&lt;p&gt;&lt;span style="color:black"&gt;1. El 17 de diciembre de 2022, en el BOIB número 164, se publicó la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022 por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2023, para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;2. Las personas o entidades que figuran en el anexo de esta Resolución obtuvieron una subvención para la implantación de instalaciones renovables.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;3. Las personas o entidades que figuran en el anexo de esta Resolución presentaron la documentación justificativa de las actuaciones realizadas, donde se acredita que el importe de la actuación ha sido inferior al previsto inicialmente o se ha reducido la instalación.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;4. Los servicios técnicos competentes han informado favorablemente el pago de las subvenciones descritas en el anexo, donde se incluye una aminoración del importe proporcional a las modificaciones realizadas, las cuales se han calculado de acuerdo con la Resolución de convocatoria de estas ayudas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;5. El 25 de octubre de 2023, se emitió la propuesta de resolución provisional del director general de Economía Circular, Transición Energética y Cambio Climático &lt;/span&gt;por la que&lt;span style="color:black"&gt; aminora la cantidad de la ayuda y se propone el pago de las subvenciones en el marco de la convocatoria pública &lt;/span&gt;para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR2023)&lt;span style="color:black"&gt; (BOIB n.º 148, de 31 de octubre de 2023) y se ha agotado el plazo de diez días hábiles que se concedían para presentar alegaciones sin que se hayan presentado.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;6. El 21 de noviembre de 2023, se emitió la propuesta de resolución definitiva del director general de Economía Circular, Transición Energética y Cambio Climático &lt;/span&gt;por la que&lt;span style="color:black"&gt; aminora la cantidad de la ayuda y se propone el pago de las subvenciones en el marco de la convocatoria pública &lt;/span&gt;para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (FOTOPAR2023).&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Fundamentos de derecho&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="color:black"&gt;1. La Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;2. El Real Decreto 887/2006, de 21 de julio, por el que se aprueba el Reglamento de la Ley 38/2003, de 17 de noviembre, General de Subvenciones.&lt;/p&gt;

&lt;p&gt;3. El Decreto Legislativo 2/2005, de 28 de diciembre, por el que se aprueba el Texto refundido de la Ley de Subvenciones (BOIB núm. 196, de 31 de diciembre de 2005).&lt;/p&gt;

&lt;p&gt;4. El Decreto 75/2004, de 27 de agosto, por el que se desarrollan determinados aspectos de la Ley de Finanzas y de las leyes de presupuestos generales de la Comunidad Autónoma de las Illes Balears (BOIB núm. 122, de 2 de septiembre de 2004).&lt;/p&gt;

&lt;p&gt;5. La Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022 por la cual se aprueba, mediante el procedimiento de gasto anticipado, la convocatoria pública de subvenciones para el año 2023, para el fomento de instalaciones de energía solar fotovoltaica y microeólica dirigida a personas físicas y comunidades de propietarios dentro del Programa Operativo FEDER 2021-2027 (BOIB n.º 164, de 17 de diciembre de 2022).&lt;/p&gt;

&lt;p&gt;Por todo ello, dicto la siguiente&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;Resolución&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;1. Reconocer la obligación y proponer el pago de una subvención a los beneficiarios que figuran en el anexo, de acuerdo con el importe que se indica.&lt;/p&gt;

&lt;p&gt;2. Autorizar y disponer negativamente el gasto a revocar parcialmente de los beneficiarios y por los importes detallados en el anexo de esta Resolución.&lt;/p&gt;

&lt;p&gt;3. Establecer que los beneficiarios están obligados a cumplir el que dispone el apartado undécimo de la Resolución del consejero de Transición Energética, Sectores Productivos y Memoria Democrática de 12 de diciembre de 2022, así como los supuestos establecidos en el apartado decimotercero en relación a la concurrencia de ayudas.&lt;/p&gt;

&lt;p&gt;4. Disponer que toda alteración de las condiciones establecidas para la concesión de la subvención, así como la obtención concurrente de subvenciones o ayudas otorgadas por otras administraciones públicas o entes públicos, nacionales o internacionales, dará lugar a la revisión parcial o total de la subvención y, por lo tanto, al reintegro de la cantidad correspondiente más los intereses de demora.&lt;/p&gt;

&lt;p&gt;5. Publicar esta Resolución en el&lt;em&gt; Boletín Oficial de las Illes Balears&lt;/em&gt;.&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;Interposición de recursos&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;Contra esta Resolución, que agota la vía administrativa, cabe interponer un recurso potestativo de reposición ante el &lt;span style="color:black"&gt;consejero de Empresa, Empleo y Energía&lt;/span&gt; en el plazo de un mes contado desde el día siguiente al de su publicación, de acuerdo con los artículos&amp;nbsp;123 y 124 de la Ley&amp;nbsp;39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas, y el artículo&amp;nbsp;57 de la Ley&amp;nbsp;3/2003, de 26 de marzo, de Régimen Jurídico de la Administración de la Comunidad Autónoma de las Illes Balears.&lt;/p&gt;

&lt;p&gt;También cabe interponer directamente un recurso contencioso-administrativo ante la Sala de lo Contencioso del Tribunal Superior de Justicia de las Illes Balears en el plazo de dos meses contados desde el día siguiente al de la publicación de la resolución, de acuerdo con el artículo&amp;nbsp;46 de la Ley&amp;nbsp;29/1998, de 13 de julio, reguladora de la Jurisdicción Contencioso-administrativa.&lt;/p&gt;
