    <env:contingut rdf:parseType="Literal">![CDATA[&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El apartado&amp;nbsp;8.3. de la Resolución del&amp;nbsp;Presidente del Fondo de&amp;nbsp;Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) de 14&amp;nbsp;de abril&amp;nbsp;de 2023&amp;nbsp;por la&amp;nbsp;que se convocan, para el ejercicio&amp;nbsp;2016,&amp;nbsp;ayudas para el fomento de la producción integrada,&amp;nbsp;especifica&amp;nbsp;que la resolución&amp;nbsp;expresa&amp;nbsp;se notificará&amp;nbsp;a&amp;nbsp;los interesados mediante&amp;nbsp;su publicación en el&amp;nbsp;Boletín Oficial de las&amp;nbsp;Islas Baleares&amp;nbsp;de acuerdo con los&amp;nbsp;términos&amp;nbsp;previstos en el artículo&amp;nbsp;45.2&amp;nbsp;de la Ley&amp;nbsp;39/2015, de 1&amp;nbsp;de octubre, del&amp;nbsp;procedimiento administrativo común de&amp;nbsp;las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;Los expedientes&amp;nbsp;han sido&amp;nbsp;tramitados&amp;nbsp;por el Fondo&amp;nbsp;de Garantía Agraria&amp;nbsp;y Pesquera de&amp;nbsp;las&amp;nbsp;Islas Baleares&amp;nbsp;(FOGAIBA) en cumplimiento de lo&amp;nbsp;dispuesto en el artículo&amp;nbsp;43&amp;nbsp;de&amp;nbsp;la Ley&amp;nbsp;39/2015, de 1 de octubre, del procedimiento administrativo común de las&amp;nbsp;administraciones públicas.&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;El vicepresidente&amp;nbsp;en Materia Agraria del FOGAIBA, con fecha 2&amp;nbsp;de noviembre de 2023, firmó la siguiente &amp;nbsp;resolución,&amp;nbsp;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.Con&amp;nbsp;fecha de 15 de abril de 2023 se publicó, en el BOIB núm. 48, la Resolución de la Presidenta del Fondo de Garantía Agraria y Pesquera de las Islas Baleares (FOGAIBA) de 12 de abril, por la que se aprueba la convocatoria de las ayudas para el Fomento de las razas autóctonas en peligro de extinción para el año para el 2023. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2. De conformidad con el apartado sexto de la citada Resolución, el plazo de presentación de solicitudes de la convocatoria terminó el día 30/06/2023, y tuvieron entrada en el Registro del Fondo de Garantía Agraria y Pesquera de las Islas Baleares un total de 298 solicitudes de ayuda. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;3. Los órganos gestores del Servicio de Ayudas al Desarrollo Rural han realizado el control administrativo de las solicitudes y de la documentación aportada de acuerdo con las normas reguladoras de estas ayudas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;4.Los solicitantes indicados en el anexo I han presentado una alegación a la Solicitud Única de la PAC 2023 indicando su deseo de desistir de la ayuda solicitada por la línea de ayuda para el fomento razas autóctonas en peligro de extinción.&lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Fundamentos de derecho &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Ley del Procedimiento Administrativo Común de las Administraciones Públicas. Ley 39/2015, de 1 de octubre. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por aplicación del artículo 94. Desistimiento y renuncia por los interesados. Que en su punto 1 dice; "Todo interesado podrá desistir de su solicitud o, en cuanto esto no esté prohibido por el ordenamiento jurídico, renunciar a sus derechos." &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p style="text-align:center"&gt;&lt;strong&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Informe y propuesta de desistimiento &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;Por todo ello, se informa favorablemente y proposo al vicepresidente en Materia Agraria del FOGAIBA que dicte resolución en los siguientes términos: &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;1.- Dar por desistido de su solicitud de ayuda presentada en la Solicitud Única de la PAC 2023 de la línea de ayuda para el fomento de razas autóctonas en peligro de extinción a los solicitantes que figura en el anexo I, de acuerdo con las alegaciones presentadas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;

&lt;p&gt;&lt;span style="font-family:Times New Roman,Times,serif; font-size:12px"&gt;&lt;em&gt;&lt;em&gt;2.- Contra esta resolución -que no agota la vía administrativa-. Se puede interponer recurso de alzada ante el consejero de Agricultura Pesca y Medio Natural, en el plazo de un mes, a contar desde el día siguiente de la notificación de la resolución, de acuerdo con los artículos 121 y 122 de la Ley 39/2015, de 1 de octubre, del procedimiento administrativo común de las administraciones públicas. &lt;/em&gt;&lt;/em&gt;&lt;/span&gt;&lt;/p&gt;
