Alcover, Miguel Ferrá, etc.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Este lote 1 presenta valores suficientes para que una parte pueda ser declarado como Bien Catalogado. De hecho, el Archivo del Reino de Mallorca ha mostrado interés en poder adquirir parte de este fondo, que será el que se recogerá como parte integrante de la declaración de Bien Catalogado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El conjunto documental y bibliográfica que se incluye en la declaración como Bien catalogado queda conformado por los siguientes elementos (el número de inventario corresponde al remitido por la propiedad):&lt;/span&gt;&lt;/p&gt;
