    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado 9.3 de la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 28 de febrero de 2015 por la cual se convocan subvenciones para el Fomento de la Agricultura Ecológica, para el año 2015&amp;nbsp;(anualidad 2019), especifica que la resolución expresa se notificará a las personas interesadas mediante su publicación en el &lt;em&gt;Boletín Oficial de las Islas Baleares&lt;/em&gt;&amp;nbsp;de acuerdo con los términos que prevee el artículo 45.2 de la Ley 39/2015, d'1 d'octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes han sido tramitados por el Fondo de Garantia Agraria y Pesquera de las Islas Baleares (FOGAIBA), en cumplimiento del que dispone el artículo 43 de la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El &amp;nbsp;vicepresidente en Materia Agraria&amp;nbsp;del FOGAIBA , con fecha de 16&amp;nbsp;de noviembre&amp;nbsp;de 2023, dicta lo siguiente:&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con fecha 26 de febrero de 2015, se publicó en el BOIB núm.29 la Orden del consejero de Agricultura, Medio Ambiente y Territorio de 19 de febrero de 2015, por la que se establecen las bases reguladoras para la concesión de subvenciones en el marco del Programa de Desarrollo Rural de las Illes Balears 2014- 2020. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.En fecha de 28 de febrero de 2015 se publicó, en el BOIB núm. 30, la Resolución del Presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al Fomento de la Agricultura Ecológica. En fecha 11 de junio de 2015 se publicó en el BOIB núm. 87, una modificación de la Resolución. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3.De conformidad con el apartado sexto de la mencionada Resolución de y la orden AAA/872/2015 de 2 de mayo, publicado en el BOE núm.114 del 13/05/2015 , el plazo de presentación de solicitudes terminó el día 15/06/2015 y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 104 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Con fecha 4 de octubre de 2016 se notifica mediante la publicación en el BOIB núm. 126, la Resolución de concesión de las ayudas para el fomento de la agricultura ecológica por el período 2015-2019 al beneficiario Isabel Duran Galmés con número de expediente 135 y DNI ***9697**, por un importe anual de 1.777,78 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;5.Con fecha 1 de noviembre de 2016 se notifica mediante la publicación en el BOIB núm. 138, la Resolución de concesión de las ayudas para el fomento de la agricultura ecológica por el período 2015-2019 al beneficiario Especias Crespí con número de expediente 146 y NIF A07118227, por un importe anual de 5.066,52 €. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;6. Con fecha 19 de mayo de 2018 se notifica mediante la publicación en el BOIB núm. 62, la Resolución de subrogación a favor del beneficiario Especias Crespí y la consiguiente revocación del solicitante Isabel Duran Galmés. El nuevo importe anual del cesionario Especias Crespí es ahora de 6.844,30 € &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Con fecha 27 de febrero de 2019 se registra en la aplicación de Gestión de Ayudas SGA la solicitud de subrogación total por parte de Especias Crespí a favor de Tap de Crespí con NIF B16605958. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han comprobado la información necesaria para efectuar la evaluación del cumplimiento de los requisitos por parte del nuevo titular para ser beneficiario de las ayudas tal y como estipula el apartado décimo de la resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 28 de febrero de 2015 por la que se aprueba la convocatoria, para los años 2015 al 2019, de las ayudas destinadas al para el fomento de la agricultura ecológica . &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;9.Durante la evaluación de los compromisos, se comprueba que el cedente Especias Crespí con número de expediente 146 y NIF A07118227 no se encuentra inscrito en el CBPAE, incumpliendo el punto noveno, apartado 2 de la convocatoria referente a las obligaciones y los compromisos del beneficiario. Además, el cesionario Tap de Crespí con NIF B16605958 no cumplen con el requisito de la convocatoria, punto tercero, apartado 7) de estar al corriente de las obligaciones tributarias. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;10.El incumplimiento del requisito de las obligaciones tributarias implica una exclusión del 100% de la ayuda, consiguientemente, no puede ser beneficiario de las ayudas previstas en la convocatoria, denegando la subrogación a favor de Tap de Crespí con NIF B16605958. Paralelamente, el incumplimiento de inscripción al CBPAE también implica una exclusión del 100% de la ayuda y por tanto procede revocar parcialmente la resolución de concesión para el beneficiario Especias Crespí con número de expediente 146 y NIF A07118227, tal y como cómo se explica en la Tabla I. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;11.Con fecha 30 de octubre de 2023 se publica en la página web del FOGAIBA el Informe propuesta provisional de denegación de subrogación y revocación, emitida por el Servicio de ayudas al Desarrollo Rural al interesado Tap de Crespí con NIF B16605958 y Especias Crespí con número de expediente 146 y NIF A07118227, concediéndose un plazo de 10 días para presentar las alegaciones oportunas. Dentro del plazo establecido, el interesado no ha presentado alegaciones para realizar posibles enmiendas, o bien si las ha presentado, se han desestimado. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;12.Se ha considerado el informe/propuesta provisional de Resolución, publicado en la página web del FOGAIBA, de denegación de la subrogación y revocación de los interesados Tap de Crespí con NIF B16605958 y Especias Crespí con número de expediente 146 y NIF A07118227 , puesto que no cumplen con los requisitos de la convocatoria, consiguientemente, no pueden ser beneficiario de las ayudas y debe denegarse la subrogación al cesionario y revocar al cedente.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;Fundamentos jurídicos&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Illes Balears (FOGAIBA) de 28 de febrero de 2015 por la que se aprueba la convocatoria para el año 2015 de las ayudas destinadas al “Fomento de la Agricultura Ecológica”, la Resolución de 9 de junio de 2015 (modificación de la primera) y Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) por la que se modifica la Resolución del presidente del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 26 de febrero de 2015, por la que se aprueba la convocatoria, para el año 2015, de las ayudas destinadas al Fomento de la Agricultura Ecológica. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;7.Reglamento de ejecución (UE) núm. 808/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1305/2013 del Parlamento Europeo y del Consejo, relativo a la ayuda al desarrollo rural a través del Fondo Europeo Agrícola de Desarrollo Rural (FEADER). &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;8.Reglamento de ejecución (UE) núm. 809/2014 de la Comisión, de 17 de julio de 2014, por el que se establecen disposiciones de aplicación del Reglamento (UE) núm. 1306/2013 del Parlamento Europeo y del Consejo, en lo que respecta al sistema integrado de gestión y control, las medidas de desarrollo rural y la condicionalidad. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

Revocar parcialmente la Resolución de concesión de la ayuda solicitada al beneficiario Especias Crespí con número de expediente 146 y NIF A07118227 con los importes y cofinanciación detallados en la tabla I, relativa a la línea de ayuda “Fomento del 'Agricultura Ecológica 2015” anualidad 2019.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
